Judge Hippler's opening comments seem very on point to me. I think he's seen the shenanigans and won't tolerate them. When my ex asked for early release from probation, his comments in denging that motion were very similar in tone. I have a lot of respect for this judge.

My thought of the Judge’s initial comment was that he wasn’t happy to be there due to the circumstances of the case and what he will have to view. It’s an awfully tragic and graffic case.

What's happening in Delphi is scary and it seems there are already so many reasons Allen would win an appeal. The judge needs to be removed for starters. Those innocent girls deserve justice but not if it's done unfairly. It could be any of us in that defendant's position.

I was in the courtroom yesterday. When they brought him into the courtroom, he was cuffed behind his back. Once he was situated at the defense table, but before he sat down in his seat, the bailiff removed his handcuffs. I couldn’t see his feet. But by the way he was walking, and the clanking metal sounds I could hear, I’m assuming he had shackles on his ankles that stayed on during the whole hearing.

It’s my understanding that the time it will take to have the defendant change into street clothes from his orange jail attire is what the safety is for. I’m sure the guards are like if the other defendants aren’t allowed he is only setting up problems inside the jail as they will demand they get the same treatment he does. During trial yes he should absolutely be in street clothes.

They have to cuff him because he is being transported from outside in non-secure areas. Before in Moscow, the jail was underneath the courthouse. In this situation, he has to go outside, get into the van and walk into the courtroom hence the cuffs.

There's absolutely no reason for Kohberger and his defense to regret this move. The defense has built a solid record from the start, and we've all seen how the last hearings (especially Payne, Mowery, Ray) went. We also saw a confident and arrogant prosecutor turn into a wreck when it became apparent he'd actually have to present this "case" to a jury. Bryan isn't taking a plea deal, and the prosecutor won't be able to hide behind the gag order, the FBI, or anything else. The defense has every reason to be optimistic because the prosecution has to convince all 12 jurors in Idaho. If they lose just one during the trial, Bryan walks free. If he is convicted, the same applies to the decision between LWOP and the death penalty. One Juror can change the outcome.

I think that PCAff.was full of unexplored holes, would-be implied promises, and gave the good citizens of Moscow a feeling of security and justice settled; that is until they learned there was not much more convincing evidence against the guy they got arrested and jailed - nothing from his vehicle , apt., work/school or his past (a dog lover and he never stalked anyone, etc.) afterall. The only shenanigans were from the direction of that Prosecutor, and what he could exaggerate, embellish and invent and cattily point out to character assassinate under the harshest of prejudicial light. He got away w/it in Moscow until that "survey" hearing which most got confused because of the judge's spin on what exactly he/WT were trying to do! Great p.r.switcheroo/ manipulation, I'll give them that, but his bluff is about to be called in this new venue, I'm guessing. If this new judge looks at what started it all, maybe the case could be thrown out by the end of Oct.esp.if not a UID alumni or no connection whatsoever. But just based on all that was never done in the beginning of its investigation, the mishandling/ignoring/disregarding of other valuable evidence they "accidentally" lost, put aside or deleted (and covering for the survivors' absurd 8 hrs' delay, know-nothing yarn for not contacting MPD...)🤔

Based on her statement to the judge, and like LYK highlighted, perhaps not all of the discovery is brand new. It appears she has multiple pieces of the defense she’s positioning as a need for pushing the start of the trial. Perhaps she needs more time with the discovery, perhaps she needs more time with the newly acquired expert witness. Perhaps not. But she’s asking for it nonetheless in hopes her request is granted. The point I was making, and Runkle highlighted in his take as well, an arbitrary measurement of GBs as to the amount of discovery is highly suggestive as to what it actually is. 1TB of text documents would be a mountain of discovery. 1TB of high quality surveillance with both video and audio could be minutes/hours of footage. Based on their comments concerning anticipated length of trial, I’m sure they’d like to have more than ample time to review everything thoroughly before pre-trial deadlines at met and the trial begins. Up to the judge to decide what ample time means. Not so speedy, speedy trial /s

She should be moving a lot faster. So if what you're saying is not true, and not all of the discovery is brand new, then that should make her job a lot easier since she knows what she has and has not seen before.

But they are busy and you tell them they have a deadline of August…better believe you are getting discovery August. The judge is right that almost certainly the expert would be finished for whatever time the deadline is set…they’ll just have to more highly prioritize the case.

First i am glad we have a new judge. Judge Judge was great but overwhelming with the defense issues. Next if he can afford a suit I think that is good.

Ann did not make a good impression on the judge by not telling the full truth about the “New” discovery dump. As well as not wanting to tell what type of expert she was having to hire due to death of one. The judge was wise enough to ask and get her to admit it was for a mitigation issue instead of guilt/not guilty phase. This means May is possible instead of September. Risking going into the holidays now.

It would have been helpful if at least Santa or his elf had known what they found after almost two years. Unfortunately, neither could answer that question. When Santa handed her the hot potato, Madame Shush was visibly irritated and overwhelmed. I'm looking forward to the Franks hearings and motions to suppress because this judge certainly doesn't need advice from Backseat Bill on how to do his job. It doesn't matter which phase the expert was hired for, as the defense has the obligation to complete both phases before the trial starts. I still don't see the point of this since if there's an acquittal, it's a waste of time and money, and if there's a conviction, a few weeks or months wouldn't make a difference, but that's how it works in Idaho.

I feel like Ann Taylor’s style of defense is delay, delay, until the sharpness of the crime wears off, people forget a lot of what happened, then go to trial. And what’s wrong with August? It won’t be any more trouble on the jury and they’d be done by the holidays?

The prosecution needs to turn over ALL discovery ... They have dragged their feet way too long! This isn't just an issue with the defense. The defense is on their 17th request for discovery ...that is insane at this point!

Did you miss where the judge asked the prosecution if they had complied with the deadline to turn over the rest of the discovery? At what point should the prosecution shoulder some responsibility for causing delays? It’s been 18 months and took the judge ordering the prosecution a deadline. The prosecution waited until JUST before this hearing to dump 390 gigs onto the defense. Neither Thompson or Jennings could even tell the judge how much of that was new discovery. It’s inexcusable for a prosecutor to take 18 months to turn over discovery.

@@mikeard210 because you asked a question about the defense delaying things. I was curious if you’re aware of the delays caused by the prosecution. I’ve looked back through the court filings and I couldn’t find anything in any of the motions or documents that indicated that the defense hadn’t complied with deadlines. I could only find multiple incidents where the prosecution had missed deadlines or in one instance, the prosecution said they would turn over the rest of the cast data once they received the defense’s alibi and the defense filed the alibi by the deadline and the prosecution didn’t turn over the cast data. They said in court they couldn’t turn it over because now that they’ve got his alibi they needed their experts to look at it. Which makes not sense. The cast data doesn’t change. There was no reason for that hold up. I have no skin in the game regarding this case. I just read the filings and watch the hearings and the things going on in this case are really concerning. I’d like to clarify also, I meant no disrespect towards you or anyone by my comment. I apologize if my comment seemed that way. It was a genuine question with no ill intent, just discussing the case with other folks who are interested court cases like myself.

I understand that the families of the victims are upset with how Kohberger is being presented. Still, someone needs to explain to them-- in the nicest possible way-- that their feelings don't factor in the process, and that their public antics aren't helping anything. The pre-trial and the trial have to be all about the defendant, and maintaining his rights, so that the end result can be justice for the victims.

If you listen to their interviews, they don’t seem to be open to feedback. They have said stuff like “we won’t be silenced” and “we will do what’s best for us” and “I’ll talk to every camera if I want to” and so on

Why is this defense gets all these lawyers, resources, monies etc but other defenses don't even get 2 lawyers or gave to fight to get a professional to prove batter spouse syndrome. I just think Anne Taylor is tooooooo expense. How much is that monies going into her pocket just my thought. All those resources and still can't get to trial. It's crazy. If I was the prosecution I wouldn't allow for the defense and judge to be meeting by themselves. She can talk you into buying a burned down building.
