Because she knew it was nasty, and she didn't think that should matter. She thought that the repairs he had to do were irrelevant to her case. She thought because he didn't send a detailed explanation of deposit kept for repairs, she could make him pay her double the deposit. I'm so glad she was wrong. Not only nasty but devious.

I understand a little of what the plaintiff is saying if they used cheap paint or flat paint the walls do ended up looking like that I lived in my apartment for 19 years I repainted twice and I didn't use the cheap paint. We they did they flooring they hired cheap labor it started coming up immediately and the tile has the sit if you dont do these things it doesnt work out when I tried to show the laborers and their bosses how to do it because the boss was watching a youtube video they called the landlord and complained so we took picture's just in case when we moved they wouldn't try to make us pay but they already knew we took pics

we would always have a pot luck at work and i would never eat anything that one lady would bring because her car was a complete mess so i just pictured what her house looked like. im talking fast food cups and wrappers piled up on the floor so high it spilled on to the passengers seat. the whole back seat would have junk in it. mail, more food garbage, boxes, etc. i just knew her house had to be a mess too. id watch people eating the food she brought and just cringe.

@@branz2002 im picturing it in my head. they used it, then couldnt put it in the sink to get washed because the sink was full of other dirty dishes. so they put it on the counter next to the sink to get washed later. the counter was so full of trash and other dishes that to make room someone just stuck it in the drawer in the bottom of the oven and never thought about it again. when they were moving out someone opened the bottom drawer, saw it there, and thought nah we have lived here 5 years let the landlord throw it out and just shut the drawer.

I've never left a rental that didn't look better when I left than before I moved in. This wasn't wear normal wear and tear, it was real damage. One major reason why landlords don't want to rent to couples with children. The damage to the wood floors alone was thousands of dollars. Their artificial fireplace/ heater probably pulled too many amps and smoked the outlet and wiring.

My first appartment was small and the landlord was not communicative, so I used wood pencils to draw a landscape on the door (thinking it would be easier to paint it back when I leave) thinking this would be ok. Other than that, I always wash the walls, counters, floors, everything before I call the landlord in for an inspection.

it can be normal wear & tear with cheap products & cheap plain white walls with a bad flat paint job. that ceramic tile in the bathroom was laid OVER a linoleum floor, whoever laid it was too lazy to remove it down to the subfloor, it will always crack like that in that way. Cheap wood flooring that isn't treated will scuff like that. These photos are classic telltale cheap products wearing out after 5 years of basic use. Sometimes the scuff marks on the walls are actually the paint underneath showing through because someone painted it white without priming the walls first. this is all classic stuff, seen it before.

But if you're renting you'd need to alert your landlord about it ASAP. And try to take pics if at all possible showing uneven tile. Then you'd have a leg to stand on against the landlord saying it was all your fault. Definitely wouldn't just leave and hope for the best🤦🏾♀️.

WE lived on Wilmington island, outside of Savannah When Hurricane David came by, 40 yrs ago. The police were slowly driving Up and down every street w a bull horn.....telling everyone, it's a mandatory evacuation.......as they passed by, my husband, A WWII veteran, a German national, informed me..... "WE cannot evacuate. We are renting this house. We have to stay and try to protect this house in every way possible." 🤯......and we stayed while he lashed a ladder to the roof in case we had to climb up to up out of the water....he tied our lifejackets to the ladder. He built a "float" for the bird cage and put the dog's life jacket on him.......he was quite sure the water would flood over Wilmington and tybee island.....uhhhh yeah. Thank God nothing bad happened to us during those days......but I would never trust anyone w the responsibility of my children, like that, again. All said to point out what a tremendous sense of responsibility he always felt for the other person's property.....we PAINTED and waxed floors before we left anywhere......washed the Venetian blinds and any curtains that were there..... We wanted everything to be ship shape.......🖐🏻😁

it's almost impossible to clean cheap white flat painted walls that haven't been primed which is what is seen in those photos. Whoever painted them white never primed the damn walls, this will happen to the most cleanest person, they can be the most organized cleanest person in the world & they'll have scuff marks & the underlying paint showing through. I've seen this a million times, whoever is doing this apt is using extremely cheap products that aren't installed correctly. They more than likely wouldn't allow them to paint the walls, kept it white, knowing that white shows everything. It's a deposit trap, happens often, very old tactic.

yes but even after 5 years you should be able to wipe the dirt off the walls. the dirt and dust build up in that house was a lot. look at the electrical outlet its got an inch of dust caked onto it. look at the cabinets with black dirt in them. the plaintiffs did not take care of the place, didnt clean often enough, ruined the flooring. overall it was more than $2000 worth of damage, it wasnt just the walls werent painted.

Exactly! What does it matter how many scuff marks there are? Paint doesn't care. It covers them all. Scratches from bed were normal wear and tear. The hole in the floor was not normal wear and tear. The dirty pan in the oven was gross, but it just requires cleaning. I'd give the landlord $300 for the hole in the floor. And another $250 for cleaning. That leaves $1700. So double that and they get $3400 awarded. But often judge Marilyn doesn't follow the law and her prejudices often color her rulings. She is often sexist. Kangaroo court.

i am a house painter with 20 years experience and i can tell u that nobody is gonna pay 2000 dollars to paint the walls in 4 rooms , the cost for that is usually around 150 dollars per room , which is only a total of 600 dollars even if u paint all the walls in 4 rooms , so i think the defendant ripped off the plaintiffs and the judge doesnt know how much painting actually costs .

I had two kids and ran an in-home daycare. Lots of kids in and all five days a week...My walls never looked like that. That was excessive. From looking at the other damage and gross items left behind it seems more likely the parents are lazy and irresponsible, not just in house keeping, but in teaching their children to treat a home (especially a home that’s not yours) with care.

I watched this twice....by accident... and have to comment. The tile damage is for 2 reasons...It's cheap ceramic tile and it was installed wrong. I know because I bought a house recently with the EXACT same tile and when I started replacing the tiles the mastic was NOT properly applied to the floor originally. It can crack just stepping on it when installed wrong

kids do not always damage apartments. i managed apartments years ago, and most of my tenants’ children did not damage their apartments like this family did. that stove was nasty.

My tile is broke from exactly what she said. It’s uneven and you certainly have to paint after a tenant lives there for 5 years. But the oven and scratch hardwood is different story

Pretty sure they were banking on that clause that says that the landlord has to send an itemized list. In fairness, he violated the lease if that was in it, and violated the law either way if their law states that. But....and this is a big but, they definitely didn't do their due diligence in cleaning that house before they left. As much as I think it was the right decision, that landlord should have at least been scolded for not doing HIS part by sending the list.

When the paint is cheap it scuffs if you look at it too hard. In the houses we built new it came with the standard paint and we had to repaint with a better quality paint.

They could have prevented the floor damages from the bed by simply placing down a rug. Dollar stores sell adhesive padding for under furniture legs. They didn't care about taking care of that place.

The plaintiffs did leave it in bad shape. And that oven with dirty bake pans was just mom being lazy. I'm wondering if mom was a good housekeeper. Only because of the mess. I think the ruling was right. And for the tile floor . I believe something was dropped on the floor. Because the way it was cracked.

Ok, I have to say Judge could be wrong on the cracked tile. We are on a wooden subfloor and our tile in the kitchen did the same. A wooden subfloor will move and the tile and grout won't move with it. It will crack, especially where the most foot traffic is absorbed. The crack will spread to accommodate the movement of the house and the movement of the people in the house. We recently built a new house with two levels, i wanted tile so badly all through the top floor but our contractor and the flooring guy explained to me the likelihood of the tile cracking over time due to the subfloor moving. I got laminate instead, not as pretty but way more practical and way less maintenance than tile.

Gracious! I have seven children and would be so embarrassed if I left a place looking like that. Yes, we have had accidents where a couple of tile broke, but I would clean the stove, the cabinets, and the walls. Not to mention I would try to make sure the wood flooring was preserved by putting down cheap rugs under the bed legs.

Teach your children how to care for things. My parents raised three and if we marked the walls we had to clean it. If we scuffed the floors we had to clean it. Carpet spills got cleaned. Any mess we made we had to clean it and since we didn’t like that we tried not to make messes. We were also responsible for helping with general housekeeping and that taught us value. That place should never have looked like that, kids or not. This was negligence.

My property owner did his own floor in my bathroom and he didn’t do it right because I was literally walking on egg shells. Every time I walked on it the tile would crack. He finally had someone come and put down some linoleum. They never ripped out the old floor which had been put on top of the original flooring. I hate when Property owners do cheap work for themselves and skip certain parts of the job and then complain that it’s broken. I don’t know why the plaintiff didn’t just clean before they left.

let me tell you something, if you ever go to rent an apt & the walls are all white & they won't allow you to paint - RUN, RUN FAST. White walls will ALWAYS pick everything up whether it's high gloss or flat paint, especially if you have kids, and it's a royal pain in the ass sometimes to clean. Every single little finger mark, scuff mark, you name it it'll show and it from the JUMP will guarantee you no deposit returned. I sometimes wonder if they do this on purpose just to keep the deposit. I say this after owning my own house for 17 years and as a renter, white walls are like a white void & they WILL show everything. You do NOT have to be a dirty careless person to have this happen. Darker walls that are painted typically won't show it. But if any rental wants you to be in that white void without painting, then go elsewhere if you want your deposit back in the future. and NO you don't have to drop anything on ceramic tile to crack it, if it's not installed properly or if it's not level it WILL crack eventually, it's a rental they probably put cheap flooring in there, this usually happens if they're too lazy to remove old linoleum floors under it. Wood floors can scratch if they're cheap or not treated & if it's cheap the slats will separate. It happens. If they want the place spotless when a tenant moves then stop buying cheap crap at Home Depot and allow them to paint it other than white void. .Not only that but in between tenants they should be painting & putting in a new carpet anyway, go buy a can of white paint & a brush for christ's sake.

I’m always so surprised at how many people DONT clean their walls/baseboards periodically in their homes. If these people had just cleaned it once each year they lived there it wouldn’t have looked so bad when they moved out. I do my walls, baseboards and inside/outside cabinets at least once a month!

Here's a tip. When renting a house with hard floors go to home Depot get a carpet square that fits the rooms before moving any furniture in.
