That guy could(and probably should) go to jail for that. In pretty much every state you are only allowed to use the threat of lethal force, or actual lethal force, if you or your loved ones are being threatened with bodily harm. You can’t shoot at people for theft, or in this case standing there obviously fishing. Those things are not considered threatening enough to use lethal force. He’s an irresponsible gun owner, and at the very least needs to be confronted before he actually kills someone.

Not in castle states. There is no duty to retreat. There was an incident with a guy who shot a trick or treater and didn't get any criminal charges or anything because he was within his rights and there were multiple no trespassing signs up. So if this was in a castle doctrine state and he actually hit him it wouldn't matter. He was on his property which in castle states encompasses all of your domain. It's fucked when people abuse it like these cases. But it beats having to literally wait for someone to break and enter into your house, retreat, and only then protect yourself. You've just cornered yourself. Hard. There has to be a balance. The balance must be recognized. Extremes must also be recognized and carefully thought about before considering it in a sweeping generalization of this balance. I don't agree at all with Gary and I wouldn't even look him in the eye much less shake his hand. Completely irresponsible gun owner. A firearm is like an airbag that you hope you never have to use not a horn like Gary was doing here.

@@aussierule that’s not completely true about castle states. Especially if you are talking about the Japanese foreign exchange student incident that took place in Louisiana 30 years ago. That guy was let off, but because of instances like that one the laws in most states were changed because it was recognized that someone’s presence on posted property isn’t enough justification to use deadly force against them. Sometimes people have legitimate business with you or your property, and posted trespass signs don’t apply in those instances. I know about this because I live in a castle state. The castle boundary is normally only extended to include the front and back porch with a thin perimeter around the home. If that. A lot of castle states still only consider the “castle” to begin at the door way. And even then you are supposed to use “reasonable” force. That can include deadly force, but there have been plenty of instances where home owners have gotten in trouble for using excessive force over what the situation called for. Also, posting trespass signs doesn’t give you license to shoot people. That’s a common misconception. What it means is if you catch someone on your property that you have posted those signs on then you can have them arrested for criminal trespass because they were already warned by the signs. Instead of only being able to have the cops issue a trespass citation or warning. My gist is that even in the more lax castle states who extend the boundary of the “castle” to include all of the property you still have to justify the use of deadly force. And that means proving you feared “grave bodily harm” and acted purely in self defense of yourself or your loved ones. Meaning in Gary’s case if they had decided to call the cops, and shown them that video, Gary would have probably spent the night in jail. If not several. Oh and the “no duty to retreat” concept means if someone made an overt move to attack you then you don’t have to retreat 1st. You can immediately respond with force. The key to that legal term is that you must be blatantly attacked first. Which 2 dudes fishing, not approaching you, can’t be considered an overt attack. He, legally speaking, attacked them first.

Oh please. It's a land owner letting out some bird shot in a safe direction to scare what he believed to be trespassers. No one was in danger. The land owner doesn't need a defense to discharge firearms on his own property outside of city limits. If you walk on to private property unannounced you should anticipate surprises.

I've always struggled to understand how mad people get about people fishing. Certain instances are obvious small stocked ponds, ponds close to a a house/shop/building etc. I have a creek/canal on my property that runs into a large 8k acre lake. Lake is less than 100yds away & people fish my creek from time to time & the ONLY time it bothers me is when they are making a mess, being loud or just disrespecting my property & i have a hard time with people that get so pissed off at fisherman when a simple no trespassing sign would peacefully alleviate %95 of the problem. I usually come out& ask them if they're biting & what they're using for bait & then wish them luck & leave it alone.

That whole shooting thing is BS. I have been shot twice in robberies, both times taking their gun, but I'm a little jumpy about people pulling and I'm constantly armed now. I don't know, I might have returned fire before that could be straightened out. I get the landowner thing, I've had folks poach on my land, but until your absolutely for sure, ya gotta hold off on those shots!

Some years back ,I was fishing with my Dad and we were fishing different areas along the River that I grew up fishing in. I had a few months earlier gotten out of the US Air Force and I wanted to do a little fishing with my Dad seeing how it had been quite some time since the last time I fished and really wanted to get back into fishing. We hadn't had much luck at the spot I called " the Swimming Hole " so moved upstream about 200 yards and were going to try a promising looking area where the water ran past a huge boulder and was quite deep. We no sooner got our lines in the water when ... Kra- POW ! Somebody was shooting just across the River from us . Judging from the "sharpness " of the shot and how it echoed , I presumed it to be some kind of rifle ( 308 or a similar caliber ) I tried to see if I could see anyone but couldn't . Another shot rang out and We were thinking about leaving . I told my Dad to start going ahead of me as I was still trying to see who was shooting ,but still couldn't see anyone . I was turning to follow my Dad who was a few steps ahead when another shot rang out and I saw clods of dirt and plant fragments explode no more than three feet to the left of my Dad. I took a couple of quick steps and made certain to be between my Dad ( I wanted to at least block any rounds from hitting my Dad if at all possible or at least slow the bullet down if I got hit then maybe my Dad stood more of a chance from the HOPEFULLY greatly decelerated bullet) and whoever the ASS HOLE was that was shooting towards Our position. Once We both were up the steep bank and into the woods , we were much more relieved and safely behind large densely growing trees and moreover, a small hill that ran alongside the trail added effective cover. It was a very long time before I went to that spot again and even longer before both my Dad and myself went fishing there. Looking back on this, it may have been some STUPID FUCK-HEAD that was drunk or "trying to scare us". Whetever the motive or the condition of that shooter was, there is nor DAMNED reason or cause to be shooting so recklessly ! Frickin' scary SHIT getting fired upon , I tell Y'all WHAT !

@@jamesautry7432 , Well seeing that mud, clods of dirt and plant matter erupt not more than THREE feet from my Father made me think otherwise when the event transpired. I take it by "snap" you meant that I didn't hear the shock wave from the bullet(s) flying in close proximity to my Dad and myself ? We were near a fairly loud river as some rapids were only twenty or so feet upstream from where we were fishing so, I am not sure that "a snap" could've been heard, quite honestly.

if you’re trespassing and you hear a shot, it’s a warning shot. If someone wanted you dead in the first place you wouldn’t even hear the report. While trespassing, if you decide to shoot at the property owner expect to die... So William, while you may feel like you can defend your self with you EDC, you are no match for a mini 14 with a scope, especially since the guy grew up shooting prairie dogs at 300 yards with it

But even if they were setup at a distance, once a person fires back and the rounds get close they usually dial 911.

Someone dumb enough to shoot at a property owner who fired a warning shot while trespassing on his land might find out the hard way that a farmer with a 200 yard Zero rifle only has to come up 2 inches to park that projectile exactly where he wants to. Setup...? Really.... My son when he was 15 could shoot a gopher at 200 yards from the back porch. Doesn't take much of a setup. Remember the premise of this staged video, no bullets were flying in the direction of the fishermen, only the distant sound of shotgun blast. Also if you're carrying firearm on someone else property, while trespassing, you're asking for trouble not to mention, you're not all that smart.

I promise, if your kid fired at someone and then someone fired back and things were turning to shrapnel around him he's not going to sit around long enough to return fire from the same position. The last time i got accused of trespassing was some nosy neighbor who thought i was stealing a car his neighbor had parked by the highway for sale, that I had just bought. The guy felt real big with his pistol grip shotgun and thought he was doing something good, I almost ended him right then and there just for pointing a gun at me and i probably should have because it's dangerous. But you go on ahead and keep thinking land owners are always going to be 200 yards away and always have an advantage and I'll keep thinking that if a person shoots at someone else that opens them up to being shot back at in nearly every state since trespass isn't a killing offense but shooting at someone else is. Also, who's to say the person you just fired a warning shot at won't come back and execute anything that moves at a time of their choosing?

This reminds me of a time I went to deer hunt on a fellow workers land in rural Virginia and this guy comes up to us after we parked and were getting ready to hike in to the stands.He pulled out a pistol and aimed it at us.I leveled my loaded shotgun at him as did the other 2 guys and we gave him a choice.Lower your gun or die.He retreated and the cops showed up shortly.The guy claimed we were on his land.We had written permission and called the owner who showed up a few minutes later and proved he did own the land.Law asked us if we wanted to press charges but we didn't as nobody was shot.A few years later at work the owner/fellow worker told me the guy turned out to be one of the best neighbors he had.Seems the guy was fighting druggies and thieves so he should have looked us over before jumping to conclusions.Ed,the owner talked him into carrying a shotgun if he had to confront anyone because that pistol wasn't scaring anyone better armed.lol

I support use of firearms for self defense and sport usage, but I absolutely do not support this sort of usage. Never pull the trigger unless you know your backdrop and are intending to kill. Did anyone get hurt, no, but very easily could have ended differently.

I have gone with people who said they had permission to fish from a friend and it turned out being in a private pond and they and the owner didn't even know each other. The friend had been trespassing the whole time as well and sending his friends over there too. I always ask to make sure.

Ron is entirely at fault in this situation, he needed to call ahead and inform the land owners that he was coming by with a friend. This never would have happened if he had done his due diligence. Even if you have permission, call ahead folks, it'll solve a lot of problems before they have a chance to happen.

Never mind that the effective range of that firearm is about 50 yards and they were well over 200 yards away. For all you know the owner was shooting skeet in his back yard. Good reason to let him know you are coming, you never know what may be going on in a private property on any given day.
