I took a gun safety class years ago in Bedford Virginia and on the ladt night of class it was customary for a member of local law enforcement to come and talk to the class. For my class officer Grubbs was there to talk to us. The class had been friendly throughout the course but everything took a turn for the worst when officer Grubbs spoke to us. The first thing i remember his saying was that the first thing he will do regardless of why he was pulling you over once he called in your plates and foundout that you had a concealed weapon permit (running a stop sign, headlight out, etc.) is to place everyone in the vehicle in handcuffs no matter what. Then he would search you and your car. If you didn't give him permission to search he would call in a canine unit. The he feely admitted that if the dog didn't give a positive signal for something illegal the handler would give it a slight hand signal to have it sit or bark and that would be used as a positive signal. His words and explanation - not mine. At this point he turned most of the class against law enforcement and the instructors started looking uncomfortable. He was a complete bully to anyone that tried to ask any questions. Not long after that he was caught having indecent liberties with a girl that attended the school where he was a resource officer. Once he was found out he fled the state with the student and was captured in Kentucky when he tried to purchase gas with his credit card. Don't believe it when you are told the dog indicated something illegal in your car. Don't believe my story? Well officer Grubbs story is below. wset.com/archive/on-october-19th-2011-deputy-ew-grubbs-was-arrested-by-the-virginia-state-police-for-twelve-counts-of-indecent-liberties-of-a-minor-by-custodian wfirnews.com/news/missing-teen-could-be-with-fired-school-resource-officer www.nbc12.com/story/15738080/sheriffs-deputy-arrested-charged-with-crimes-against-children/

Hey, I'm in Bedford lol. Watching these auditor and cop watch videos, I see that handcuffing someone without articulating a crime they have committed is a false arrest. There are lots of videos where the people have been suing for violating their 4th amendment rights. Audit the audit, is a good channel that shows how the police violate people's rights.

Ummm. Not. This cop might have said so in this instance, but if he was corrupt enough to lie in court, why not lie to you too? These detector dogs are trained to alert only to a smell. An odor. A particular odor. Or a couple of particular odors depending on the breed and skill of the individual dog as required by COURT ORDER. This dog qualification standard has been challenged through various appelate (appeals) courts already. I know. I used to train them (the dogs, NOT the judges LOL. Albeit some judges could use more).

@fartymcfartface897 I never mentioned him telling lies in court or him telling lies. You made that up yourself. I was in a classroom setting while taking a gun safety course. Most of the people in the class were there in preparation for getting a conceal carry permit. I'm not sure why you would attempt to change the story. I know what he told the class - I was there.

Considering that a normal "alert" is to sit, and basic non-LEO obedience training is to sit at a slight tug on the leash, that makes perfect sense.

So about 10 years ago my wife and I got pulled over on I65. It was the middle of February in Indiana near Lafayette. 2am ,the temperature was around zero. The cop tells us they ran thier dog around the outside of our car and he signals we have drugs. We were told to either consent to a search or wait for a judge to issue a warrant. We didn't have anything so consented. They made us stand outside freezing to death while they searched. We had just came from a formal dinner in Chicago so not really dressed for the weather. Of course they found nothing. We to this day think the cops took some cash. We had recently returned from vacation and still had around $500 in cash in the glove box. Half of it was gone.

In 2013 after I refused to give them my driver's license because I was a passenger in the vehicle they brought a canine out and made it false alert to the vehicle intentionally so they can say oh, we have probable cause and then they searched the entire car. My brother was driving he's the one that got pulled over because he was speeding and I was in the front passenger seat. Then they commenced to violate both of our rights by turning the car basically upside down everything in it putting me and my brother both in handcuffs one at a time yeah this happened in the state of Indiana at the hands of the Indiana State Police. These people are criminals.

As a soldier in the mid 80's to 90's I took part in several "Health and Welfare" events where MP's brought dogs into the barracks on random drug sweeps. My favorite story from those happened in Germany around 1984. I knew one of my roomies was dealing and when the drug dog alerted on his wall locker I thought "Oh, man, he's about to be going down to turn big rocks into little rocks and little rocks into sand for a few years. The MP handler gave us all this little smug smirk and told the dog to "go get it" and pointed inside the wall locker. The dog dove in and started rooting around...and then we heard the crunching start as the GSD started wagging madly. The handler pulled him back and then had to try to wrestle a half eaten package of Oreo cookies away from him. The MP was the only one who's tail was dragging as he slunk out of the room.

There was an experiment done by a news outlet on drug dogs. They told officers where the non-existent drugs were before the test and the dogs "alerted" to those spots every single time because the handler was cueing the dog to alert.

A few years ago, local police in Jerseyville, IL set up a bomb threat to search my tavern for drugs. I call this town "The Jerseyville Cartel". They could not get a warrant in Illinois to search a tavern, so they had their CI to call in a bomb threat. Here comes the drug dogs. There was an occupied home literally 2 feet from the tavern building and they did not evacuate the home. They did not find any drugs on a busy night because I would not allow drugs of any kind to brought in. But that did not stop them from committing a felony. They detained everyone that was inside the tavern in the middle of a well travelled street at night with no safety lights or barricades. This is the same PD that killed a child for carrying a Bible on a public sidewalk. Google Roger Holyfield. His mother was an employee. Later, this PD set up a blacked-out police car from Missouri to park behind me at night and had several lighted cars at the other end of my parking lot as a distraction... To kill us. "The suspects tried to escape and my officers shot the suspects 500 times for their safety." This was an assassination attempt for two people. Police are our worst criminals. Felons with guns.

I paused during the intro to make this comment before hearing what he says. There is a growing mountain of evidence on the lack of reliability of canine detection of contraband. There are, I believe, even some court cases where the Judge has ruled the canine detection as inadmissible based on this lack of reliability, which means no probable cause for the search.

I was a K9 trainer for 23 years. Bottom line: if the dog’s mouth is open he is not searching. For a dog to sniff his mouth must be completely closed. Look at your own dog when he sniffs the ground. His mouth will be closed. Additionally, watch the officer’s face closely. He may use facial changes to prompt the dog to sit. He may also use nearly inaudible clicks or mouth noises to cue a dog to sit.

The thing is, the lay-person doesn't know what an "alert" actually looks like from a dog, and cops know this, and use it to claim they have probable cause. A few nights ago I was sitting in a parking lot minding my own business when a cop pulled up, I got out of the car, he asked if he could search my car. I told him no he didn't have permission. He then "decided to search my car with the dog". He told me the dog alerted. I have no idea what an "alert" looks like, not only that but I was placed in cuffs while he pulled my car apart. Looking in the gas tank, opening up the hood of my car, going into the back of it. The cop didn't find anything. But the mere fact that they can say that a dog alerted when it obviously didn't, is just fucked up.

Smell should not be allowed because it is subjective. I heard a story where an individual was pulled over. The cop said he smelled marijuana. The motorist stated that they smelled cilantro, pico de gallo, and carne asada. They had just passed gas. Saw a KZbin video where a cop claimed to smell marijuana and after finding nothing, claimed maybe it was from a passing vehicle.

I’ve seen cops say the dog alerted when I watched the whole thing and didn’t notice an alert at all. I don’t even have anything to do with drugs at all, but my main fear is that an officer will plant drugs while he is searching, which does happen. Once they are inside an automobile, he is greatly secluded from anyone’s view, including his own body cam if he is slick enough. And you’re right about the leading behavior and false alerts too. You’ve got a great channel, and you are passing along much needed information. Thanks!

While in the military I'd had two times I was alerted on. The first in Alaska while the plane was being refuel. Lined us up against a fence and run the dog. He alerted on the Kitkat I had, nearly missed my plane. The second time I was stationed at Ft Dix. Dog alerted on my parked car, submitted to their search and the dog wanted my Hardies leftovers. I guess both dogs were hungry. Dependable? I think not! I feel the same about polygraph and GSR test.

I've seen quite a few videos lately showing the officers allowing the dogs inside the cars that they are searching. The people get really upset and said that it's illegal to open the door and put the dog inside the vehicle, and according to the Supreme Court, a case of the dog getting on 2 legs and front paws going in the window. The person won and the police lost on that case. But they keep changing the laws so we have less and less Rights. I don't do drugs but I don't want a police dog climbing in my car. I also seen video showing a "Free air search" while the driver stays in the car. So everyone look up the law in your state because if you get out of the car, they can search your person plus find something in the car that wasn't there while you was in the car. Learn your Rights. ⚖️📜🥰

A friend of mine had his dog with him, was instructed to remove his dog and get out. A k9 was called. It was 37° outside and snowing. It was recorded by his gf who was still on the car. The 2 dogs almost fought... it turned out one of the cops called animal control. They came and IF it hadn't been for my friends dog being a support animal it would have been taken. After that the cops left his car in ruins, everyone in the cold for 40 minutes and yet NO probable cause and no alert from the k9....unlawful detention and multiple violations across the board. My friend sued and won. Takeaway is DO NOT CONSENT

Dogs are wonderful animals. I have three GSheps and love them all dearly. One thing for sure, when it comes to "treat time," they KNOW because they have LEARNED that unless they behave a certain way and perform certain tasks then they won't get the reward. A 10 year old can train a dog to perform like this. I say use them when you need to send in a diver for a dangerous situation or someone fleeing on foot...leave them out of the tasks that provide "cause" because they can't be cross examined in court.

The issue I have with drug dogs is that now they can run your plates and instantly have your entire driving record and criminal record on hand before they even pull you over. If you have a history of minor drug charges or charged/convicted of violent crimes or even having guns that is their excuse to continue to follow you. You don't even have to have been convicted just charged with any of the previously mentioned "crimes". Even if you have absolutely NOTHING in your vehicle they will follow you until you make even the slightest driving mistake and pull you over to go fishing. By that time they have already called the K9 unit to their area and that K9 unit arrives as the "backup" officer thus eliminating a long stop excuse to dismiss charges. The majority of the time you will never get a ticket on the original reason they pull you over especially if they find something after the dog "alerts". They will even follow you if you pull out of a "known drug area" in spite of the fact that you have friends or relatives living in the area and you were just there to visit them. They will sit for hours just waiting on you to pull out of the area especially apartment complexes. They will even drive through the parking areas to run plates just to tag someone to be BOLO (Be On the Lookout) for so they can find an excuse to pull you over and go fishing.

"The issue I have with drug dogs is that now they can run your plates and instantly have your entire driving record and criminal record on hand before they even pull you over." In some states the police have access to the CCW licensing records, so when they run your plate and get your name they're also notified if you have a CCW license and are more likely to have a (100% legal) firearm with you. Then when they pull you over they treat you like a violent convicted criminal: approach with guns drawn, order you out immediately, handcuff and frisk you. Because "officer safety", or something. Even better is when you have two officers in that car, and the illegal search of your car is part of their "training".

Regarding handlers and dogs, if there was any decency in the K-9 programs of any police department, they would require a recertification every two weeks, where both the dog's AND THE HANDLER's behaviors are CLOSELY observed and monitored for any inadvertent cuing of the dog. Every K-9 program that has any legitimacy is more heavily comprised of training the handler than it is the dog.

I seem to recall, some time ago, reading that Utah's highest court ruled that "drug dogs" were 1) not equally trained and 2) were reacting more frequently to handler signals than to any "suspicious scent". Thus, they prohibited the admission of such "evidence" in any court in the state. It's possible, I suppose, that the deficiencies have been corrected, but I am not convinced that the LEOs did more than sulk. Loudly. Thanks for the information.

I said no (my husband on the phone says no) She states the dog will come in. I waited at least 30 mins or more. During the time, the females officer is telling the story again what has happened with the past incident. Really, disrespecting and embarrassing me in front of others officers. I was really upset both times and I just really left me feeling as if I was a piece of crap because of the way she made me look. Well, after bringing the dog and waiting for awhile. The dog signaled and the lady with dog says my dog never lie. (I never even commented on anything that he was. Well, they searched and found a paraphernalia. It was not given to me as a paraphernalia but scraped out the residue and charged me with felony under a gram.

Years ago when my buddy was in high school, a drug dog "alerted" to the scent of his dog on his backpack. A few years after that, I got pulled over and the K9 "alerted" twice to my car: once to my tire where a tomcat had sprayed, and once to the box of fried chicken in my passenger seat. Too bad I didn't have a dashcam at the time to record the deputy saying that his dog regularly alerts to the scent of food and to the scent of other animals. And lastly: last year when I was listening to my police scanner, a deputy called for a K9, and they had to call an off-duty K9 handler because the on-shift K9 had already eaten. I don't trust drug dogs.

Since this video was 3 weeks ago according to KZbin… not one comment or question has been answered at least in the comments. So I doubt mine will. But I’ll try. What does perceive as “RAS” (Reasonable Articulable Suspicion) for probable cause since smell or odor is not valid for an officer? Let me explain. High Court: Odor of Marijuana Not Enough to Conduct Warrantless Search The Pennsylvania Supreme Court ruled in the final days of 2021, that “the odor of marijuana alone does not amount to probable cause to conduct a warrantless search of a vehicle.” This is “heady” stuff, no pun intended. The manner in which the trial court, and ultimately the Supreme Court, reached a decision in Commonwealth v. Barr, 28 WPA 2021, is interesting indeed. In the fall of 2018, the appellant, Timothy Barr, was the occupant of a car pulled over by the Pennsylvania State Police in Allentown, Pennsylvania. As the troopers approached the car they smelled an odor of marijuana. The troopers used the odor of marijuana as probable cause to search the vehicle. The Pennsylvania Supreme Court ruled that was an unconstitutional and illegal search and seizure! By this, if officer smelled an odor, it would not warrant probable cause for dog to search. Right?
@hamptonlawfirm
@hamptonlawfirm Жыл бұрын
Great point! The problem is that not all state courts recognize this precedent. This works in Pennsylvania but not in Texas. Odor of marijuana may, but not necessarily will, constitute probable cause. The odor of burnt marijuana is not the basis for a search in many states because marijuana use is not illegal. In Texas, possession of marijuana is still illegal. In fact, in Fort Worth, Texas, you can be arrested and spend up to 180 days in jail for possession of marijuana of less than 2oz.
@selfdo
@selfdo Жыл бұрын
@@hamptonlawfirm The phrase "I smell weed" seems to be all the officer has to say in order to detain someone long enough to get the drug dog. It would also seem logical that there's no way, if said K-9 unit is going to take 30-45 minutes to show up, that the cop is going to come away "empty handed", even if he has to, er...IMPROVISE. If in Texas, possession of less than 2 ounces of marijuana can result in arrest and up to 180 days in the county lockup, then it'd be very easy to frame up a person the officer wants to put behind bars. This especially if, during the "detainment", the subject is cuffed and placed in the "squid car", an arrest that NOT an "arrest". And police wonder why so many hate them.

and there is the wrinkle...if they have used a drug dog, you should have your attorney request the training and certification records of both the K9 and the handler. If they haven't kept accurate and detailed records, that can invalidate a search. and certifications only are valid for 1 year, but frequently teams of handlers and K9's have not received the next years certification prior to the existing certification expiring...so any searches done after one expires but before obtaining a new one become invalid due to the team being out of certification and anything gathered from the search becomes fruit from the poisoned tree and can be argued and thrown out.

Question: Floating around these days is the notion that if the police ask if they can search, you can take a moment to think (for dramatic effected, only) then consent. And as soon after as they start, REVOKE that consent - tell them you changed your mind and do not agree and want them to stop. The idea (loosely of course) is that allowing and then revoking - the revoking dominates their legal right, by taking back the permission. The cops can't then, simply begin again. What are your thoughts, please?

My sentry dog was trained to bark, growl and show his teeth with an imperceptible double pull in his leash. No verbal command needed. This was handy. I could say "Watch him Ralph", give him to cue, and he wouldn't pull on the leash, but would stand there and show his dental "equipment." Great way to keep an intruder from even THINKING about resistance. So yes, a dog could be trained to "false alert."

Dogs are also trained to alert on an otherwise innocuous hand signal from the handler, so if the officer wants "probable cause," he gives a twitch of his wrist (or whatever) and, Boom -- instant probable cause. These deliberate false alerts are never used in the official "accuracy" tests.

A major problem is if a k9 alerts on a free air search of a vehicle but weapons are found, especially if the weapons are found locked in the trunk. And with marijuana being decriminalized in so many states and even legal in a few, drug sniffing k9s are becoming obsolete for patrol duties. They are still necessary in ports of travel and entry but for street patrol not so much.

Tennessee Highway Patrol is FAMOUS for illegal stops - searches and civil forfeitures - aka highway robbery. They even run FLIR cameras on blacked out suburbans at night looking for out of state tags. Driving between Memphis and Jackson Tn to visit family. Cops see my rental car - pull immediate U TURN - and come after me. I waited for them to catch up to me - light me up - and I pulled over. Cop walks up and I asked him why he pulled me over. He said he noticed my out of state tags. I asked if being from out of state was a crime ? I asked if all police cars had roof mounted FLIR cams ? He never asked for my license or reg. I asked if he had witnessed me breaking any laws. He didn't speak. Are you already remaining silent to protect yourself ? Now he knows - game on. I said - time is burning - let's cut through the BS. You want to search my car. You're not going to search my car without a warrant, exigence or pc and you have none. He said - I can call for a dog. I said - " Rodriguez " says you're out of time. You already admitted you didn't witness a crime. Your stop is admittedly pretextual. It's actually illegal. Waiting for the dog would be more illegal and you searching my car with a fabricated signal from a dog would be even more illegal. You could lose your QI in the civil rights case and I don't carry cash - just so you can't steal my money. I said - tick tick tick tick tick. Do us both a favor - take your loss - tell me to have a nice day and go find a victim who doesn't know your game. He said - have a nice day.

If it went to court you could probably get any evidence tossed, but who will hold the officers responsible for detaining beyond what is permitted?

Do you have any fruits and vegetables? They might have have asked about weapons? We are from Provo, We are headed to Placer County for the holidays, I have no fruit in the car, there are no weapons in the car. Well, I get done answering questions. Here comes Karen Law. She has us pull over toward the offices there. I am not sure she even gave us a reason? Then she wants me to empty the luggage, cooler, etc. What did she find? no agricultural goos, nor did she find weapons. We had to repack everything.
