I can't count the number of times this has happened. We just ignore the landowners except to give a quiet chuckle when their faces start turning red. Ignoring Karens makes steam come out of their ears. Every fisherman knows that people pay exorbitant prices for a view of the water. And we also know that what you ACTUALLY bought was a view of guy like me sitting in a leaky boat with a cold beverage in my hand. Cheers! 😂

They then act surprised when their million dollar homes begin to slide down the mountain because it's made of gravel and after years the support sometimes gives out. And then they want to sue. Dude you built a house on a mountain of gravel and you knew it because they've been digging it out of there for like 30 years. And on top of that it's right on a major fault line. In my state, not only can you not privatize public waterways, you also have to provide an easement for access. Yet I see private property signs everywhere on the river. Like the Clash says: Know your rights!

In some places, there’s no legal right to block access to the waterways via land. So while some people will try and fence off all the area right down into the water, they can’t legally do it. Because historically it was used as transportation And an important source for food, so the people need access.

The daily dot article gets this backwards. The law isn't what makes the water navigable. The fact the water is navigable (traversable by boat, etc) is what makes it public property. As for the second person, often the shoreline doesn't count as private property, or reasonable exceptions exist for its use. It's likely the fence line was already the edge of the surveyed property, anyway.

happened to me about a year ago, i was eating lunch off a canal road leading into a small lake, pricy homes, old guy marches toward me angrily, "this is a private road, you need to leave." i knew it wasn't a private road because they have orange street signs, public roads have green. this was green, it was a dead end, houses on one side, canal on the other. i told him it was a public road and i didn't have to leave, that i wasn't blocking traffic, and was on the side of the canal, not the homes. '"i'm calling the police". i'm like "go ahead, you're wrong." after 5 minutes i left, i didn't want any police encounter to make me late for work. dude gave me the death stare as i left, i waved just to piss him off even more.

In 99% of states almost all waterways like rivers, dams, lakes, etc are public domain when your on the water in a boat and in some places it counts the shore line as public too. For a lake area to be private in most states it has to be a fully contained water supply where the owner has containment of all the water like a pond or lake. But most streams, creeks, rivers, reservoirs, etc, where the water enters and leaves cannot be private by definition from the state where they own the water and its public. This is because the water is moving thru and up or downstream their usually is public access. Sadly as a fisherman, myself I've dealt with this identical situation of people yelling at me for being in a boat on a river.

When these fishermen actually do trespass, and it happens, things can get out of hand real quick. I live on a lake, and have a dock. There are people fishing around my property all day, everyday. Most are just fishing, and I've got no problem with that. However, some will come, and climb on my dock, and then start looking around at my gear. That's when it gets tricky. I've had the entire gas tank stolen off my pontoon boat while it was parked in my dock. I've got friends who have had their fish finders stolen off their boats, and people who have had their boats stolen. Once they get out of the boat, and walk on someone else's property, everything changes.
