The problem with it is technically the system didn't do anything wrong (per se). The system is designed to arrest and charge people who have "probable cause" which is just a reasonable belief that a person committed the crime... you don't have to be the actual guy who did it or for there to be proof beyond reasonable doubt just for the police to arrest you. That's what is required to _convict_ you. When it comes to arresting and taking someone to jail and initiating the court process up, technically the police and courts did what they are supposed to do. Not every person who gets arrested and accused of the crime _did it._ That's what the trial process is for. Some innocent people are going to arrested, inevitably, and that's why the trial process exists, to weed out which people arrested are actually innocent as opposed to who actually did the crime they are were accused of. Like "guilty beyond reasonable doubt" is *not* the standard that police use to arrest someone, that's not the police's call to make. It's an arrest... not a guilty verdict. You're still "presumed innocent" at the time of arrest. Literally it's written within the system that everyone who gets arrested is considered "innocent" until proven guilty... it's worded that way for ar reason. So you can't really blame the police here. You can't necessarily _blame_ the police for arresting the wrong person because that's not how arresting works... you're not supposed to have 100% certainty that you're arresting the correct person before you arrest them. It's "probable cause". Probable cause does NOT mean "undeniable proof that someone is guilty", just a "reasonable belief" Also the eyewitness likely didn't do anyting wrong either. At least not intentionally. Witness testimony by nature is highly flawed... there are all sorts of errors in how people's memories work, for example we don't memorize facial details of other races very well (an effect of in-group/out-group bias) and some people have been falsely accused based on that. Or witnesses have been shown to be highly suggestible to outside influence during things like witness lineups where the smallest amount of feedback can warp or influence a witness's memory. Adrenaline is a factor that weakens memory... in a tense situation your memory will be blurry or prone to error. There's even stuff like "memory conformity" where our memory can be influencedd by factors of group conformity. There's tons of psychology on it. Really the fact is that witness testimony is just a terrible form of evidence but our court system hasn't evolved as fast as the science has... our court system is heavily based on "traditions". It's not the fault of any individual but it's the design of the court system and the types of evidence it is allowed to rely on I would say if anything... the "fault here" is two things. One is, the _public_ needs a better recognition of what "innocent until proven guilty" means. I'm honestly not sure if the court system is even at fault for destroying the person's reputation because it literally says you are innocent until proven guilty and you have to go through the court process first for them to prove that you _are_ guilty. Really the fault is the idiots in America who think "accusation = guilty" even though the way the actual legal system works says otherwise. There's social fallout when you get falsely accused of a crime _because_ of the fact that people assume you're guilty once they see you in handcuffs... that's not a problem with the system, that's people not understanding the system or wanting to acknowledge it. The other factor is just that bad evidence is allowed to be admitted. But that's deeply embedded into how the court system works. That's like something a supreme court has to change... that's not the fault of these specific police officers or this specific court for just following how the rules of the court system work

This is terrible! Getting a pharmacy tech license takes as long as and often cost as much as getting a bachelor's degree in a lot of states. I hope the board of health reinstates his license soon.

This is beyond ridiculous. So someone can pick out a random person and said he committed a crime and don’t have any proof. This sound like the 60’s all over again. We have to much technology for this to happen. What makes matters worse is not even apologizing to the young man after messing his life up while the police go to work every day. How can you sleep at night knowing you did that to an innocent man.

From now on he's hosed.. each time he's asked, on any job application or hire/interview process, or real-estate or loan application if he's been arrested, then he'll have to say YES. And WHEN they ask 'for what' it will be for murder. At least his pharm-license revocation might be challenged/appealed. He wasn't even indicted.

He still has a record . He will have to get his record cleared . As long as he has the arrest on record, he will not be able to get a good job . If he has bills his credit took a hit also . So the arrest hurt his credit , livelihood , and reputation . He will never get those back . He needs to sue for millions of dollars .

The worst part about this is that the arrest will stay on the record forever unless Mr. Tuggle goes through the long and arduous legal process of having the arrest expunged from his record. It's asinine that such a wrongful arrest isn't immediately expunged from the record.

@@kelj4517 I'm sorry, but you're incorrect. The fact that you were arrested will stay on your record until your death unless you go through the court procedure to have the arrest record expunged or sealed. Arrests stay on your record even if no charges are ever filed, charges are dropped, if you're found innocent in court, etc. There's also a process called "petition for factual innocence." The point is that there is no automatic process for an arrest to be removed from the criminal record in the US. I mean, I guess the DA could proactively have it expunged, but I'd be surprised if they would go through the hassle without being forced to do so.

@@saldiven2009 That's true just enough, but the unfortunate part is that if he wants to attend law school, work in law enforcement, get some licensure, or enlist in the military, he will have to disclose that he was arrested/charged even if his record is expunged and he’s innocent. He must explain what happened and hope people get an accurate picture. If not disclosed, it can cause many issues. You can be arrested if you don't disclose it to the military and join. So even when you're innocent, it could haunt you going forward outside of the mental trauma.

This is why you don’t show ID unless suspected of committing a crime. There are criminals in badges that take your information and basically “pull your name out of a hat” ABSOLUTELY RIDICULOUS, and we tax payers pay for it in the end!
