Seems Massachusetts doesn't ask? Or maybe that's just what pros says. I'm sure similar things have happened, but I think the prosecution tends to dismiss those charges knowing a jury acquitted all but technically. But this pros and CW doesn't seem to do the right thing

Their strongest argument by far is that the judge gave them no opportunity to be heard at the time she declared the mistrial. She didn't tell the parties what she intended to do prior to bringing the jury back in. She had the jury brought back in, read their note into the record and then instantly told them their service was concluded and she was declaring a mistrial. Once those words leave her mouth the case is over. And it is standard operating procedure in cases where someone is charged with multiple separate counts that the judge goes through each count and asks them if they are unable to reach a verdict on each count. It's absolutely preposterous that you could get a vague note just saying we're deadlocked and declare a mistrial on all counts without even inquiring whether they were deadlocked on all counts.

I was on a jury in 2015 where we found the defendant Guilty of 5 charges and unable to agree on the 6th charge. We were sent back 3 times and it was 11 guilty with 1 not guilty so we could not get past it. We were asked to tell the Judge the verdict on each charge. The Judge in the Karen Reed case was bizarre to me and shocked when no one asked for verdicts on each charge here.

The trial is unique on several fronts, and that's reinforced by several other spaces where there is continued media coverage. There is fallout from the case, more investigations and other charges. I thought Bev shut them down hard when they were arguing for the clarification to all counts and not just the lessers? She had her own agenda …. And she was really tired….poor woman. A fellow woman’s LIFE is on the line and it is clear to Helen Keller that she was framed and is innocent and proven not even there at the time Jen McCabe swears she saw her out the window SEVERAL times…. After she dropped John off and he went into the house. But I digress…. Omg my heart rate can’t take this stupidity of so many people!!! I did think the defense argued about the jury instructions on having the 2 boxes, but Bev kept holding the piece of paper up that looked like something a teacher I had in 1976 that just came off the mimeograph.

Judge Cannone literally told them she was giving them both verbal and written instructions and that, if these differed, they were to follow her verbal instructions. But they were not allowed read-backs! You can't make this stuff up!

All the lawyers PRESUMED the jurors understood. They didn't. And I'm not sure the defense GETS THAT. Presuming what the jurors that came forward have said is true.... they came to a verdict on two, hung on one, and didn't understand they could "split the verdict" and were looking for more instruction from the judge. EVERYONE presumed the jurors knew all the nuances of rendering a verdict INCLUDING that they would not be further questioned. It sounds like they EXPECTED the judge to ask some variant of "have you come to agreement on any of the counts?" and she didn't and then bam it was over. The JUDGE should be in the position to hold the hand of the jury as to procedure. ASK the probing questions. The JUDGE is supposed to be the neutral party and be on the JURY'S side as to how to rendered a verdict and work through the process. I keep listening to attorneys talk about this and ALL of you keep going back to very tiny points of law. Ordinary citizens are not aware of such things. They just know they need to render a verdict....the subtleties and nuances of the law are absolutely not known to them. They do not know. It's an argument for a professional jury.

The Judge did not offer the note to the parties before bringing in the Jury. Neither party had time to form a sentence or stand up before she said mistrial and Jury released.... I certainly didn't expect her to talk so fast and doubt the Defense did.

I think the judge was intentionally deceptive. She knew and still knows it was HER JOB to clarify what charges they were hung up on and it’s HER JOB to make sure everything is spelled out to the jury and that mistakes like this DO NOT HAPPEN….

He doesn’t know the rules of evidence, he objects and doesn’t know why but he knows he doesn’t want the true provable fact evidence out…. And his sugar mama sustains his objections with no legal grounds. “What if any” sort of did you do” and repeating every sentence a witness said. That sham trial should have been no longer than 2 weeks even with all his BS LYING witnesses had he just been a competent attorney.

Riddle ME THIS???? When did it become a requirement, for a JURY to be so precise in their notes to the COURT/JUDGE, that they needed to LITERALLY and figuratively, go to law school, to CONVEY and EXPRESS, what they were conversing about whether individually or unanimously, in LEGALESE? A jury is normally a group of Laypeople who do not know NOR do they fully understand the precise legal verbiage to put in writing to convey what they are thinking. They were told not to take a poll at the beginning of deliberations, which would have most likely been extremely helpful, and also the natural thing to do, just to SIMPLY SEE where or how everyone was thinking and feeling from the get go!!!!!! They were not allowed to read transcripts or see anything else that was presented in court, unless it was in their notes, or were relegated to memory, and EVEN THOSE Notes couldn’t be shared with each other!!! The instructions were very very very confusing, and I personally was under the impression that if you found NOT GUILTY on COUNT 1, (meaning that a CAR wasn’t responsible for JO’s death, then the other charges didn’t even apply). I went over the instructions time and time again with various people, and still thought if there was no accident, there was no crime at all. Should’ve been a jury poll and it did feel like they were rushed out of the courtroom. That’s what it felt like to me. I’m assuming they felt the same way. I think they were waiting to be asked additional questions. It was extremely confusing after how many CW witnesses? 74 or something like that.?

I CANNOT STRESS THIS ENOUGH!!!! HEALTH BEGINS IN THE GUT!!!!! My mom died tragically last December because she did not take care of her gut!! I agree. Aged 14y my daughter became ill. It took 6m for Dr. to diagnose H-Pylori. Despite after antibiotics I knew that long lasting problems must have taken affect. Lo and behold 1 year later she was rushed into emergency surgery for a perforated ulcer at 15yrs old! 10 years on and she's just been diagnosed with Barrets Asophugus. 😢😢

The remedy tells us the argument. The problem would have been cured by the judge inquiring about verdicts so they could be docketed under Mass Crim.R. 28. Unlike the judge here, the judge in Blueford inquired about verdicts.

And when Bev read the jury instructions, she told them they must find all not some and also told them to pay more attention to what she said rather than what was written. I just think the whole thing was very confusing and went super fast at the end. She did not allow the defense to see the note from the jury and brought them back in with no discussion upon which time I told them she was declaring a mistrial leaving no one room or time to say anything. Of course the defense could have interrupted but they didn't. I sort of felt like we all sat there thinking what just happened? Because we didn't know no one knew the split for the count or anything and I felt like Bev would find out when she went to speak with the jurors as she mentioned and would then tell the defense. We know she didn't. We don't even know if she spoke to the jurors though I assume she did. But they seem to have felt the same way and they didn't know how to resolve what needed doing. I wish at this point the remainder of the jurors would come forward so we would know they all are in agreement. And they may or may not before Monday I'm more interested in finding out what this new judge means. No one else seems to be covering it. Yes, Turtleboy already has a documentary contract & several said they've seen them lurking around the courthouse. Turtleboy was contacted for both a movie & a book. Lol... Grant later came forward & said he is also writing a book. I don't think he gets Turtleboy is getting paid for his!! I do think, tho, if this doesn't get resolved, we will hear from the jury. I think they'll come forward and raise hell if the CW retries Karen Read. And yes, KR did put her house on the mkt but doesn't want it known. I think she's had a lot of issues with lookie loos, so there are very strict conditions on seeing the house. Zillow has the info.

Defense did make a huge objection about ballot form. Jackson was stellar but was shut down .Bev came back with a shitty edited ballot. I did not understand it myself. Bev would have punished Jackson if he questioned anything else. The jurors said it all….rushed everything at the the end , put on the bus and left the courthouse CONFUSED.Bev basically said “see ya” and ran away. So freaking bizarre . Ughh

You can be pretty sure, after all this, that his career isn't squeaky clean and they've got SOMETHING on him from some case he's fixed for them. Maybe this one or a past case of railroading or dismissal.

The judge was so quick to a hung jury. She read the note from the jury and didn't asks the lawyer about there opinions. She quickly git up and left. The defense had no time to argue the decisions.

She had already asked the lawyers after the second time the jury said they were deadlocked. The defense wanted her to call a mistrial right there, but she instead sent them back a third time. Did you see how happy the defense was with the mistrial?

This DA, Lally and Judge are doing everything in their power to prevent the defense a chance to figure out what verdict the jurors had truely decided apon. The CW and this judge don't care at all that there is a good chance that they never had an opportunity to deliver their true final verdict. They have absolutely no respect for the jurors true decision. They dont care in the slightest that there is a very real probability that these jurors did NOT get an opportunity to enter the outcome of all their diligent work and careful deliberation. This rule says that the judge must be sure they entered they verdicts they COULD reach first. This rule also provides that the court may declare a mistrial in cases where the jury is unable to reach a verdict. **** However, it MUST first receive and record the verdicts which the jury CAN agree upon.****

I’m very sad. I have been a long time resident here and I strongly feel Karen Read is being ambushed. This trial was clear that she is innocent. I don’t see how anyone can’t see that. It scares me that this has happened. I would not have the financial means to fight this and I am a nurse. I pray for justice..

If she was guilty then the alberts would have been out on their front yard that morning trying to help John. Not buttdial, delete, destroy, rehome and move. If Karen Read was guilty there wouldn't have been inverted videos, there would have been taillight pieces in the couple of inches of snow at 6am instead of none. Jen wouldn't have told Dispatch that they flipped John over onto his back and that she saw him get out of the vehicle and that he had been in the elements for a couple of hours when he was found. If she was guilty the plow driver would have seen him. The snow wasn't deep. Matt MaCabe would have seen him when they left but no one saw him that left the Alberts. Snow wasn't deep it was only a couple of inches by morning. This is all proven facts which comes from the one's who had a hand it. When John arrived at the hospital he was being treated as an assault case, as in beat up. Anyone that thinks she's guilty then tell me why the Alberts and MaCabes are so shady. They would have been transparent on everything but 1 lie lead to another and another. This shitshow of a trial and incompetent judge a cw should dropped the charges and retire permanently. That town and half the people in it are as crooked as a snake.

@debidriscoll8108 still investigating but the fbi has said even in pre trial motions in letters sent that Karen should not be prosecuted. They are the ones that gave the defense proctors texts, the crash reconstruction experts, thousands of pages of discovery etc bc they firmly believe Karen is innocent and the case shouldn’t have been brought to trial.

@@debidriscoll8108 the 2 witnesses that the defense had at the end were the guys the FBI/DOJ hired for their federal investigation that said unequivocally John was not hit by a car and it was impossible to think so when looking at the facts, science and physics, biomechanical engineering and some other big brain words I can’t remember. Those guys were HIRED or paid by the defense. They were hired for the FBI investigation into the trooper’s and state’s atty investigation. They were impartial and had nothing to do the either party. Sent reports to both State and Defense. State chose not to even bring it up. Defense chose to bring it up. Same with some of the phone data…. Came from the feds. CW should be just fired and smacked around for being corrupt and or just plain having the intelligence of a box of tampons.

It is simple: When double jeopardy is forbidden, there must be a clearly defined process of finding out of a jury had come to a verdict on some, but not all of the charges. The protection against double jeopardy has a higher priority than the possible interests of a court to „get a trial over with quickly“, and do sloppy work in the process. And these questions should NEVER be left at the discretion of any single judge to rule on.

With how thoughtfully worded both of the notes from the jury were I'm a little surprised that they didn't mention that they were only hung on one charge. I know if I was on the jury I'd want that stated in the note.

One of Bev’s instructions was for jurors to tell NO ONE what any of the votes were, not even her. The jury could have reasonably thought that meant not saying anything in the note to the court.

Hi Peter. The very last jury instruction directed the jury not to fill out any of the verdict forms until they had decided unanimously on all counts. Thus, if they had voted and conclusively decided on counts 1 & 3 yet were deadlocked on count 2, they were not yet supposed to have filled out any of the verdict forms. They entered the courtroom to inform Bev they were still deadlocked, which to them seems to have meant they weren't decided on every count. Bev declared a mistrial and released them without the jury ever having had a chance to say "wait a minute! What happens to our verdicts on 1& 3 which are already done and final?!" Further inquiry must be undertaken of the jurors.

Did the Jury have the instructions with them? Did the Jurist not fill out any of the forms? I would blame the Jury Foreman for allowing 2 counts to not go away and turning that note in. The Foreman should have said on Counts 1 & 3 We, the Jury find Karen Read, not guilty, & on count 2, we are hung.

Im gonna try cold plunges. I just got a grounding mat. Omg. Its amazing. Red light therapy & MB has increased my energy, improved my sleep & decreases pain. When the jury foreman sent the letter explaining that the deadlock wasn’t due to confusion on the law, I immediately called BS. It’s obvious now that they didn’t have a full understanding of the law and their instructions.

I think this is a "recollections may vary" situation. They couldn't get a playback of testimony, read transcripts, etc. These jurors had to rely on memory and notes 🤦♀️

I still cannot get past the fact that they didn’t put it in their notes to the judge or even ask for clarification. They had numerous opportunities to do it. All of their notes made it sound like they couldn’t agree on any of it. Their note also stated that it was not due to their understanding. That clearly states they understood.

Today would have been my 52nd wedding anniversary❣️ we were soul mates for 46 years, and because he had killed his knees while playing college b-ball ~ he was 6’5”!~ he needed his left knee replaced. He made it through surgery with no problem. A month home, he suddenly went down on Super Bowl Sunday with our 6-year-old grandson at Walmart. He had developed a blood clot, and by the time they figured it out, they couldn’t get to it, and he died. So here I sit on my anniversary, missing him so much and dreaming about seeing him again (we both believe in Jesus)! Love each other mightily and never go to bed angry! We had a great marriage, and I long to have him back! Hugs 🙃b

She could have been like .07 when she dropped John off at that house and he never came back out (because he was ambushed and beaten and killed and attacked by the dog) but anyway, she could have been .07 when she drove to the house where he was murdered, and then went home very pissed off because she thought he was blowing her off and partying so she drank when she got home. Unbelievable what is going on in the case that isn’t even a case! They did not secure the crime scene! They didn’t even secure the house and separate the witnesses. Makes my heart race!

The defense did have a problem with the jury instructions, they had a heated discussion with the judge over them and the judge had to leave the courtroom to cool down. When she returned, she said that the original instructions will remain but she will add supplement sheets. It is my belief that because there were multiple sheets where the jury had to check boxes for the same thing may have confused the jury so they chose not to check any box.
