I was just going to comment that Professor Phyllis Gardner probably won't be too happy to be associated with the Theranos board or anything remotely related to Homes endeavors. She's always been a fierce sceptic to Elizabeth Holmes, Channing Robertson and the fantasy concepts of Holmes et al. And very rightfully so. She has her head screwed on tightly, the right way, without any cross-threading - contrary to for example Robertson.

Silicon Valley engineer here. I don't have any direct experience with what goes on in the business side of things, but I don't think anyone is doing the equivalent of "let's use our competitor's machines and say the results are ours". Maybe I'm just naive, but if I'm right, I don't think this case really affects how people will do business around here from now on. Yes, people "embellish" when presenting to investors, but what that means is that the presentation is full of aspirations. E.g. "if you extrapolate how well we did last year, then this is what you're going to see ten years from now". Every investor investor in "the Valley" KNOWS that such claims are NOT presented as guarantees; just suggestions. But again, none of that excuses passing off competitor's products as your own. What's kind of interesting is that the head-liner investors in this case do NOT look like typical Valley investors (ditto for the Theranos board; what does a former secretary of state know about running a medical testing company??), so maybe they didn't understand how we do things around here. A Silicon Valley investor makes smallish (as in, rarely in the $100 M range) investments in many technology companies knowing that most of them are going to fail, but also knowing that one of them is going to be the next Google. Their whole strategy is based on that one win being so big that it will more than pay for all the losses along the way. Unless you are telling me that the Walton family has a whole stable of medical testing startups in their portfolio, they are in a completely different investor category hailing from a very different part of the country that has very different views about how to invest.

As we are now seeing in the trial there are lots of instances where we can point to EH 'knowing' that Theranos' product was not up to the required standards. Who are those people that can actually change the laws for Jurors? I believe, every Juror is required to be payed by their employees, As soon as Jury selection begins, they should receive Regular salary for each day they are required to be in court. And.. those jurors with out jobs should also be paid by the court at least the minimum wage for the those same days.. As we know, the bills don't stop coming and arrangements at home still need to be made when a juror is sitting on a case. 2nd question? Does the Court Security Gaurds, the Court reporters, Court Police, Judge and Lawyers collect their Regular paychecks during the Jury selection process? I've seen cases, 100 jurors a day waiting to be questioned, arriving at 9 being sent home after lunch w/out being questioned yet and asked to return the next day ( mainly, as Lawyers and Judges work issues out) it happened repeatedly in the Floyd/Chauvin Trial.
