I’m sorry to hear that. We usually analyze the facts presented to us at a consultation to determine if there is a pathway. If there’s ambiguity with respect to eligibility, a case assessment follows to dive deeper. Not all cases can be reopened (particularly since the push by ICE is to remove cases off their docket, not add new ones). However, if we believe the case is a good fit to reopen and terminate proceedings so that our clients may obtain a green card, we submit the request.

@@McBeanImmigrationLaw I did 4 years in prison for assault with a deadly weapon (firearm). This is of course an aggravated felony. I have been ordered removed and I lost my green card but I was able to get a deferral of removal under CAT. My felony conviction was over 10 years ago. I have been clean ever since. Under case laws Koljenovic and E.W. Rodriguez, aggravated felons are now able to get their green cards back through the 212h waiver. What is the likelihood I have a shot?

Hi there my husband has been in removal proceedings since 2013, we just received a letter from DHS has dismissed the case and we already have approved I30 since 2019, and pending I485, due to removal proceedings. We have been married since 2006. Would you be able to let us know when USCIS receive the dismissal to adjudicate the green card. We are desperate have sent enquiry to USCIS. several times, ombudsman CIS, to no avail. My husbands father passed away last year and we were not with him. So sad. Also my mother in law is very sick and we would like to see her before anything should happen. We also asked for info pass and we’re denied.

You shouldn’t have a problem filing for your mom as long as you your income is 125% above the poverty line or $22,887.00 a year. As long as you don’t have children you’re caring for, any other defendants you’re responsible for, or have already filed for someone else, because that would change the numbers. As long as you’re married, you will have to add i to our husband. Ms. McBean, you are the expert, so please add or take away any from my statement if you need to. Hello , my name is Casey. My asylum case is administratively closed . It was closed in 2003 and put in repapering . Repapering was never implemented as a rule and I never got the notice to appear. It happened because the judge denied my case first , I filed an appeal , then in the appeal it was said that the judge should have given me other form of relieve and her arguments were very short sited. She put me in repapering and then she retired. I’ve been in the U.S since 1993 and I came here legally. Any chance with this new proposal?

Thanks for the heads-up I'm currently in removal, have an I130 approved, and my attorney just filed an I-290 B to get my u visa approved since it was denied simply cus they misinterpreted the law. Hoping my case is approved very soon and all this mess is over! I been out of custody since may 2018, I was a self petitioner, until I got my u visa denied so I got an amazing attorney who didn't charge me very much since I had almost finished my case!
