Games take time to development. This game is made by an Asian Mega Corp. Marvel doesn't have direct control over it like they do X-men 97. Where despite Producer Brad Winterbaum saying all 90s shows are canon they retconned F4. Where T'Chaka was dead 10 years before T'Challa met the F4.

Marvel Studios has no power over the video games. If there is an embargo on T'Challa not being used it might be because of Marvel Studios. Also I've heard this game was in development for 5 years so T'Challa could have been firmly in the game before Chadwick died (Black Panther was the 13th character they started work on according to the Datamine). The Black Panther DLC for the Avengers game was also in development before Chadwick died. The fact that Beau Demayo was so cagey about the reason why they used T'Chaka is very suspicious.
