Actor Alec Baldwin was on trial this week for involuntary manslaughter, accused of killing cinematographer Halyna Hutchins. But on Friday, his trial was abruptly cancelled and the case against him was dismissed with prejudice. What happened?
As background, on October 21, 2021, Baldwin was handling a real gun as a prop during filming of the movie Rust. The gun was loaded with one real bullet, which discharged and killed Halyna Hutchins. Baldwin is on trial in Santa Fe, New Mexico, accused of involuntary manslaughter (negligent use of a firearm), or in the alternative, involuntary manslaughter (without due caution or circumspection.)

I was amazed at how Morrissey argued again and again (as a witness) why the evidence was not relevant--completely blocking the point! The point was that the prosecution does NOT determine what the defense should argue! It was completely astonishing. She unraveled as the day went on.

Technically this could fall under federal jurisdiction so its entirely possible for a federal prosecutor to charge Morrissey.

After the OJ case, every prosecutor should know they must dot every I and cross every T in a celebrity case. The investigation was sloppy and so was the prosecution. Seth Kenny should have been investigated.

They get away with violating rights every hour of the day, you can't expect them to completely change their life when a celebrity is involved (or a rich person). It would be too hard to train them all to respect rights at all times, right?

Gotta hand it to the defense. Their whole strategy was proving that this DA was engaging in gamesmanship. Considering this was the fourth or fifth motion to dismiss, I think the judge conceded she couldn’t give any more rope to the prosecution

I believe she earned herself a Brady notation in her files, and if not she will have a giant target on her back from every defense lawyer because of how publicly she messed up. Same with the lead investigator because even if they just failed to check that everything was solid they just lost an extremely high profile case due to sloppyness (and/or bias as the defense brought up in questioning).

The defence of Hannah knew about the witness and the rounds and did not want to use this evidence. It was not hidden. It came up at the end of the trial of Hannah. Than the mistake happened. A pitty for the victim family, as it would not have made any difference to Baldwins actions which were on trial.

The defence of Hannah knew about the witness and the rounds and did not want to use this evidence. And now suddenly it has a huge meaning in the case? It's a huge procedual mistake, no doubt, but it would not have made neither trial different. It's a pitty that it happened, a pitty for the victim family.

What was missing in this video is Morrissey's testimony. Which was that some of the evidence was hidden from her as well. I agree there should be an investigation. If it turns out Morrissey wasn't aware, then the lead investigator just slandered her on the stand. If she did know, then Morrissey lied under oath, when everyone told her that wasn't needed.

@@lilg2300 The evidence was exculpatory (it supported the defense's case) and intentionally blocked from the defense by both police and the prosecutor, hence the dismissed with prejudice ruling by the judge. It's just that simple.

As a former prosecutor, I definitely believe that the prosecutors violated their ethical and legal duty to disclose this Brady information. You have an affirmative duty to reveal this information. Part of the oath I swore to in my state says you are supposed to achieve justice, and I am sure it is the same where this trial is taking place. You have to try the case you have, not the case you wish you had.

Ah so as a former prosecutor you have obviously engaged in similar acts of warping evidence to appear favorable and hiding unfavorable evidence. The legal system is a nothing more than a sophisticated GAME with complicated rules--violate one of the rules, and you lose the whole game. This is absolutely insane that Baldwin ended someone's life and isn't going to be accountable for it.

The problem with the "silver dot" which is really the primer, is that apparently the guy who supplied reloads his ammo. That means the "silver dot" could be any color. In reality, you cannot tell the difference between a dummy and a live round which is why all ammunition is strictly controlled and live rounds are not ever near a set. Finding only 5 rounds make no sense in the setting of supplying live ammunition as it doesn't come that way. These are 5 LOOSE rounds mixed into the dummy rounds. As it turns out, the live rounds and the dummies were stamped on the case by the same manufacturer name. Next is a photo of the live rounds show that they had been reloaded and thus didn't have the same color of primer (silver dot). There are marks on the bottom of the casing that indicate they had been reloaded. Then it came out that the person who supplied the ammo, did indeed do his own reloads.

My father was a gunsmith for many years. I understand the difference in primer and casing etc. So I really appreciate you making the distinction in what was talking about. The difference in primer color is so minimal. There is no way that the actors could know the difference. I'm my opinion, Baldwin should have been taught more safety, but he wasn't responsible for this. There wouldn't be any reason for even a dummy round to be in the chamber for rehearsal

@@rc31802 Yeah i have been really confused with all the coverage of this case because it seems like everyone is so vitriolic towards baldwin. I thought that it was because he was the highest profile liable persons in the case so people were rightfully excepting him to be responsible for paying damages to the victim for liability reasons and that him fighting it was making them mad. But it seems like everyone wants him to be held to murder charges because ¿¿he was handed a loaded gun to practice a close up quickdraw scene in a gunslinger movie?? Meanwhile everyone seems so intent on reed being cleared of all wrong doing even though her job was literally made to protect actors from lazy/dangerous productions. I believe the first two responsibilities she would have had would have been 1: to confirm EVERY single round was a dummy on the off chance the supplier messed up and 2: make sure every gun was accounted for and unloaded when placed in the designated case. At which point she could cover herself with a well maintained service log. I haven't heard anything about her doing any of this. I really cant tell if this is just people not understanding the chain of custody or people with ulterior beliefs wanting reed to be innocent and baldwin guilty.

This was a poorly handled case by the prosecution. Alec Baldwin should never have been prosecuted for a criminal charge. This was always a civil case as per Baldwin.

@@arthurmoore9488 According to the testimony the decision to put the ammo under a different case number was made in a meeting with both the police and the prosecutors. The case wasn't really poorly handled. They didn't goof up. They made the choice to commit a straight Brady violation. They cheated and got caught.

A bit of background on Rounds vs Bullets. A round is made up of four things. 1. A bullet or projectile that leaves the shell or call under great pressure. 2. Gun Powder is very quick burning substance that creates a large amount of gas in a very short time. 3. The case or shell is usually a brass cylinder with a large hole in the top to hold the bullet and a very small hole in the bottom to allow a flash of fire to ignite the powder. 4. The primer is a small metal object that fits tightly into the case, and contains a small "charge and igniter" that when struck ignites the powder inside of the case. It takes all 4 elements to make a round. Some bullets, such as a 22, do not use a true primer, but instead have primer type material in the rim of the case (thus the term rim fire). There are also some shells that are not brass, but could be stiff paper such as a shotgun shell.

This isn't the first time the prosecutors hid evidence or lied. The prosecutor said she really didn't think the evidence was relevant. But that isn't her call. And more importantly, the evidence was hidden from the defense. Why hide it if it's not relevant?

@@fictionjunkie It's not the prosecution's call. They are supposed to turn over everything. When asked directly for it, they lied and said it didn't exist. They hid the evidence under a separate case folder...they sat around and decided to do that. The prosecutor lied about that too. This wasn't an accident.

@@ritaeichler2066 No, it didn't. There were many issues with the 'evidence' in the Karen Read case. For example, do you know that the vehicle logs that were referred to in Trooper Paul's testimony, that supposedly shows KR going '60 feet in 24mph' in reverse cannot be attributed to her? That is, she did not have possession of the car during that key cycle. It was after the car was seized.

The dismissal with prejudice is the repercussion for hiding evidence. That's not a slap on the wrist. I do agree that someone lied on the stand, and that should be investigated. If it's happened once it's probably happened before.

Funny how the lead prosecutor turned defensive immediately after it was exposed she decided to hide evidence that could be favorable to the defense from them and volunteered to testify. She got caught and should be disbarred for her lack of integrity

What a fiasco. This evidence wouldn’t make or break the case of Alec Baldwin’s negligence. This would have made little difference in the grand scheme of things had it been given to the defense.. imo. The LE and Attorney blew it big time.

I actually don't agree with you. They were denied material evidence that could be testified to by an expert. This is critical information for the defense. Would it have made a difference? We will never know since the prosecutor, the lead investigator and the crime scene tech intentionally lied and withheld evidence.

This isn’t just prosecutions not dotting I’s or crossing T’s. They put a different case number on the exculpatory evidence (the fake rounds that looked exactly like real ones from a man with a grudge against the armorer and wanted to get her fired.). They had NO GOOD REASON FOR DOING THAT. They were trying to hide the evidence. It was obvious to the judge and it’s obvious to me.

I believe at the time that her side was told about and given the opportunity to see the bullets, and they declined....and afterward, they were then filed into a separate file from the rust investigation evidence that would be disclosed in the balwin trial. I dont know if she qualifies for the same type of dismissal. To me, the bigger issue is HOW the live rounds got onto set. That is the person who needs to be charged for negligence.

​@tiredtears4177 To my knowledge, dummy rounds should always have a way to be identified. Such as already fired caps, or a drilled hole through the casing or sometimes a small pellet inside the round that will rattle when shaken. But always so the armorer can round for round manually inspect and verify that it's a dummy round and not a live round. And while someone else also looks. Just grabbing 6 rounds from a box of "dummy rounds" and insert into the gun and then claim "cold gun" is not the safe way. So there are multiple issues here. How did the live rounds get mixed up with the dummy rounds. How was the dummy rounds marked. And how come the armorer did not inspect each of the rounds when loading the gun?

@@Ashbrash1998 Yes, the assistant director we are talking about was expected to spend time with the armorer and dual-check the work. And then bring the gun to the actor while informing that the gun has been reviewed to be cold. That assistant director is named in the video and never got to trial because he admitted that the evidence of unsafe work was too strong to try to fight in court. But maybe there was yet another person that was also looking at the armorer's work? It's rather terrible if the armorer just takes 6 rounds and load, just assuming the box is perfectly safe with only dummy rounds. Because the expectation is that every single round should be manually reviewed when loading the gun. The best practices have been developed over many years based on earlier accidents, and "I was in a hurry" isn't a legally accepted reason to skip one of the steps. If the executive people refuses the required time, then the only acceptable path is to put in writing the safety issues and then walk home. Better to lose $$$ from one film job than to be sent to jail. how did the defense team discover this evidence? by the way I believe the defense said that Tresky handed over the rounds he thought may have slipped onto the rust set AFTER the Reed trial was over.

Defense never said, but it's likely either Hannah lawyer or tresky told them. Also, Reed trial was not over, but jury was in deliberations.

Can someone explain something to me? I am not an attorney, and I don't understand this: According to New Mexico law, one of the prongs of involuntary manslaughter is the accused had to be acting in a way that was reckless. There was a gun safety system in place at the time of the shooting, a system so effective that there had not been an accidental shooting on a movie set in decades. Baldwin is an actor, and not a gun expert. Baldwin was handed a prop gun that had been inspected by two gun experts...the armorer and the assistant director. He was told by the experts that the gun had just been inspected by them, and certified that the gun was safe. He was rehearsing his scene in the presence of the gun experts. He could expect that if he was doing anything unsafe, one or both experts would have corrected him. Neither did. So Baldwin was following the safety rules, and relying on safety experts. Where does the recklessness come from?

@@curteaton It's not analysis, it's a question. What safety protocols for handling a firearm on a movie set did he violate? And two certified firearm experts were on set, watching his every move. Both experts informed him (falsely) that they inspected the gun and ammo and certified it was safe. Neither said a thing about his actions being dangerous...their job. You think a non-expert, relying on two experts, is reckless?

@LawyerLee I think it is "a round" because a round is formed of a cartridge with a primer at the base (which ignites the gunpowder), gunpower and the bullet (the projectile which hits the target). As a English person who dislikes guns, perhaps a gun enthusiast can correct me if I have missed some detail. I do think it is wonderful that there are people who do not know much about weapons as England and The States are heavily militarised societies. For example, a friend's Japanese wife did not know what a grenade was. Weapons knowledge seeps throughout our culture. By, the way, I love the honesty, sincerity and warmth you display on your channel, even though I am a cynical agnostic.

3 years after the killing, some guy walks into the sheriff's office , DURING the Reed trial and says he has evidence regarding the "RUST CASE". There is something called a "chain of custody" where every piece of evidence has to be noted where/when/how it was collected. This evidence comes 3 YEARS AFTER THE INCIDENT. There is no chain of custody and to a layman, every live round looks like every other live round. How the ammo got into the gun isn't a matter of concern. What is of concern, is the fact that Baldwin pulled the trigger during a "rehearsal" and is on trial for involuntarily causing the death of HH. How the round got into his gun is a separate trial. The judge blew it. She could have put her decision to grant a mistrial off but she couldn't wait to get this off of her desk. Trials are a shapshot of time and in this case the snapshot begins when Baldwin has the weapon in his hand and ends when the round impacts. Anything before and after is defense bs.

Could this situation affect the Hannah Gutierrez verdict? I really liked Morrissey, I am so disappointed in her. I watched her every move during Gutierrez’s trial and was impressed with her, although she did always look flustered as if she had run to the courthouse each day. 😅 Thank you for the short video today, you cleared up a couple of things for me.

What a mess. As a retired Police Officer, you need to look at the failures involved in this case. Crime scene, the police, the Lieutenant who ordered the ammunition to be not linked, and the ADA. There needs to be an independent investigation by the FBI, and parties prosecuted if there is evidence of wrongdoing.

Does anyone else see the irony here? The case began because Baldwin didn't personally verify the rounds in the gun, believed them to be dummies, proceeded with the scene as per usual, and this terrible tragedy happened. The case ended because Morrissey didn't personally verify the rounds turned in by Troy Tseske, believed them to be unrelated to the case, proceeded with her business as per usual, and the case was thrown out on a Brady violation. She got to taste her own medicine.

THANK YOU! I have been scouring media reports on this to find out WHY those extra rounds turned in by Teske were so important to begin with!!! No one was filling in that detail. ALL the reports would talk about was how the prosecutors withheld the information, not the WHY and HOW those rounds were possibly connected to the case.
