Versace Misdemeanor Legally, once the warning or citation is issued, that detention and investigation is over! The trooper searching the car even with his consent would not hold up in district court because a new probable cause and or reasonable suspicion would have to be present in order to conduct a search. Those charges would be dropped by the Lt. or prosecutor!

In my opinion,OHP Troopers are better trained than alot of people think... As a example, you have a flat tire on the way to work, Trooper will stop and make sure you are okay.. and after a check of everything, will help change the flat tire.. most Troopers carry a 2ton floor jack for changing a flat tire on the car they drive,and they don't mind helping out changing a tire... I drove a cab and assisted a trooper changing a tire on his car.. did I have to stop?? No, but I have more respect for the Trooper that I could stop and help him get back on the road to repair the tire... By the way,I only worked the jack.. old Yellow cab driver...

This is PERFECT time to just shut up and refuse a search. The officer just told you he was releasing you. He cannot delay the stop any longer to bring a police dog to perform a search, according to the supreme court, so all you had to do was refuse, and ask the cop to let you go. Whatever happens at that point, you are protected by the law. Its a good thing the cop was very cool, thats fairly rare on this show; otherwise this might have gone sideways for both the driver and passenger.

Only problem I have here is at 2:06 Guy asks "Am I under arrest?" Lady responds "Yes, he'll talk to you about it in just a second." No, the driver is not under arrest. He is being detained. The police, at that very moment, did not have enough evidence to charge him with the crime of possession of a controlled substance. They certainly had enough evidence to detain him; they had reasonable suspicion that he committed a crime, but had to investigate further to determine if they would charge him with a crime since the other occupant was the one who actually had it on his person. But hey, if this is the biggest problem I had with this traffic stop, then great.

That other guy did not need to be arrested, if he declined consent to search the vehicle and the officer had no probable cause to search it then he couldn’t have done anything, unless the officer opt’ed to bring a drug dog.. but again, go to that KZbin channel and learn your rights!

Let’s not forget that passengers in Oklahoma are NOT required to show ID unless they are about to commit a crime, have committed a crime, or are committing a crime! Also, legally... the charges for cds would not hold up in district court because once the warning or citation is issued, that detention and investigation for the original probable cause or reasonable suspicion is over! Those charges would most likely be dropped by the detectives and or prosecutors because new probable cause or reasonable suspicion would have to be created in order for the search to be valid regardless if he gave consent or not!
