I wonder if you can answer if what the police did to me was legal or not? they came for a domestic stuck their foot in the door pulled a taser and dragged me by my arm out the door because I wouldn't let them in and tried to shut door. They then got me over a balcony rail which was loose by the way and hurt my arm by restraining it behind my back. I told them they were hurting me and they eventually let go but wouldnt allow me access to my property. They then went in my property and eventually left no arrests or anything. I got hurt and did nothing wrong except refuse entry is this right?

True consent requires a contract that is freely agreed by both parties but we don't ever get this option. The idea of a social contract should be viewed with scepticism.

We already have the lawful consent we require and its called Magna Carta. Although i'm sorry to say our people have taken their eyes off the ball, and like many policemen/women you'll meet on their beat these people are just as ignorant, and do not know the law. Many Corporations now believe that 'Legal' is 'Lawful' and that is simply not the case. We stand under statutes although we are not obliged to. The worrying example of this is council tax, and the fraud with regard to liability orders. Administrative courts are unlawful in this country. They are company meetings nothing else. It is no more the rule of law than PACE is. We are not obliged to stand under this, as we are not obliged to give our names to a police-officer. One thing I have never been able to get my head round is that “Reasonable Suspicion” is really quite subjective on the part of the police. This can surely be made up by the officer based on what side of bed he or she woke up on. Could you elaborate as to how it cannot be used as an excuse?

The main thing is that the courts are going to ultimately have the final say on this if it is challenged not the police so in Castorina the judge said "Suspicion by itself, however, will not justify an arrest. There must be a factual basis for it of a kind which a court would adjudge to be reasonable."

I assume that stealing a sandwich is not an indictable offence and if so how did the police gain entry to the premises?

The officers essentially told him they had to do a search before he was given bail. At trial it was accepted the the defendant had not consented to the search and it was therefore illegal. While the magistrate excluded evidence on this basis, this was overturned on appeal. The Divisional Court judge said that the discretion to exclude evidence should only be used when the police have deliberately tricked the defendant or acted in a morally reprehensible manner. Tbh this particular search felt like it was on the border of morally reprehensible and the case might likely be decided differently today.

hello. if you have evidence and it comes to light that it was acquired improperly/illegal by the police. can that alone get the evidence thrown out of court. or is it still possible that the evidence is admissible as long as it does not make the trial unfair?

Generally any evidence is allowed although as you correctly point out since 1998 there has been a move to exclude evidence that compromises the fairness of the trial. The "fruit from the poisonous tree" doctrine is mainly just from America.

It depends on the interpretation by the judge as I can't think of a similar case to that but that does seem like a decent example.

+Haroon Ahmad well if the arrest is unlawful you can apply Christie v Leachinsky [1947] otherwise you're looking at s. 89 Police Act 1996.

Veteran at being stopped n searched 9/10 tho they do what they want and get there way use sum reason to search u, it's always a fine line these arguments and they don't really work IMO.

This is a bad video, there are major mistakes in the stop & search section alone. It is missing loads on premisis search, 17, 18(1&5) & 32. Better off consulting online versions with PACE and RIPA.
