I once had a divorce client who got 3 DUI’s in four months. He was facing serious jail time. One case was a not guilty verdict. One case was thrown out on a technicality. One case was disposed of when he went to classes and treatment. He only drinks water now. It cost him a small fortune. Nobody got hurt, but he learned a valuable lesson. Do not drink and drive. It is not worth it. No reason to drink and drive especially with Uber and Lyft in most areas. Or just stay home if you drink alcohol.

Your a beast if you was the defending lawyer. If you heard my case and how corrupt the state police was and made up the whole discovery knowing they had nothing on video I could use. Long story short I plead guilty out of fear I then won a pcra such a mess here in Pittsburgh pa nothing illegal in my system I might add too lol

@@724deuce Yes, I defended him on all three DUI cases. I typically handle only complex family law matters but he insisted I handle his DUI cases. I think that each case is different and many DUI cases can be won with the right lawyer and a ton of hard work. The DUI system in PA makes millions of dollars in costs and fees for the courts (probation, ARD, counseling, other court imposed fees, etc.) and the local economy (tow truck operators, storage fees). It is best to simply not go anywhere near your car if you have been drinking alcohol. In PA, you can get a DUI just by sleeping in your car with a BAC of .08 or higher (if you have possession of the keys). Stay safe out there!

What I don't understand is why they didn't take his license away.. I met people with 1 or 2 dwi with suspended licenses for years that were hard and expensive to get back. I just think that's something that could be done early on if someone is repeat drunk driver. Suspend their license immediately, then if they get it back and do it again, lifetime suspension so they can never legally drive again. If again? Then potential life in prison. That's three strikes and you're out.. this guy got what 9?

My highest BAC recorded with police was above .4. I was brought to the drunk tank. Drinking was a problem for me as soon as i found it at 16 yrs old. Waking up in juvy then in jail after 18 sucks. Luckily one day i was able to wake up and be done. Went to the ER for the third time, got withdrawl meds but this time was different. This time i was done with it. 5 years sober now. Ive been extremely lucky to not be dead, or in prison. Crazy that something so normalized can do so much damage.

I worked as an injury adjuster for auto claims for 45 years. The number of drunken drivers I have dealt with is unbelievable. One day I was driving to work, lovely clear dry summer's day around 7.30 a.m. I was travelling up a hill, suddenly a car starts coming down the hill sideways and luckily for me, it crashed into a tree on the other side. Before I could get out of my car the driver's door opens and a woman falls out along with numerous empty beer bottles. She blew .32. She was some bigshot's daughter and she had got off a few times before. She didn't this time. She went to jail for drunk driving, reckless driving and anything else they could throw at her.

Isn't that wild? I'm pretty sure juries give harsher sentences than judge's in like 90%+ of cases. I bet his lawyer was BEGGING HIM to let the judge sentence him. Then again though, if he'd been in front of that same judge for DUI 5 times already, then this might've been that 10% where the jury is more lenient, because I guarantee if you go in front of a judge that many times they WILL throw the entire book at you (source: experience in front of njudge).

Judge would have slammed him too and he's 62. Is life with parole in 15 any different than 20 years from a judge. It's not like a judge was gonna let him go. Maybe thought he could gamble and get some sympathy for being an addict or something. Maybe someone with a family member. Judges think about their career too. No one wants to be judge who slapped him on wrist on 10th dui and he kills someone.

When i got older i realized there was no actual evidence against me yet he advised me to take a plea deal. Telling me id get 3 years probation, then the whole thing would be wiped off my record. Didnt tell me that i could never own a firearm for the rest of my life, or that my goal to be a doctor would also go poof. ive needed a lawyer for both criminal and civil (mostly contract negotiations) reasons and I’d say at least 3/4 of lawyers who were described to me as “very good” were so annoying to deal with. They were always in a rush. always talked over me, never made me feel like they actually cared about my concerns, etc. The criminal lawyer was all right bc at least he made it go away (and granted i wasn’t like… telling him how to do his job and he got annoyed or something. I’m not that stupid of a client 😅). When you have a lawyer like that for a contract negotiation, yelling at you to take a shitty deal bc it’s an industry standard and he doesn’t really have respect for the work you do it’s annoying as fuck to deal with. In general I think finding a lawyer is a huge pain in the ass bc theres simply no way to tell if a lawyer is good until you’ve hired them. and then it’s basically too late already. And they often make it worse by always being in a rush, talking over you, and trying to take every last penny you have (in criminal cases) to get the job done.

@@noThankyou-g5c I'm so sorry that you and @Redspeciality had to deal with that shit. A bad attorney is like a mummy curse. I hired a probate attorney for my mom's estate when she died and I seriously would have been better off picking someone at random off the internet. No kidding I would have rather paid you to do it, there's no way you could have screwed me as bad as she did. No other attorney would take me until I got free of her claws, which I basically had to teach myself how to do. That was a civil matter, that you had to deal with that for a criminal case makes me want to puke.

Most other countries don't drive around and have cars like we do here in America you have to think about the fact that our biggest economy generators used to be the car manufacturers so we grew up and we were told the first thing you do is get your drivers license and get a car. I think they need to make it harder to get a license. There are a lot of people out there that I believe should not have a license. it's always been actually quite easy to get a license because of the way our economy used to be. everybody wants to own a car so give them that license and let them buy a car. I think they should have a simulator up like airline pilots do to train to fly their planes. Heck we have so many more deaths from people in car accidents why do we not hold that same standard as we would do for airline pilots for travel. EDIT: i have thought about this because i have been in 6 car accidents , all of which my cars were totaled and NONE of them were my fault .. i have caused zero car accidents in my 47 years

I remember my uncle was a big time alcoholic for years before he passed. He went through at least 4 or 5 duis and had to spend time in jail. After getting out and not being able to drive anymore unless he gathered enough money to install one of those alcohol breathe testers, he finally decided to get sober. One time he had driven home drunk and pulled up to my grandmas house with the tire of his car completely off and he was driving on one of his rims for like a block or two. We found the tire the next day on a major street that he turned on.

I have a friend who recently bought a car with one of those breath testers installed. She got a great deal on the car, especially in this market, but my God those things are obnoxious. Not only does she have to blow every time she starts the car, it also randomly goes off during transit and there's a camera installed to make sure she's not getting a passenger to blow or some other shenanigans. She finally got it removed a few days ago, but man, that thing was a nightmare to deal with. One more of the many reasons not to drink and drive. It caused all sorts of electrical problems with the car that magically vanished once she got free of that thing, and of course there was a ton of paperwork and legal hoops to get it removed.

“Since Mr. Stanford had four previous prison sentences for felony DWI offenses, he was treated as a habitual offender,” said District Attorney Jeff Swain. “His record showed that he was going to continue endangering communities throughout the Metroplex unless he was locked up. This was his first DWI in Parker County, but he had other convictions in Tarrant, Dallas, Rockwall and Johnson counties, so he has been a menace on the roadways throughout the DFW area.” The case began Aug. 15 when troopers and firefighters responded to an accident at the intersection of FM 51 and SH 171 just south of Weatherford. When they arrived on scene, they found that Stanford’s Lincoln MKC had run a red light at the intersection and rear ended a Kia Sorento.

I don't know if this exists in the US, but here in Belgium a police judge (police court for traffic violations) can order your car to be fitted with a driving lock, meaning that the ignition of the engine can only take place after you blow in the installed device and the reading shows 0.0% alcohol.

I live in Europe and the last time I went to the US I went out with a relative and her friends. All were adults and mothers of several children. Once out, I discovered that all three of them were heavy drinkers so I offered to drive since I was only drinking mineral water. They laughed at me, saying that I had no idea where I was. They then laughed about the fact that none of them had a driver's license because DWI convictions. I was pretty shocked and scared. The convictions for drunken driving had no effect on their behaviour. All drove regularly. Needless to say I left the group and found another way home. I just don't understand how this is allowed to go on. Or how they have so little regard for life. How can being able to drink alcohol be more important than anything else?

I feel so sad to hear people suffer from this disease when they could have found help. Therapy and AA works. It worked for me. Some may say it's not for everyone but if you really want to quit you'll try anything people recommend works. However, there is nothing you can do to convince an alcohlic who isn't tired of drinking to try to quit.

tmanchu, you are so right. An alcoholic will not stop if they don't want to, and even some who want to, will still find it very difficult. Everyone says they need treatment, which is true, but there is no magic pill. It's not like you get an infection and an antibiotic will cure you. It takes a lot of motivation and dealing with your demons, and the alcoholic has previously learned to avoid all that by lessening their pain with alcohol. If he's 62 y.o. and started drinking when he was 13, emotionally he is quite stunted, and still stuck at a 13 yo stage of development. Bruce is right - you have to keep him away from society because the need of others to be safe outweighs his need for freedom to drink and drive again.

As a teen in the very early 1980s, I was incessantly targeted by a crooked cop, who, for ridiculous personal reasons that would take too much space to explain in the KZbin comment forum, kept pulling me over without cause and falsely arresting me for DUI. This happened three times before the local judge finally ordered him to end the campaign with these words, "I had better not see this young man back in my court after another questionable arrest by you". After that it got slightly better, but only because the cop instantly resigned from the city police force, and went to work as a Sheriff's Deputy in the county. There he did continue to harass me without so much as a hiccup, but he could no longer stake out the street I lived on at night, and I quickly learned not to drive outside the city. I am 100% convinced that had I not given up my right to travel freely in my native county, he was preparing to plant something on me and put me away for good. I never blew anywhere near the legal limit, and the charges were always ceremoniously thrown out upon appearing before the judge, but it has still haunted me for the rest of my honest and sober existence. For one thing, I was forced to give up my life's dream of entering the Air Force and flying, because they, "didn't take drunkards". Reluctantly, I ended up in the construction industry, where I started at the bottom, but excelled and eventually attained a rather high position. For several decades I managed lots of huge government contracts for the largest company of its type in the region, (I once was involved in the 2nd largest construction project on Earth) and therefore had to undergo many, many background checks, where I was always treated like a crook, and was forever forced to answer for my , "extensive history of misdemeanor arrests and drunkenness". No FBI agent conducting background checks would ever entertain a tale of being victimized by dishonest and corrupt cops, so I quickly learned to act as though I had just made juvenile mistakes, and had learned my lesson... thanks of course to the heroic good cops who did their jobs well and kept me in line. This always worked, but it shook me to the core every time I had to do it, and it still ticks me off to no end that police have the power to nefariously alter the course of a person's existence without consequence. End qualified immunity now!

He was 65 years-old, engaged, support from his sister, and her husband's church where he was the pastor. I told my judge in closing arguments that client would die in prison if not released. Anyways we live in Florida, he was about an hour away from the beaches, I’m way more coastal so I feel our rules are stricter here. He ended up getting 11 DUIs and only did more than an overnighter once. He spent 5 days in jail waiting to see the judge and his lawyer always got him off somehow. Never lost his license. He would hangout at bars to talk to people and he’s knew when he was about to catch a buzz. So he would drive home before that happened and finish drinking at the house and go to bed. He can blow a .103 and won’t be slurring because his tolerance is so high. Maybe that played into it? Idk but he kept his lawyer on retainer for his whole life when he got back from the war. Even left him things in his will after he passed.
