Okay, we can't shoot down a drone, but is it possible to nondestructively blind it with a high wattage spot light? Modern CMOS light gathering arrays are not prone to burnout like the previous vidicon tubes, so there is little chance of damage, and if you project light spectrum from far ultraviolet to low infrared it would saturate the imaging sensor, effectively blinding it. This would be especially effective in municipalities using drones not registered with the FAA as they could not charge someone with, say, obstruction, without revealing the illegal drone's use. Even if they are registered you are not required to assist in an investigation and it could be argued that blinding it amounts to preventing unwarranted invasion of privacy. In effect, you are creating a "light fence" that the drone cannot see over.

Moreover, since you aren't shining the laser at a human eye, using a green laser to permanently damage a flying camera should be lawful. I would argue that damaging the camera is not damaging the aircraft, since a drone with no camera can still fly.

The ruling was in relation to the TN state constitution. The US Supreme Court would have to make a ruling on a case for it to be nationwide.

Almost 10 years ago, my grandmother was reaching the end, and I thought to take her to see the ocean one last time. We were standing on a seaside cliff looking out at the horizon, when I noticed something hovering about 20 feet past the cliff and 10 feet above us. It was something the size of a large man's hand, and it looked and moved just like a dragonfly, with a small camera where the head would be. It was almost silent, and the way it moved made it hard to spot at first. Once I started staring right at it and became visibly angry that some fed or local PD would be spying on my family when we were on a day out, it moved on the the next group of people on the ciff, then the next group of people, and so on until I lost sight of it. They've been using these drones for a while, and by now, they probably don't look like anything we recognize.

Actually another attorney has said that you DO own the air space above your property which is why you can build up and create skyscrapers. The only reason planes can fly over your property is because the gov claims public right of way the same as if a 100 year old path ran through your property. I believe he did say what elevation was considered public as well, so don’t automatically think that whatever this guy says is absolute. You need a good attorney for this. Also, old farmers and ranchers will literally shoot F16s and other air craft flying over their properties because some dick head pilots start shooting their property, and those old guys know they are legally allowed to use fire arms to protect their livestock/property. I have heard many Air Force guys talking about how the planes came back with a bunch of holes in them and the gov has no recourse against the farmers because they were perfectly in their rights. So you DO have the right to shoot air craft.

I actually build these little things. It's pretty weird how the rules are currently laid out, and often times quite stupid. The latest lawmaking that they're trying to push is known as Remote ID, which they expect anything weighing over 250 grams to have a GPS lock and emit a registered serial number, location, and pilot location. Of course, this rule has a huge number of holes in it, and the hardware is stupidly expensive compared to everything else on the machine. To date, I think I've found one person who plans to comply. This is out of hundreds. We feel like we're getting screwed for something that helps nobody, and hurts us.

That is not correct. In most circumstances the FAA altitude limit is 400 feet maximum. Drones (the small ones that we're thinking of in relation to this video) can only fly above 400' if they are within 400 feet of a structure and not in controlled airspace.

Air rights typically extend 1000 feet above a property before the FAA gets a default easement for aircraft. Small drones are banned from going above 400ft. So, by default a drone would be encroaching or trespassing if it flew over private property. It seems like the law is pretty clear cut, it's just that a court opinion hasn't explicitly reinforced the law yet.

FAA rules on drones say 400 ft is highest you can fly. Most drone operators will not fly low about a house as they understand privacy concerns and don't want trouble. I had a neighbor ask if I was flying one low over his house. I told him I wouldn't do that but it wasn't me. I suspect it was the power company. He talked about shooting it down and I told him it's a federal crime.

I would say "Yes, take it out." No one has any business flying anything in your air-space. The more land you have, the more rights to the airspace you have to a certain point. Zoning matters too. However, everyone has the right to privacy and protection of themselves and their own property. Any un-marked device near my home can and will be immediately disabled, regardless of Agency. Why? Truth be told, how do we know it's an agencies and not a Cartel? These days, it's better safe than sorry.

I used to live way back in the mountains and was doing laundry. I had a helicopter just about land looking at me. Yes I was on the back porch using a ringerwasher. I gave them the finger because they were blowing my clothes off the line 😡

Police aircraft, planes and helicopters are clearly marked as police vehicles. How do you know a drone belongs to the police? A few years ago in my cottage area ( in Ontario, Canada), thieves were using drones to survey private property to see who was not at their cottage so they new it was safe to break into ( this was reported by the police). In this area there are strick rules about where you can fly a privately-owned drone to try to prevent this. Real estate companies have to fill out paper work with the authorities to use a drone to photograph a listing, but often still get the police called to check them out. I don't know if police use drones here, but I will be keeping an eye out for large birds.

Using a drone to peer into a window/living space would or should fall under the same ruling as a neighbor having camera's viewing your property. It's legal to view the happenings outdoors but illegal to view inside the house of said property.

Well, if you're in aviation, you'd better study up and learn what the FAA actually says, because even for an airplane or helicopter, it's a lot more complicated than that. And for drones, they are allowed in the opposite of the places airplanes are allowed, so that they don't hit airplanes.

One thing I would disagree with is that according to FAA rules an aircraft can’t get closer than 1000ft to anything over populated areas and 500ft to anything over sparsely populated areas or be in a position that in the event of an engine failure you would cause damage or undue harm to persons or property on the ground. I’m not sure exactly how those federal aviation regulations relate to drones but those are the rules for general aircraft.

couple years ago my oldest daughter notice there were drone flying over head of her home, cousin and aunt's home. one was even close to her aunt's home. they had like blue and/or red flashing lights. this went on every night and not sure even to this day why they were over their places

The first question is how do you know who owns the drone? Didn't the supreme court ruled you own the air space above your property and can shoot down drones that enter your space?

No the Supreme Court did not rule that you can shoot at drones, or any other aircraft. Weather people technically own the airspace or not is irrelevant. It was decided a long time ago that the airspace is a public domain that anybody can use according to FAA regulations. Even if you own that airspace, you cannot regulate it.

So if its not illegal to fly drones outside of a window and see in, and its considered a public vantage point, then it is not illegal for us to do it to them. Get some footage of some of these cops or politicians in the shower and watch it become illegal REAL fast!!!

with the ring cameras the police have access to them should be illegal. so insurance company's are using these drones without your permission. By the way, they have the tech to see through your walls now, so what is to stop them from using them?

Additionally, The FAA has stated that a home/land owner owns the airspace above their property up from the ground to "navigable air space". Navigable air space is defined by the FAA as 1500 feet above ground level and higher. So, how is it, that drones which are limited by FAA rules and regulations to not more than 400 feet above ground level are able to trespass above a land owners property???

Pretty much everything you said is wrong, except the 400 foot AGL limit for drones. And the 400 foot rule is more complicated than just being 400 AGL. You can be an unlimited height above ground if you stay within 400 feet of a structure, a cliff, or whatever. 400 feet from the top of an antenna tower, whether up or to the side or both, is OK.

Turns out it was a warrantless drone. I’m now on a list. Have hired an attorney. Told to remain silent if asked by police if I have ever stated “I wouldn’t hurt a fly”

Minimum altitude over buildings is 500 feet generally. Drones are allowed to fly from ground level to a maximum of 400 feet. Helicopters are different

More importantly, are we certain we have competent lawmakers monitoring police (ab)-use of these surveillance technologies? Remember, these lawmakers have granted police the ability to edit police body cam footage, as well as withhold public owned footage. Propose we deploy over our judges and other politicians to ensure they are compliant with laws as part of proto-type testing! Why do we allow injustice until lawsuits / cases reach SCOTUS? Seems like America is doomed because of elected incompetent lawmakers. VOTE WISELY!

Since drones are legally considered to be aircraft, and therefore have certain flyover rights afforded to aircraft, I would like to see the courts also clarify that they must conform to FAA-enforced minimum altitude regulations, as follows: § 91.119 Minimum safe altitudes: General. Except when necessary for takeoff or landing, no person may operate an aircraft below the following altitudes: (a) Anywhere. An altitude allowing, if a power unit fails, an emergency landing without undue hazard to persons or property on the surface. (b) Over congested areas. Over any congested area of a city, town, or settlement, or over any open air assembly of persons, an altitude of 1,000 feet above the highest obstacle within a horizontal radius of 2,000 feet of the aircraft. (c) Over other than congested areas. An altitude of 500 feet above the surface, except over open water or sparsely populated areas. In those cases, the aircraft may not be operated closer than 500 feet to any person, vessel, vehicle, or structure.

Hmmm - seems to be a conflict here. Can't fly above 400 feet, but can't fly below 1000 feet (of the highest point) in congested areas....seems like a loophole for city dwellers.

So called drones AREN'T AIRCRAFT. That's the issue everyone is having. The FAA can't just claim they are aircraft by redefined in the definition... This was just taken up with the supreme Court.. I've posted this countless times on this thread that this so called lawyer has no idea what he's talking about on this subject matter. He's making a KZbin video for clicks... Stating caselaw of cases that had bad lawyers. Then not telling you the full details of the real case

91 regulates manned aircraft and part 107 regulates unmanned aircraft. You're reading the wrong set of rules. Also most localities have voyeurism laws that protect you from "peeping Tom's" which would apply when non-police drones are being invasive to your sense of privacy. Under part 107 a drone is still considered an aircraft and you cannot interfere with its flight without facing legal consequences.

They used the drones that look like birds on my husband in the late 90s and early 2000s. My father in law would go and feed the wild birds at the house. N he told my husband one day, all the birds eat but those. 😂they were drones from the police. They have ones too that look as flies and bees. I have photos of how they look on the inside and the mechanics. I had them for years. You can find them if you do a Google search. You know now the LED light bulbs can be used to get information on you as well. I seen a way they hook the light bulb to a device that shows them/tells them someway what you were talking about and doing in a room. I'm not a technology person, hell I can barely get my phone to work properly. When it messes up I get a new one. So I'm not good with describing what I seen. Also they have all kinds of spy cameras.From smoke detectors to as small as a tiny screw in the wall. So don't trust a damn soul. They had a way to tell about energy and frequencies that is in a room. The CIA has had this type of technology for many years. Look into it. I'm not crazy. There's a case where they used this technology for some murder but it was probably a top secret file. I read and watched a short video of them explaining how the technology worked and how the energy creates like a memory of whatever in a room along the walls. What we need to focus on are these slaughter bots. Which are like those lil round balls that are released in the movie TWISTER. These are programmed to kill and take out people. You program them say for an example they put my information in them to say I'm a terrorist or whatever. The thing is once released you can't stop them. They seek to destroy. So they go through walls and doors to kill. Basically no emotion attached. No thinking no nothing. Done deal. I WILL BE PUSHING DAISIES BY MORNING. SHOT TO THE DOME. What is the difference between a police drone and a police helicopter? The drone is only a problem if the drone is flying so low as to be a real invasion of privacy, i.e. it is being used to look into windows not visible from the street without a warrant.

There is no distance that restricts drones. You do not own the airspace above your home. Not even one inch. Period. They can fly over one inch and it's perfectly legal. And if you shoot it down,you are being recorded shooting down a private aircraft. Not smart.

an elderly couple just was on T.V. regarding a peeping tom using a drone going window to window. Cops were called but drone operator was not located. So some random guy can send a drone to drop poison over your home or fly a dangerous explosive. Legislation needs to be updated.

It seems to me that since the SCOTUS ruled that aerial surveillance of a yard was lawful only if done with fixed wing aircraft from 1,000+ feet, any use of a rotary drone under 1,000 feet would be a 4th Amendment violation.

Had a cop spying on my through drone use once before in Canada Ontario (Peel Region). I live in a corner house #1 with a forest in the back yard past the fence. They hovered over the trees and were just looking through my light window. ( I can’t prove that last part but this region is notoriously anal and charges the most in the country for police fees a whopping 36.5% of tax in the area goes to the police force.)
