@@heathercoon3451 The baby might not be a strategic move. From the jury's point of view, having a baby right before going to trial is NOT what a good parent would do. If that is how they think, then having a baby would end up working AGAINST her. I'm willing to withhold judgement on whether she timed her baby as a way to gain sympathy from the jury. If she did do it for strategic legal reasons, it could have been to buy more time. Having a baby as a delay tactic doesn't seem likely to me though.

I have been so obsessed with this case and have listened to SO many videos/documentaries on it that my husband was so sick of them but when I played one of your videos he actually didn't want me to leave the room because he felt like you had content that was really well discussed. @@janetownley lol he listened to the dropout podcast with me and then zoned out with the rest of the things I listened to/ watched but I always feel like each podcast/documentary has something i didn't hear before lolll but my hubby just wasn't that crazy to rehash like 90% of things until now where he even requested i send him the link to the latest! I agree there has been little media interest. I think the whole thing has taken so long to get to court 6 years in total , people have naturally moved on. Also the court not allowing filming and limited access to the court room, it's just a hassle for journalists to keep up with for 3 months.

The fact she is using the "beaten oppressed partner" as a defense suggests she recognizes the crimes committed Other wise why offer any defense at all. Just praying the jury realizes what complete utter BS that defense is. Not only is trying that route a disgrace to people who genuinely suffer such oppression and violence but it insults the general publics intelligence. I cant wait for the "my voice got deeper" due to karate chops to the throat. Start to finish , top to bottom, the woman's a fraud. Oh and thanks for taking the time to explain the various legal concepts in plain English. Much appreciated

I think that is the most disturbing part of the whole thing is that holmes was aware the testing may not have been accurate and went public with it. I know the investors may have been duped, but the moral implications of inaccurate testing on top of e everything else.

For the grandiose project that she claimed to embark on it was an understandable choice of name. A name that symbolises (American) innovation. Somewhat similar to Tesla and the Tesla car.

There's too much other important stuff going on rn. R Kelly trial just wrapped up. Pandemic, wildfires, floods, infrastructure talks in Washington, climate summits, etc. absorbs all the media's attention.

If you've read the book, Theranos also paid a SF lawyer $1000/hr. to go after any dissident, whistle blower. What's his culpability?

Boies, one of Theranos' lawyers, was also given stock in Theranos so he had a financial stake in making sure dissident/whistle blowers where silenced. What's his culpability? even if there is culpability there's rarely ever anything more than a finger wag or stern letter in terms of punishment.

George Schultz did treat his grandson very badly, but I'd modify that 'idiot' remark to say that, while George Schultz did have a brilliant career in business, academia and as Secretary of State, he was by that point very old. Some people, when they age, loose their critical thinking skills and are easily duped. Scam artists often target them for schemes like extended car warranties. We may all be in such a situation near the end of our lives, so we need to be gentle with such people.

The patients should have been told that Theranos was in beta test phase. Informed consent. But Elizabeth Holmes massive ego got in the way of patient rights. I hope she gets convicted on all counts.

He has made detailed public statements where he was the only subject of the interview. Very informative. His own Grandfather ambushed him at George's home with a Thernaos Company Attorney, trying to get him to sign a muzzle agreement. Now you tell us he also served on the board of a company which paid over %150k to investigate his own grandson.

Yes I think he had to pay somewhere in the neighborhood of $400,000 in legal expenses to defend himself against Theranos lawyers. In my opinion he’s paid for the privilege to testify.

Hearing the explanation of derivative immunity makes me wish Canadian prosecution had this at their disposal when Karla Homolka testified against Paul Bernardo.

I agree with K Stacey - Tyler will testify. He seems to be a conscience- driven young man and will be willing to participate in seeing justice served.

In the medical community, including the medical laboratory testing community, there is not just an obligation to not lie, there is also a duty of care, in order to make sure that what one does is safe and accurate/appropriate. The CEO of such a lab has that duty of care, and "the buck must stop" with her. If and when subordinates bring to her attention that there were problems with the tests, and if and when, in response, there is not just inaction, but action to intimidate and silence employees that bring the problems to her attention (and it is pretty clear that this happened here), that is certainly when one must reasonably argue that there was intention to put patients into harm's way, and secondarily (by way of the roll-out) to defraud patients, medical professionals and investors.

Very telling that the vast majority of people who never heard of Holmes, when they started doing research on the story, came away having a very negative opinion of this woman. I am one of them. I cannot wait for her to hit the slammer. Watch her hold her mother's hand then.

He has been extremely good. I saw him on a film describing how hard it was to go to his grandfather with his concerns. I am admire him very much for doing the right thing. Whether they need him in this case though is another matter. Sometimes you just need a few witnesses rather than loads saying the same thing which just wastes the court's time.

He also was a whistle blower when under threat of litigation. If he was brave enough then, why wouldn't he be brave enough now. In the book it describes how his grandfather went totally against him, massively damaged their relationship - he was literally saying Elizabeth is a genius you are an idiot. Can you imagine! Why would he not testify to protect the grandfather who didn't protect him.

Keep doing these analysis! I am hoping Tyler testifies. He is a hero responsible for saving only gawd knows how many lives. Went through pure hell and he deserves his moment of justice. As for Elizabeth, I find it very irresponsible and possibly manipulative to go and get herself pregnant during a time like this. Even at the moment, that baby is being stressed by the absence of his mother when he needs her the most. But I hope the jury and the judge will look beyond that to bring on justice and teach a strong lesson in the industry that you do not fake data. Especially not in health related matters.

I feel Tyler Schultz will likely testify but let’s see how this goes. Thanks for providing a summary of weekly updates. Being a person with scientific background I was familiar with the flimsy testing procedure at Theranos. But it’s great you are describing it from a legal perspective which I have no clue about!

I am irritated that Schultz might be excused from testifying due to the privilege of his birth. Also, I don't see the point of his family blocking him. It is ALREADY very public what he WOULD say if he testified. Therefore, what "protection" can the Schultz family gain by stopping Tyler from testifying?? My guess is that he would be happy to testify.

This is a prime example of one of the reasons why health care is so expensive in this country. There's a lot of fraud and greed in that industry.

Elizabeth Holmes and Sunny Balwani were clueless with regards to how to run a high tech company trying to develop very complex and groundbreaking technology. For one thing management should not angrily attack people who step forward and warn them about problems. Instead legitimate problems need to be acknowledged and corrected. Also, you cannot create an environment of secrecy within the organization. Instead effective communication is critical to allow a coordinated, unified effort.

I’ve heard there’s no cameras in federal court rooms but I absolutely have seen federal hearings that were recorded online. It was an appellate three judge panel, and I think I even saw one that was in an appellate en bank panel.

These are great Mr Sartes, I love how you get to the point and not brag about how amazing you are (I think a lot of people know who I'm referring to, ugh I cannot stand "I'm am the best, look at me" braggadocio). I'm guessing Holmes might try the "Poor me, I'm so sorry and I'm a new wife and mother. Sunny beat me up until I caved" defense. I hope she does in fact, because they jury will see right through that and send her away for 20 years. It's not fair on that poor child, but there are only two people to blame here and Holmes is the main one.

I predict Elizabeth Holmes will be found guilty but will ultimately not spend nearly enough time in prison because of her status as a new mother. During her sentencing hearing the judge will probably show leniency and cut her time by far more than she deserves.

I heard Holmes had a baby a year or so ago. Hard to think she got preggers so that someday if found guilty, she would be a new ish mother of an infant plus the fact all these crimes fall into white collar corporate crime, and with those 2 big items, sadly I think she won't be put in the prison

Fascinating to get your expert legal insight on the trial and the whole affair, thanks! Also for giving balanced impartial information. I have a question (or 2) about the jurors. 1. In the end did the court select only people who had really never heard of Theranos or EH? Or who had only a passing acquaintance with the case? You would have to have been living in a cave for the last few years not to know anything at all about it! 2. Second question (hope it's not dumb!) I've heard the jurors aren't allowed to discuss the case or the testimony between themselves, correct? But are they also forbidden to access the media (TV, podcasts, papers, etc) for the duration of the trial? If so, how can that be enforced? Are they kept in isolation in a special facilty (quarantine style)? Thanks!

There's a Netflix series?! So Fascinated by this trial. Normally, I don't bother with the trial, I just wait for the verdict, but this is so fascinating, I think I'll follow the trial through this channel. Thanks so much for your updates. Quick question though, isn't the fact the Chung's testimony mentions Tyler an indication that he will testify? Otherwise what she said he said would be hearsay. I know she has the emails, but in an English Court, (I studied at the bar here🇬🇧 ) he would still have to take the stand to verify what Chung said and he would also have to authenticate his part of the the email conversation. Is this not the case in US federal law? Just curious. Many thanks for your great videos. Also love the sketches. It's how it's done in the UK too, no cameras allowed anywhere.👍🏽👍🏽
