Just because you are released from the hospital, it doesn't mean you're all better and still not sick. It just means the hospital can't justify the cost to treat him further. They are putting his health at risk by the material witness arrest, and throwing him in jail, and then making him sit for hours on end to testify. Shouldn't he be resting? Doesn't he have pneumonia? WTF? I'd fire my attorney too if he didn't force the DA to put me up in a cushy hotel with room service while I testify and recoup.

I mean for one it’s not nearly that straightforward, a long term patient could have lots of oxycodone in their system and not be up for a DUI if they were coherent and with it; in fact the same patient could be charged with a DUI for *not* being loaded - rarely ever has happened but as someone habituated will be worse off without that becomes the default “intoxication” state. It’s also different shit, a DUI doesn’t necessarily mean someone’s mind is gone but their hand eye coordination and balance etc might be fucked, so someone can be on some shit and still very coherent. As mentioned also the nature of habituation is understood. If he been using for 30 years, that’s the most sober he gets is when he is “well”

HIPAA states that upon medical information being given out, if it is orally done, it is for that instance, and only that person(s) privy to the conversation at that time. For any extended period of medical information being given, written approval must be given. If I'm at the hospital, and my son is there when the doctor comes in, and asks if it's OK to talk in front of my son, and I give verbal approval, once that conversation is over, my son is no longer eligible to receive my medical information.

Judge was clearly in the wrong even though she was getting upset and acting like the lawyer was being difficult, HIPPA is quite strict and patients do indeed need to give updated consent when the situation or parties the doc talks to change (idk if they actually ended up video chatting w the doc, I’d be surprised if a doctor disclosed to a third party any info without clear consent from the patient to talk to that person); I suppose he *could* have given a blanket authorization to the doc and lawyer to discuss anything necessary with anyone from the court but I doubt he did that. The judge would not have appreciated the lawyer making it even harder to come to any resolution but IMO he decided to be more easy going in the interests of his career and potential future cases w Whitaker, not what his client wanted. In the other hand, he did consistently represent to the court that his client was on deaths door and was greatly harmed by the need to testify, to the point where they were openly considering the nuances of what would happen if he died during his time on the stand, and tbh he doesn’t seem *that* sick , not that sickle cell is a joke but I think he def did seem to embellish the situation. How is the Judge yelling at Lil D attorney but not at Love who is completely unorganized, ill prepared, and just horrible at her job! What is so difficult about this trial is IF these men are guilty of all these crimes the DA has come in with such dirty hands that it makes it impossible to convict them. Makes me question our legal system on so many levels!

What's even more crazy is that the dudes already have had a trial and did time for their crimes. However, double jeopardy is allowed in a RICO. To me, that is just insane and ridiculous . When they appeal can the call a mistrial with prejudice with all the breaking of laws between Love and the judge?

This Trial is a waste of time but entertaining. DA Love only seeking revenge because she was letting Nutt slam dunk in her, it’s clear that this case is personal to her. I hope it gets revealed during trial and it causes a miss trial . I understand it’s her job to trial cases but in this case she falling apart!!! I’ve been following this trial since it came out that the detective was asking out a witness. I always watch trials live but for so long this trial hasn’t been able to make it through the day so I gave up. Thank you so much for giving the energy to edit out the pauses! I don't understand why Judge Whittaker never calls out Love for her despicable behavior! Everybody knows what Love is doing so I know that the judge knows what Love is doing too so it's disingenuous for the judge to pretend like there was nothing nefarious going on! I guarantee you that Love's behavior is going to be investigated by the Professional Attorneys Qualifications Commission because of her conduct during this trial and rightly so! I I can't even imagine how many complaints they must have gotten about her so far!
