It really depends how you use them and how you deliver the pennies. If you dump a bunch of pennies and claim that this is to pay X amount, then you are causing a burden for the other person to have to count all those pennies. If you were to make a payment in rolled up pennies, that seems more sensible. I made payments to people through pennies, but I use common courtesy by counting the pennies and giving it to them in rolls.

Tha Hool As a previous assistant branch manager, that is only true if the person exchanging high amounts of unrolled coin do not have an account. Many local businesses (two of which were vending companies) would bring in large amounts of coin, and there was never a charge. I'm not saying that there wouldn't be if the amount were in excess of $500, but then again we have never had that much brought in on a single transaction.

According to our own federal laws he did nothing wrong.....Title 31, Subtitle IV states "United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues".

the statute says that only private companies, or parties can decide what they take. the government has to take its own money. the court is government agency, not private so they have to accept it or it is marked as paid.

Example: guy finishes eating at a restaurant (and now he has a DEBT owed)and the waitress says we only accept gold coins. Guy says BULLSHIT, and pays in US dollars. The police and court would side with the guy. Second example: guy comes in again and BEFORE he eats (ie before he incurs a debt) the waitress tells him he can not pay in dollars only gold coins. Police and courts would side with the waitress/restaurant.

But there is no law restricting company's right to refuse certain types of payments for example parking meters do not except pennies, arcade games, vending machines, gas stations not taking bills larger then a 50, coin op laundry, self serve car wash. But A store does not have to take that many pennies. You shopping is not a debt. I have had this happen to me many times. I refused bags of coins, customer gets pissed, calls police, police show and tell them I do not have to accept it. It was funny seeing the looks on their faces.

+Buck Fisher Unfortunately, that only applies to government entities at the federal level. There is no federal law that mandates all forms of legal tender are valid and must be accepted as payment. It gets more murky since there *can* be state laws that do this. In the end, as John Stilwell stated, private business can not only refuse stunts like this but they can also, if desired, all but force you to pay in denominations and amounts they choose. Most establishments will accept anything to promote positive PR but all pennies (usually unwrapped) just screams abuse of good nature. Do that at your peril.

Don't know about the USA, but in Germany (which is where I live) shops/institutions are allowed to decline cash payments in coins once the overall amount exceeds "usual" limits (I think ~5€ when paying exclusively in 1/2/5 cent coins). If he did throw/dump the pennies just over the counter, I don't see it differing too much from just throwing something else that would make a mess (i.e. grains of rice).

Hans Meier In the US, if someone is willing to pay a bill and you accept cash as payment. You cannot refuse payment even if the payment is in pennies. It's actually illegal to refuse US currency as a payment.

I was in a tobacco shop last week when this guy freaked out because he couldn't buy a pack of cigarettes with $6.50 in rolled up pennies. He was yelling "What the HELL? This is United States legal tender! You can't turn this down it's a felony! I'm going to call the Secret Service on your ass and report you!" The store guy said "If you make that on a pay phone, be sure to use quarters. Pay phones don't take pennies either."

"Legal Tender" does not mean they are allowed to take it. It means they are REQUIRED to take it. It is a federal offense to refuse legal tender in the United States of America.

It's to my understanding that the federal laws says that the only one that has to except us currency in the us mint. No one has to except pennies as payment for a debt. But the debt is still owed.

It's actually a federal crime not to accept pennies as a form of payment in the USA. Also, they do not have to be rolled! So if you want to make a statement when paying for a ticket or a fine or something go for it. If the one charging you doesn't accept it, call the United States Secret Service and a federal agent will be there with the hour.

In Canada, there are legal limits on the largest purchase that can be paid for in coins of each type. So in Canada, he actually broke the law.

A private business Doesn't have to accept coins even though it's legal tender. The business can chose which way to accept it. (They did say they accepted cash). The only time they HAVE to accept legal tender is a government facility. He can actually pay the $140.00 fine in coins.

The reason he was cited was that he dumped the pennies on the desk, according to the story. That is causing a disturbance which is why he was cited for disorderly conduct. If he had placed them on the desk in a container(s) of sorts, he wouldn't have been cited.

If the individual or company incurs any fees for collecting your fee then that is deducted from the amount you paid so they can charge to count those pennies federal court case look it up...

If you sell a car for 2000 dollars and someone says, "here's 200000 pennies". How do you know if there's only 1200 dollars worth? And, yeah, you can argue that pennies are legal tender but not until they are counted. Taking them to a Coin Star machine could cost a hundred dollars between an employee's time and the Coin Star cost that gets subtracted from the Coin Star payout. Now you only gave me 1900 dollars free and clear. When I make an agreement of sale, or a contract, the price is specifically in dollars, not $2000.

They said he "dumped" the coins on the desk. I presume that means loose, not bagged. That might be the basis of the disorderly conduct charge since he could have put them down still in whatever container he was using to transport them, and it would have been his right to have the container(s) returned after the coins were counted. Doesn't the USA have a bit of legislation like Australia about the amount of small change retailers are expected to accept? In Aus., there is a prescribed limit on how much total money you can expect a retailer to accept in each type of small change. It's a generous amount, but at least there are limits. (A retailer can choose to ignore the limit and accept more if they wish, but they aren't forced to accept change over the limit). Also in Australia, last I knew there was a piece of legislation which says that a retailer must accept legal tender in payment for goods or services. If you've received goods or services and attempt to pay with legal tender (and the amount doesn't exceed the prescribed limits mentioned above), you're entitled to walk out without paying and the person to whom the debt is owed must personally come to you and ask to be paid, and you're still entitled to pay via cash if you wish.

By law private industry can demand to be paid in jelly beans if the want. Private industry can demand to be paid in whatever form they want. The only thing US law says is that pennies are legal as opposed to being illegal. Private industry does not have to accept it.

In addition, movie theaters, convenience stores and gas stations may refuse to accept large denomination currency (usually notes above $20) as a matter of policy.

My mom and I hate it when fast food places take FOREVER to serve us. It's FAST food for a reason! So to get even, we came up with "Penny Runs." We'd save up all of our pennies just for this purpose. When we place our order and drive up to the window, we'd start counting out pennies. However long it took them to serve us the food we ordered, that's how many pennies they received. Fast food places around town got faster when they caught wind of this.
