First amendment claims wouldn't apply. However, labor law might. Workers do have a right to discuss workplace issues, discuss their salaries with coworkers, and lobby for union membership. Retaliating against someone for educating others on their labor rights could very well get the company in serious legal trouble.

Ideally, Veronika would not have identified herself, her company, or her fellow employees in the skits or on the social media platform she's using. Therefore, neither the supervisor nor HR would be able to see the skits online and link them back to her. Maintaining anonymity is the key in this type of situation.

A teacher in the UK got fired recently because of his social media presence... his video of him leading a student to thinking critically and not being a sheep was not liked by the school. Critical thinking is not on the syllabus, it's actually banned. The teacher is a gem and someone every kid deserves and every society needs. That right there = the problem. 😊

Many years ago when I worked at a Kmart, during the days of Myspace (way before Facebook) I got pulled into managers office. They said they were told I had a Myspace, they demanded I give them access! I said no, they I can be fired! I'm like ok start taking off the Kmart vest, my name tag, they backed up with the quickness!

So for anyone watching, ignore any advice you think is implied in this video. The 1st Amendment generally does not apply to the workplace, unless that workplace is part of the government, and even in that instance there are BROAD allowances for the government. And yes, there are absolutely circumstances where what you do outside of work can be grounds for disciplinary action.

That is a nice manipulation tactic, but freedom of speech is protected even against our goverment. Problem is people are intimitadate to challenge it. Personally i have sent my constitutional rights along with any violations and if necessary case wont just go through county, but i love to challenge it to supreme court. And i have it where judges and attorneys know i am not bluffing.

1-I’ve worked for government and civilian in right to work states. The reality is, before they fire you a supervisor usually says something that shows they will be violating the laws and your rights before HR gets around to firing you; as long as you can show that it was possible they fired you because you didn’t capitulate to their illegal request/order than DOL will still side with the employee….. yes, even in a right to work (or as we like to call it, “right to fire,” state). Reality is, the narcissistic nature of bosses who do illegal shit lead them to believe they can do whatever they want and then fire you if you don’t play ball every time… 2-even in right to work states, many jobs are for companies that have a corporate headquarters in a different state/country and the corporate policies have them keep track of certain things, including why each employee is terminated. That becomes hilarious when stupid bosses fill out the paperwork showing their illegal reason for firing you thinking that it doesn’t matter because like you said, it’s a right to work state. Then the corporate HR sides with DOL & employee and remove supervisor from high paid position (or fire altogether) to avoid the big lawsuit. I personally witnessed where a group of supervisors in a multinational conglomerate violated the Americans with Disabilities Act and fired someone in a right to work state; when all was said and done, all supervisors but one were fired and the one went from being in charge of a manufacturing plant earning over $200k/yr to being in charge of a small refrigerated warehouse in a different state making less than $40k/yr…. so he could retire a few years later under a Union retirement program….. the fired employee was basically given the difference in pay for a year from that supervisor (he settled for their first offer because he had a lot of debt from being out of work for so long before the company (Tropicana Orange Juice) was forced to settle with him, due to multiple phone and online complaints, by one of their sister companies (Pepsi Co).

Lol. This is funny. There is no blanket right to free speech regarding employment. An employer can easily decide that your social media presence creates a conflict for the employer. It doesn't even need to be a right to work state. Unless your position is subject to collective bargaining, tenure, or some other presumptive labor agreement or employment contract, in the US you can be fired for any reason that is not illegal or does not violate local, state or the federal constitution. For every wrongful termination case won in administrative or civil proceedings there are tens more that have lost, even in pretty progressive states.

Yeah the problem is free speech does not mean this and a business can absolutely fire you for what you post on social media. It has happened, it continues to happen, and courts have upheld it so just be aware of that.

The First Amendment forbids the government from preventing you from speaking you mind, not private companies. A private company is incapable of infringing on your First Amendment rights. Now, the company may not have a case against you in this situation, but not because of the First Amendment. This is a good topic for a video, but the First Amendment should never have been brought into it.

Well in the real world, companies will go to great lengths to filter out the “Veronikas”before they even get through the door (through reference checks, careful interviews, and even psychological tests). If there is a hiring mistake and “Veronikas” somehow manage to get in, there’s usually a probationary period which have more lenient terms to dismiss new hires which are considered disruptive to the “culture.” Any company with a half-competent legal department will have a battle-tested agreement document that all candidate employees must sign before they will be let in the door. And if there’s a violation, they’re written up, and eventually removed. “Veronikas” who don’t fit in with the company culture are a deemed a disruption and are legally engineered out.

I had HR & my supervisor contact me about a post I had put on Linkedin. My supervisor was cool, though. After HR had their spiel, I told them that I wasn't going to surrender my 1st Amendment rights just because some random moron called an 800#. I told them that I hadn't lied nor encouraged anything illegal or immoral and that I wasn't about to be bullied by them. I then asked HR if they had anything else they wanted to say to me. They responded angrily with a no. Only then did I tell my cool boss that I was going to remove my post because it had done its intended job. I never heard anything else about it and I continued to receive outstanding ratings for my work until I retired.

Here in Texas they can and will fire you for less so long as they don’t run afoul of any anti-discriminatory or Federal protection laws (FMLA, military leave, etc). And while some employers will tell you why in the vaguest of terms, they aren’t obligated to do so. Also, the 1st amendment offers protections between you and the government, not you and your employer.

I'm pretty sure a company can fire you if you do something that publicly embarrasses them. That said, if the topic of her videos is workers' rights, I don't see how that would make them look bad unless she's using them as an example. In any case, going straight from zero to "my lawyer calling" might not be the best way to keep a job. 🤷‍♀️

An employee may not necessarily get the employer regarding 1st amendment rights but if the employees don't have their workplace named, listed or shown anywhere on their social media nor are they giving away company secrets or breaking laws then there is no reason for the company to micromanage their social media presence either and that can still violate labor and privacy laws and rights

My current employer is trying to develop more of a “public” presence by going in on community activities which I have no problem with. However they ask the hourly employees to “volunteer” their time at these events. Why? Why not have some of the big wigs go out and work these events, they get paid more than the rest of us. Sorry, not me. Not going to work for free when it’s not a charity. I know someone may look at this and think my response is selfish, maybe but I think not. I work full time and need my personal time so I have life balance. Just Sayin’

The problem is the manager should have kept her mouth shut. You know Veronica. You know how she is like. My cousin is a business, labor, and employment lawyer. She dealt with cases like this. This never goes well. She is trying to make hr look like the escape goat. She said most people like the manager dont have personal lives. Just clock out and leave drama at the office at the office. This crap 💩 makes you undesirable when you try to get another job. Getting another job without a reference is hard. They aren't going to write them one after she used them as an escape goat.

Unless my social media presence somehow includes the name or location where I work it’s irrelevant. There is no right to free speech or the first amendment at work, it applies solely to government oppressing your speech. That said your off time is your own so long as it doesn’t involve work at all.

Free speech ensures the right to free speech, and guarantees you won’t be jailed for it… but it doesn’t guarantee you protection from consequences. However, the punitive dismissal would likely result in a lawsuit because she is stating facts, she didn’t mention her employer by name, she didn’t use any work products, and didn’t do it on company time.

Free speech rights would not be applicable in this situation. The first amendment protects individuals from government interference in free speech. This situation does not involve the government. However, that does not mean that a company (legally another person) can limit the speech of an employee outside of the parameters of work.

You have no right to free speech within a company. The government can't legally censor you (not that that will ever ever stop them), but corporations absolutely can. May not explicitly be a social media clause, but I'd put $20 on there being a clause regarding representing the company in a harmful manner or something along those lines.

By taking this stance, Veronica needs to know her contract and the employee handbook forwards and backwards. They will try and find a way to let her go on the smallest infraction. If she has a good lawyer, has tons of persistence, and gets the ACLU involved she might get a settlement.

There is no "Right of Free Speech" where companies are involved. The First Amendment only applies to the government.

No, they can't restrict what you post but they can react to it - most states are 'at will' employment.

It is clear to me in Australia you only got basic hospital cover and you didn't get extras for specialist care. My private insurance in Australia has covered me for years for specialists. You just have to pay for it as part of your insurance. Also you aren't comparing apples with apples, most Malaysians can't afford insurance to get the cover you have an expat. Your comparison is not very accurate.. And BTW I lived in Malaysia for 20 years before coming to Australia.

The gist of the conversation is: If you're going to be one of the faces of the company, be mindful of what you post. Yes, it's still your personal page with your personal choice....but you are still a representative of where you work. You never know what clients or customers will see you. Being online is the same as being out in public.

I watched a couple of these videos now, while funny sentiment, the author obviously doesn't know much about HR or most labor laws. I would call these shower thoughts at best, but the misses are cringey.
