As I said last time, a warranty issue must be returned to you for repair or replace. They can't do work to fix what they think is a problem, and bill you for it. They didn't make a warranty claim - end of issue.

Not necessarily true . If you believe the work was not up to scratch and you believe this has caused a break down in the relegation, you can get someone else to correct the work and seek a remedy in court , then the judge will decide

@@robertburrows6612 But that isn't what happened. The stealership decided to remedy in house and invoice Barum for it, despite not evenhaving paid for the original work. First Barum are aware of any issue is when chasing up non-payment of that original head job. A judge's first question will be, why did they not make Barum aware there was an issue and give them a chance to make good their work, if that ever was the problem which seems very unlikely.

We stopped sending goods out until payment had already been made apart from 1 customer that is a regular. Many years ago during the financial crash my contract boss learned the hard way not to allow the owed invoices to mount up. I now require payment within a week on labour, up front on goods or i move onto other work (after ive stripped yours) and then charge storage from day of missed payment. only had 1 complaint but he had tried it on with others and now not in business (says it all)..... Oh and i NEVER deal with main dealers.....not even when im the purchaser.....a certain blue oval near us messed us around on a purchase, i took my 50k elsewhere, the same month a mate did a deal with them and ended up getting done over. great content by the way.

For Barum Engines doing an evaluation on an engine, this scope would be invaluable! To avoid future problems like this I think you should consider taking pictures of anything that comes in and goes out.

You've done right to state that you've only done work EXACTLY as per your invoice and you expect payment for said work done. The dealer has basically voided any warranty offered by doing the rectification work themselves so you would be within your rights to refuse to honour any warranty. Do your homework, be organized with your evindence and you shouldn't go far wrong.

As already mentioned. A workshop cannot just crack on and repair what they believe is a faulty part without at least giving you the opportunity to rectify the issue. If they had followed correct procedure, you would have had the chance to inform them that the head was never supplied with injector sleeves. They certainly can not just invoice you for what they claim it cost to rectify an issue and that’s the first you knew about it. There’s a principle at stake here. I’d be definitely taking court action if the insist on their current approach. I’d be pursuing them for court costs and all your costs to attend court as well.

Im a sparks, when I buy goods from my supplier, I have to fit the parts with skill and due diligence, i can't blame the supplier if I fit the parts badly. It's as clear cut as that. A judge will laugh at them , if they didn't check your work, that means they didn't use skill or due DILIGENCE. . Blaming you is not a defense

I had a few occasions with customers "making assumptions" about what I would do as regarding their jobs, usually they "expected" more of course, so in the end I added "Total of works as stated" to invoices. Then if their "assumptions" were for anything other then I had put in writing in the invoice it was in writing exactly what they should expect and no more! After all your invoices detail your work, supply and time, so adding Total of works, is just three little words.

Counter-invoicing for a similar amount is quite a common tactic to avoid payment - hoping you will just accept the difference instead of 'wasting' the time involved in two small claims cases. We had a similar situation, strangely enough over a Cylinder head. In our case we bought a head, but the company supplied a similar but different head (from a non turbocharged vehicle). After the head cracked very quickly, we returned it and ended up having to take them to small claims to geth either a replacement or refund as they just ghosted us. We lost the claim against them, due to a single word! The OE head manufacturer wrote us a letter saying the non-turbo head was different and not compatible. If fitted, it MAY cause cracking. The Magestrate said that if it had said WILL, rather than MAY, he would have found in our favour. The bottom line is make sure whatever evidence you submit is absolute. In your case, get your supplier to state they NEVER fit sleeves. If there is even a hint of ambiguity, you are likely to lose.

Thanks for sharing this - Genuinely interested in the inspection camera as I work at a distributor for a small to medium diesel and gas engine manufacturer. (0.7-61litre, 2-16 cylinder engines) - we have some older, fancy optical bore scopes which are ok, but we're looking at c.£8k for the current digital equivalent!! It's hard to justify that sort of expense in this economy!

When I was in the Diesel Engine business (as a Warranty Engineer) we rented a Canon borescope kit to diagnose a particularly strange failure, which as usual was NOT a factory defect. The kit came in several cases and almost completely filled the trunk of my car! 1989 Pontiac Grand Prix SE (very rare loaded 5-speed car with a Getrag gearbox). AND cost several thousand US$ to rent for one day!

When I served my apprentice ship 50 years ago we used a borescope which was made in 1953,to check bores on English electric ,General electric ,Gardener , Rolls, Leyland Detroit and EMD engines. It was a small unit and gave very good views of bores in large engines.

If you'd fitted the sleeves, you would have an invoice for their purchase. Simple enough to bring invoices from your suppliers to court showing the lack of purchased sleeves.

Have maxspeeding rods in my caterham with 1800 k series, 244BHP and 8900rpm. Done many track days in past 10,000 miles no issue, same for many sister engines to mine. £198 for rods is amazing! Wasn't sure at first having them joing a £1350+vat crank and £400+ pistons, but so far all good

Even more the reason to photograph what comes in and what goes out. In my line of work I photo what I work on prior from all angles and likewise when I’m done. Upload it to my Pc with a copy of the invoice and then I know 100% I have my backside covered. Can’t argue against a clear photo with a date and signed invoice. Job done!

Be careful. Don’t get sucked into a back and forth with them. A plus for your side is that they documented their error (assumption). I don’t know English law, but in the US, emails are admissible in court. Make copies. Bring your phone(s) in to show judge.

They "thought" it came with the injector sleeves, and tried fitting the injectors without sleeves, and damaged stuff. Why they called and asked if you put sleeves in, and when you said no, they went well crap we messed up, and they are now trying to make you pay for it.

I don't know bud should they have noticed it probably , But as a heavy diesel tech for 30 years at dealerships when we get a head back from our machine shops they are complete and ready to go with new injector sleaves. Your passed warranty stuff I was with you and myself wouldn't have paid them but this one I think they got you unless you specifically told them or have it in writing there is no sleaves. He’s already stated in his original invoice 🧾 that they supplied a brand new bare cylinder head they re used refurb the old valves cut them in at the request of the dealer as there to tight to do the job right from the start. At no time has he said or implied he’s fitted new injector sleeves as it’s a bare head. The garage has fecked up I recon they fitted old sleeves from old head that didn’t work either way there going to be paying a hefty bill in the end

Lee, warranty according newest EU Regulations you as a manufacture can decided what is under warranty. The UK is no longer under EU Regulations, you need to discuss with your legal representative what is possible.

Well all I say is your win that case all day long because as soon as a judge sees your receipt 🧾 evidence reads the conformation papers from your supplier and there supplier of those cylinder heads heads and also that dealer has disposed of that old head mysteriously. That dealer will not only have to pay 💰 your outstanding invoice in full but also all your out of court costs. But I like the way that business has had the head done the job poorly but dtill got paid by their customer and is trying to shake you done. There things called shysters in this world and that dealer is a big one well and truly
