Wow. Why is your KZbin channel so interesting??? I'm studying Mechanical engineering right now in Utah and don't know exactly what I want to do with it, but I love science. Dylan, really enjoying your videos. Lots of great information. I have a few questions. 1 do you have to or should you use a patent attorney from your state? 2 I have modified a fishing lure by adding another functional group of parts to it, what if any patent should I use?

Thanks, Gary. Very glad to hear it! Since patents are federal law, you can use a patent attorney in any state if you want. For example, I'm based in Seattle, but most of my clients are in San Francisco and I've represented clients worldwide, even including countries like Cuba. The only benefit of using a local patent attorney is being able to go visit them in person if you want and having someone in the same time zone can be convenient. For the modified fishing lure, it depends on the specifics of what you've added. I would suggest having your patent attorney do an analysis. Design patents are typically a better fit for lures, but sometimes a utility patent (or both) can be applicable. However, in some cases, the cost of any patent might not be justified given the expectations of sales and resulting revenue.

How can I protect an image I drew as my log for my clothing brand? Something I create from scratch but can’t afford to trademark it just yet? Can I still sell clothes?

It depends on what exactly you are looking to protect, if it's just the drawing itself, that would be via copyright, but if you want to actually protect the design of clothes, you would need a design patent, if it's a fabric pattern that could be copyrightable, if it's a design, logo or other mark that's specific to your brank, then it might be protectable by trademark (this video has more on trademark protection kzbin.info/www/bejne/goqTe6V-bNKMaKs). All that being said, you don't need a patent, trademark or copyright to sell the clothes. You start forfeiting patent rights upon a first public disclosure, public use or offer for sale, but clothing designs are often not patent protected. I would suggest talking with an IP attorney who specializes in clothing/fashion to look at the specifics and see what might be protectable and what to do until you can afford protection or whether you need protection at all.

It sounds like what you're asking is whether changing the design or material of a patented product would be sufficient to make the new product non-infringing. It depends on the claims of the patent on the product. Some design changes might make the new product non-infringing or might not. Changing material of a product might make the new product non-infringing or might not. Trademarks and copyrights work very differently, and unlike patents, you can actually gain some basic rights when when a mark or artistic work is used publicly. For copyrights, it's when the work is first fixed in a tangible medium and for trademarks it's when the mark is first used in commerce. So Bart Simpson couldn't prove that Lampwick invented Itchy by simply providing an old,.dated sketch? So the simpsons lied to us? My whole childhood is a lie!

Since Itchy is an artistic work, copyright law would apply to this situation instead of patents as discussed in this video. In a copyright case, an old dated sketch could be evidence that someone else conceived of an artistic work first and has priority to it, but unlike patents, you also need to show that the other person was aware of the earlier work and copied it or derived a new work from it. In other words, unlike patents, copyright law gives a pass to folks who independently conceive of a work without copying or deriving it from someone else's earlier work.

@@PatentsDemystified ....but Roger Meyers Sr. and later Roger Meyers Jr. Didn't create or derive Itchy from anything, Roger Meyers Sr. literally just took Lampwick's Itchy Creation and claimed it for his own, just as Walt Disney took Ub Iwerks Mickey Mouse designs and claimed them as his own.

Yea, this is an example of simple copyright infringement where where Rodger Meyer Sr. directly copied the Itchy creation by Chester J. Lampwick and there was proof of this via the animation cell at the Android's Dungeon and Meyer's Jr's admission that his father had stolen the character.
