Most Patent Attorney's wouldn't dare make a video like this. Amazing! I am going the Pro Se route and would like to have an attorney look over my claims. What range do you think that will cost me for an hour or two? Curious is your firm does this.

Such a great video John. One question, once we filed the PPA, when we trying to convert the PPA to a non provisional patent, can we change some parts of the drawings and some parts of the claim? Will that affect approval of the non provisional patent? Many thanks.

@alisainwonderland3157 Yes, it is very common to improve the description and the figures. This is really necessary in most cases since the PPA is often filed as an informal document. Also, it is common to include improvements to the invention that were developed after the PPA was filed. Note that the PPA filing date only applies to the inventions that were taught in the PPA while any improvements get the nonprovisional filing date. John, I understand that PPAs aren't subject to examination, but do they still become part of the public record / prior art if the provisional isn't converted into a utility patent after the 12 month window; or does the provisional simply disappear from the public record as if it were never filed? In other words, is the invention essentially in the public domain and no longer subject to patent protection if not timely converted?

What if you do file the full patent within the 12 months? Are you obligated to use all wording, files, sketches etc that you initially included? Depending on your answer, I wonder if it would be better to let it expire and then just file for the real thing immediately after. What do you think?

Hi John, thanks for the video, I would like to ask you one question. I have been reading the book titled - Patent Pending in 24 Hours- 2nd edition by the attorneys Richard Stin and David Presman, on page 28 the following is said: "Unlike a regular patent application ( that must be filed in English), a provisional patent application can be filed in any language.".My question is: ¿ Is that statement made by the authors of the book correct ?.

Hi John - thanks for this very helpful video. I'd like to ask a couple of questions about PPA's : 1) - Are PPA claims subject to the same standards as non-provisional claims ? 2) - I've read that the European Patent Office requires PPA's to contain a full set of claims for EPO patents - is this true ? Many thanks.

@mcgrath1487 Thank you for your comment. 1) PPAs are never examined and there is no requirement to include claims in a PPA. However, I think it is a good practice to include a plain english claim in the PPA just to help recall after a year, the main point of the invention. 2) Nor does the EPO require PPAs to have patent claims. The EPO has increasingly emphasized, however, that to receive priority from a prior application, PPA or Utility, it is essential that the prior application fully disclose the invention in either the specification or the claims. For more, check out this link: www.epo.org/applying/european/Guide-for-applicants/html/e/ga_c4_1_8.html "As a rule, the EPO initially examines only the formal conditions for claiming priority. ... The subject-matter for which priority is claimed must be derivable directly and unambiguously from the full disclosure of the invention in the priority document.." 'Hope this helps. Hi John, If I submit a provisional... then one year later submit the non-provisional... how tightly am I bound to the description and drawings that were submitted in the provisional application? If I were to submit the non-provisional, I would see myself hiring a pro for the drawings, etc. But would this be allowed given the fact that I have already described the device and provided (not professional) drawings in the provisional? I discovered a website where you can upload a photograph, and it will convert this to a "pencil drawing". In my case, I have a completely finished product, and the converted photographs look pretty cool... although I don't know if they would meet the PTO's requirements. Thanks again!

@TimsCabana You are free to change or add to your PPA disclosure when you file your nonprovisional patent application a year later. However, only the details of the invention disclosed in the PPA get the original filing date. Additions included in the nonprovisional application get the filing date of the later application. Thanks so much, your video cleared a lot of doubts in my mind. My one question is: is there a PCT/WIPO Form to use in a provisional application, what PCT form is it? or can we just make an Applicant data coversheet? Thanks, in anticipation

There is no WIPO PPA for the PCT application. One option is to file the PPA in the U.S. first and then claim the PPA priority date in your PCT filing. I hope this helps. -john

Great video! Thank you. I would love to see a video that explains In a step by step format how to file a PPA. Yes, I have an invention. I just completed a working prototype and I’m ready to file the PPA. Also, I created an LLC intended to eventually use to license or sell my invention (should I be lucky enough to do so! Lol) can I or should I file the PPA using the name of the LLC or should I file using my name and then eventually transfer ownership of the patent to the LLC? Just thinking about future liability protection. Thank you!

How do you check if a company infringed your patented algorithm to match the colors? That's impossible, unless you get a copy of the code. Wouldn't it be better to file a patent on the idea of using a software to match the colors instead? Is it possible at all ?

Thanks for the helpful video! A question: I want to patent a novel function that 1. can be achieved decently through an app, but 2. is significantly better in form of a separate hardware which does not necessarily need an app. Questions: 1. Can I protect both ways to achieve the function in one patent? Or 2. Can I do this at least for the provisional year, while exploring whether or not to split it into 2 actual patent applications?

@seraphimrasmustoerper6702 - Yes, you can protect both embodiments of your invention by claiming the product not as a device or an app, but rather as a process for doing something. For example: I claim a method for wardrobe selection comprising: photographing a selection of available dress shirts, photographing a selection of available neckties, selecting a specific one of the photographed dress shirts, scanning the internet for popular examples of matches with this chosen shirt and internet necktie combinations, and choosing the available necktie that most closely matches a popular example. Note the invention could be either an app or a smartphone/computer that executes this. The example claim covers both. You would need to write a different claim to cover the app and probably a third to cover the smartphone. Hope this helps. -john

If I may ask for additional clarification: Until your last sentence I was sure you were saying that by protecting the process, every kind of product that implements the process is also covered (especially if named as example application) - but then you said I need to file separate claims for the different applications! Did I understand that right? What benefit would the process claim then even have, if it covers only a theoretic process but not its practical applications? And is this already the case during the provisional year, or only after?

@@seraphimrasmustoerper6702 There are often multiple different ways to protect an invention. For example, let's say you have invented a new type of paint that works particularly well on fences in cold climates. You could patent the chemical formulation of the paint; you could perhaps separately patent the method of making, colorizing and mixing the paint; you might be able to patent how the paint is applied (if there is a special process for this); and finally, you might have also have invented a special applicator for applying your new paint that is also patentable. Any one of these four patents could be useful in protecting your product, but you might also choose to patent each of these elements separately to create the strongest monopoly. Sometimes the patent office lets us combine closely related inventions in the same patent; in other cases, the inventions must be separated. I hope this answers your question. -john

@donya80 The USPTO filing fees for a provisional patent application for a micro entity (individuals earning generally less than $200,000 or so a year) has recently dropped to $60. The filing fees for a regular utility application are now under $400 for a micro entity. The cost for having a lawyer prepare and file your regular utility application can vary greatly depending on the complexity of your invention. These prices can range between $8,000 for simple inventions to $20,000 or more for pharmaceutical patent applications. I hope this helps. John I would like to file my provisional first by myself, for _60, then after less than a month the utility patent by myself and pay the $400 just to have it file for the date, the try and get a Lawyer for another more professional patent. The reason is in case I get a crooked lawyer and steals the idea I would have evidence of the provisional and the previous utility patent.

Also, I forgot to mention that prior to filing a patent application outside of India for an invention made in India, Indian law requires you to get an Indian Foreign Patent Filing license first. This is to assure that you are not shipping military secrets and other strategic technology out of India. Failure to do this can result in fines and possible imprisonment (although I have never heard of any going to prison for failing to get a foreign filing license). These are the rule for the Institution of higher education basis: It must be certified that the following criteria are met: Small entity requirement- The applicant(s), each inventor, and any other party with an ownership interest in the invention (e.g., assignees, licensees and obligated assignees or licensees) qualify under 37 CFR 1.27 as: (1) a small business concern as defined in 37 CFR 1.27(a)(2) which, including affiliates, has fewer than 500 employees, (2) a nonprofit organization as defined in 37 CFR 1.27(a)(3), or (3) an individual who has not assigned, licensed or otherwise conveyed or promised to convey an interest in the invention to a non-small entity; and Either: The applicant’s employer from which the applicant obtains the majority of the applicant’s income is a United States institution of higher education as defined in section 101(a) of the Higher Education Act (20 U.S.C. 1001(a)); or The applicant has assigned, granted, or conveyed, or is under an obligation by contract or law to assign, grant, or convey an ownership interest in the application to such a United States institution of higher education. Does the majority of the income of all applicants come from a United States institution of higher education, or are you required to assign your invention to a United States institution of higher education? -john
