He is going to court to trial. His sentence is now down to a jury. A jury can find you not guilty if you are guilty or guilty. A judge can't go against a jury's decision. The reason that all those who had it out with the police and a Mosque and sent Tweets went to prison is because they pleaded guilty. Pleading not guilty is available to everyone , and the process would unfold as we are seeing here, this is a nothing burger legally. The implications of pleading guilty from the outset are that this can be taken into account in the sentencing, generally a reduction in sentence , in this instance that is now not available. If you are not guilty of course you should plead that , but the legal system decides if that is true , even innocent there is risk in being prosecuted. Also beware of your legal council encouraging a guilty plea if your innocence is clear cut , there is a video on the UKIP channel I think where the presenter attended the court cases of 6 people from the "far right" riots, all were advised by their legal representatives to plead guilty in the hope of having reduced sentences , only one did not. The five guilty pleas were instantly sentenced to custodial sentences, if their pleas made a difference to their sentencing is not clear. The 6th , the not guilty plea, was given bail and faces future court proceedings. The 6th was merely present at the event, and at least from the account given they did nothing illegal, they are confident in their ability of being able to rebut in court any claims of guilt, or that such guilt simply cannot be established, but there is still risk in this. Now the topic has a man pleading not guilty and he remains remanded , not on bail , this seems a normal state of legal affairs. So I don't understand how you question "how is this fair". This story only becomes interesting when the court makes a verdict, and if you plead not guilty you have to go through the whole process.
