How would that have helped? Charlie could have withdrawn that waiver at any time, including during the trial, which would have been a lot worse. I think this judge, who I adore, really messed up by not removing Rashbaum the moment Charlie was put on the states witness list.
@u.synligАй бұрын
@@EffSharp To have summarily "removed" Rashbaum (when Charles A. was added to the witness list) would have required the judge to overstep his authority. As Judge Everett inferred, Rashbaum represented that he was on top of his ethical reponsibilities to both his former and current clients. The ball was in Rashbaum's court; and, while the judge _could have_ 'nannied' or nagged Rashbaum to make sure that this licensed attorney and officer of the court had continued to 'do his homework' as the case progressed, Judge Everett had every right to believe that this experienced (and well-compensated) attorney was not failing at his job.

@u.synligАй бұрын
The judge did not "forget that Charlie did not waive his right." As Judge Everett said here, *"The only way Mr. Rashbaum's representation could occur, is if both ends of the conflict were waiving."* In presenting his current (conflicting) client to the Court -- to be examined concerning her understanding of the potential conflict, and to speak her waiver under oath (the "colloquy") -- _Rashbaum implied to the Court (and the State) that he had already obtained such a waiver from his previous client (Charles Adelson)._ One doesn't embark upon the new, before settling with the old. The judge _could have_ nannied Mr. Rashbaum (in this, and in _all_ of his other professional duties... why stop here?), and nagged him to show the signed waiver from his client files. But it should not be (and, normally, is not) necessary for a judge to stand on the neck of an experienced, well-compensated licensed lawyer and officer-of-the-court, to see that he fulfills the most basic of his professional responsibilities.
@YIKESMFАй бұрын

Very helpful explanation. The whole situation with conflict makes no sense. How would a judge allow it if they can rescind the waiver at any time? The State can incur the expense and be halfway through a trial and then the waiver is rescinded in writing? Crazy. Also, how is Morris not tainted from this? How can he proceed? Isn’t it fraught with issues for an appeal?

It was Donna's plan from the beginning, but Rashbaum ran away before he could be sacrificed for Donna. By retaining Charlie's lawyer as her own, Donna reduced the risk that Charlie would turn against her. Charlie has the option of selling out Donna and/or Wendy to reduce his prison years if the appeal fails. If Rashbaum stayed on as Donna's lawyer and Donna gets convicted, she would have appealed, arguing that her constitutional rights were violated because incompetent counsel did not properly advise her or misled her about conflict of interest issues. If that fails, she might finally turn against Wendi.
@JennifermcintyreАй бұрын
What’s even crazier… Rash was actually Donna’s Attorney long before he was Charlie’s… since 2016 so Charlie/Rash was technically conflicted from the beginning. Two coconspirators swapping an attorney.. what could possibly go wrong??

Question? Wasn’t Rashbaum Harvey and Donna’s lawyer at the start? And when Charlie was arrested he switched to him? Could Charlie be trying to use that on his appeal?! Maybe they didn’t do waivers then either?! This is wierd. I just swear I remember hearing he was theirs and then switched to Charlie. So technically this be 3rd switch if I remember right

Wendi did testify under oath that she met Rashbaum in 2016 after Sigfredo was arrested for Dan Markel shooting. He was meeting Donna & Harvey if I remember correctly (so you are indeed correct). Why Wendi was there is a mystery to me.

Charlie could have rescinded his consent at any time, even during the trial as Peter said. DR, the “sophisticated attorney from Miami” as the Adelson’s condescended to Tallahassee people, has a lot of egg on his face since he can’t produce any signed waiver…ever!

I have never been happier getting a guilty verdict. This has been so long drawn out and it's about time she gets her punishment. I just wish the cameras were pointing to her face on when they read the guilty verdict. Juror #3 when he shouted YES after being asked "is this your verdict?" Im glad the jury felt the same

I bet Mama Adelson is not happy with son Charlie for losing her attorney and the delay in her trial! She may turn on him!! But then, if he gets wind of that, he may turn on her. Mama was pretty unhappy with Wendi also distancing herself from the rest of the family, so who knows who she might turn on to possibly get a plea deal.

They said the reason there's no signed waiver. It was a jail/prison issue. There was issues with being able to get into the prison to have him sign in person.
@JennifermcintyreАй бұрын
That sounds like a weak excuse. Maybe they didn’t want to go all the way to South Dakota where he’s located now or to Tallahassee from Miami but inmates have the right to meet with counsel. Think they are just trying to cover their major issues.

I just rewatched the STS interview with Joel and Dan Rashbaum. Dan Rashbaum says he had written waivers and his clients had spoken to independent counsel. I don't thinkRashbaum said the same thing in court....not good in my opinion.

I feel Donna and Dan's relationship was to close. Dan should have never taken Donna's case period. Dan knew he didn't have Charlie's waiver SIGNED and perhaps was hoping it wouldn't come up

Right. And I think he might have started getting too big for his britches and thinks he’s above the regular rules and sanctions of lawyers. Kinda fat cat celebrity after being employed by and enmeshed with this family since 2016. I keep saying this but Donna is in for one rude awakening when Dan R doesn’t take her calls now that she’s not financing his life. Also wonder if Rashbaum is privy to any knowledge of other criminal activity by this family-if he’s run the risk that he might ever find himself in the hot seat being questioned by Georgia.
@gmac9766Ай бұрын
How many combined years of schooling did it take for all of the lawyers and the judge in the room for none of them to figure out this would be a problem. CA was convicted less than a yr ago - so his appeal is apparent. I am surprised he is not being called in the initial case, only for rebuttal. This case should have started with the waivers of both parties.

Peter, Rajon knew exactly what he was doing. He said out loud on surviving the survivor, that everyone had signed waivers, including Charlie. He knew that Charlie had not signed the waiver and had always known. But he said out loud in front of God, and everybody that Charlie had signed a waiver, knowing he had not. Go back and look at the hearing, and see how happy mom was to be off the case. He was smiling all over the place, and had a definite bounced to his step. He wanted out.
