Long Term Disability Insurance and Social Security Disability

When you file for long term disability with a private insurance company like UNUM or Prudential, there is a very good chance that your insurance policy will require you to also file for Social Security disability.
Your LTD carrier wants you to win approval from Social Security because (1) the monthly payment you receive from Social Security will offset, or reduce, what the LTD carrier has to pay you each month; and (2) your policy likely contains a provision requiring you to turn over your lump sum SSDI award to the LTD carrier.
If you are not prepared for your insurance company's claim on your SSDI money you will likely be very upset when you get a letter demanding your SSDI lump sum check.
LTD carriers argue that the insurance premium you pay contemplates an SSDI offset but that does not make it any easier to sign over that $15,000 or $20,000 check.
LTD carriers may also try to assign a non-attorney rep to "help" you win SSDI, but you have the right to select a lawyer of your choice.
Despite the offset, there are some advantages to qualifying for SSDI after your LTD award. First, your LTD carrier is much more likely than Social Security to try to cut you off. If the insurance company is successful, you have your SSDI to fall back up.
Second, your SSDI payment almost always includes a cost of living increase each year, whereas the LTD payment does not.

Do you have to pay the long-term disability carrier for the money paid to the attorney? If so you lose 20%+/- to the attorney and also to the Long term disability insurer for 40-45% loss.

I have a question regarding combined SSD & LTD. What happens in the following scenario? I initially was paid 66.66% of my salary in full by my LTD provider. They assisted in getting me on SSD, & my total monthly payment was divvyed up between LTD & SSD. I have 3 years left (will be 65 years of age) on my LTD policy at which time it will expire. My question is what happens at that time? Do my SSD payments increase by the amount of my LTD monthly benefit? Does SSD pickup the amount that LTD was paying me before my LTD policy expired? Would greatly appreciate any feedback…

I was an LTD adjuster, u will get your SS benefit only, your SS benefit was just an offset from LTD, unfortunately at 65 you will be taking a pay cut.

Thanx for the quick response. So in 3 years time I’m gonna be faced with some serious monetary issues. My LTD policy was written & contracted to be in tact till I turn 65, in 3 years. I have been collecting my LTD benefit since 2000. In January of 2003 SSD was forced upon me by my LTD provider. SSD paid approximately 53.55% & LTD paid the balance of 46.5%. So for 16 years my LTD provider was not paying per my contractual agreement of 2/3rds my salary as it was divvied up between SSD & LTD. Shouldn’t LTD still be on the hook for not paying my full 2/3rds salary for 16 years? Also, my LTD provider offered me a lump sum payment recently. It amounts to approximately 79% of what I would make if I received my monthly benefit for the next 3 years, at which point I will turn 65. In your professional opinion does this seem like a fair offer? Can I negotiate with my insurance company over the amount offered? Thanx so much for your feedback in advance…
