This issue of same-sex marriage not being recognised is not just an outcome of ignorance, but also an outcome of a colonial/western mindset of a social and biological binary, when eastern cultures (like south asia) have almost always had a fluid relationship with gender and sexuality (even as seen in hindu mythology). it is genuinely disheartening to see this persist for this long when i and so many others deserve the same basic rights to love and marriage as any other person because it is human nature to love who you love.

@@Rudra-rf5cn what do you mean "hamara hissa"? pehle ke zamane mein marriage was only considered to be something for procreation but then log pyaar ke liye shaadi karne lage. toh same sex marriage doesn't come under that issue unless we talk about love marriages in today's times. however, in ancient hindu texts, homosexuality has not been considered a crime or a sin or anything like that, balki in many cases, homosexuality has been seen in regular circumstances, for example lord ayyapa was born of vishnu and shiva (mohini's form showing gender fluidity). therefore, it has not been explicitly called to be anything because it is considered nature to love whoever you do. the material world is of less importance than the soul's and it's wishes.

Because two "consenting adults" are not the bases for society. If you go to a prostitute and both are consent to have sex (by agreeing to the price and hour of service), does that mean you are now married to that prostitute? That is the difference between sex through marriage (which could create family) and sex through hook-up culture. You cannot equalize both with a simple nonsense like "consenting" and basic rights. You are human living in a human society, not a stray dog.

@@GobiSubramaniam Consent is basis of humanity, we left barbaric ages long back. And that is by far the greatest. Sex is not a determinant of marriage (going by your short-sighted example). Marriage is a choice and a promise, a legally valid one. But that does not criminalise consenting adults to form relationships. "Consent" is NOT "nonsense".

Even the Hindu mythology narrates stories of same-sex relationships and also mentions about the existence of transgender deities. The discrimination that the lgbtq community faces today in india is solely an outcome of ignorance. They can't get away with saying same sex marriage can't be legalized because it will hurt religious sentiments. Great to hear so many lawyers voicing their thoughts. The ancient Indian text Kamasutra written by Vātsyāyana dedicates a complete chapter on erotic homosexual behaviour. Historical literary evidence indicates that homosexuality has been prevalent across the Indian subcontinent throughout history. Living in a country whose whole philosophy is of advaita, Upanishads which keep telling you that you are beyond this material body. These notions of gender were trivial things to fight for. It is victorian mindset where even the legs of table are covered, leave that of woman.

Our scriptures were foundation on which a society was built which was bold enough to accept a book on sexuality is what I pointed out. Making personal insults won't prove your point. You said it is not Indian which is wrong then there is not a chapter on homosexuality which is also wrong. A basic google search will help you sir. Read a bit, study a bit. Kamasutra is a pretty disgusting book. Idk why we've been treating it like a holy book, why aren't we giving it the same treatment as manusmriti, since manusmriti was considered holy too? Kamasutra objectifies women, has a lot of instances of potential rape, and a lot more.

If a book on sexuality was accepted by a society at that time, it portrays what kind of society it has been. Sex was not a taboo for always in India, that's the point we are making. A society where same sex marraige is not recognised is a society which forces rape upon the person who is homosexual by forcing and social conditioning of the heterosexual marraige upon the homosexual person and thus to live with a heterosexual person. If a woman does not like the touch of a man, but if the parents of her are forced out of social and legal conditions to give her daughter to a heterosexual man, the legalised sexual advance of that man to his lesbian mentality based wife is legalised rape, which may be allowed by law but is injustice or adharma. Then when I pointed out is this what he wants, to marry a girl against her will, who clearly wants to marry and be happy with a woman, then he went on about how homosexuality is abnormal, against the nature and biology, how lgbtq+ people are mentally ill and blah blah blah. Legalize Same sex marriage is not a problem for me personally, it doesnt mean that i support this Lgbtq+ idea. However, one cannot force this ideology onto someone everyone has their own rights and preferences so respect it. Also keep in mind that Western ideologies always not right. This is absolutely stupid. Look into the arguments put by advocates and Justices in this matter. Chief Justice just announced that the Honourable Supreme Court cannot entertain popular morality because if they go by what young people feel then they afterwards have to listen to what many other people feel. Listen to the arguments put forth by the Solicitor General and how the bench agreed on the devastating effects and ramifications of legalising same-sex marriage on the personal laws, Special Marriage Act, Constitutional laws, Criminal and Civil Procedure, and provisions and laws and safeguards for women. The problem is that people are seeing this without even a smidgeon of technical knowledge, and it is not a problem but people should restrain from speaking on the matters which are exceedingly severe. Same-Sex Marriage entails Identity-crisis (just like what is happening in USA) and after that Identity Politics. There would be thousands of petitions on the identity issues with the defence of 78th paragraph in NLSA v. UOI (2014). Attorney General is not wrong when he said to thr bench that no one id stopping them from marrying whomever they want without registering it. He even said that his marriage is not registered, and they don't depend on thr State in the matter of marriage. Same-sex marriage also entails people wanting special provisions, reservation, and so on. There is so much into this, and people are behaving like they understanf everything. First look at the severity of the matter, then think if you should dive into it or not.

Why this even a case or questions rise by court if anything they should fight it's about sexual harrasment , money laundering, education system, dirty politics 👀but no they want to simply distrub those people who simply wants to spend life as they want... marriage,love and child it #LGBTQ rights . They deserve to live there life in #peace #happily . What is issue with that? If anything they want to give them is there proper respect and insurance, child adoption these should be provided to them🌱. As per PC-PNDT ACT (undeveloped genitals by birth), SC forbade parents to decide for their kid's surgery in favour of a Son before 18 yrs. Such kids after 18 may have difficulty being a boy and engulf into mixed emotions to homo or hetero sex. They may have harmonal urge of a girl to love a boy i.e. the surgical boy will love a boy - So no question of "marriage is b/w a *biological* male-female " can avert these unconventional conditions, as by NATURE itself such babies are born.

You are mixing two things. Biological sex and sexuality are different things. Sexuality is about what you are attracted to, so either same sex or different sex or both. Homosexual means same sex, heterosexual means opposite sex and bisexual is both. Sex is either male or female, but due to gender dysphoria, you do not identify with the sex assigned at birth. Hence, you undergo transition. These people are what we call transgender. Both gays and transgender are very different. You can be gay but not trans, or you can be trans but not gay. You can also be gay and trans.

Basically her reason for legalizing same sex marriage is so that LGBTQ people can easily buy life, medical and home insurance like the normal couples (i.e husbands and wives) do . Why not just add/have a law to get those easily accessible to the LGBTQ community instead of legalizing same-sex marriage? By traditional I'm talking about what your parents, grandparents and your ancestors have done so far. Did any of them marry people of the same sex? One problem with legalizing same sex marriage is normalization of the LGBTQ views. Just like you're not supposed to force your religion down someone's throat why should the LGBTQ agenda be forced down people's throat . People want to be gay, great keep it yourself. I listened to most of the arguments made during the 10 days of hearing spread over almost a month and this argument from Guruswamy was the most succinct and the most compelling argument. She delivered a masterclass. It is sad to know that the majority of the judges were not persuaded and our brothers and sisters from the LGBT community continue to be treated as second class citizens.

Todays Hinduism is nothing different from Saffron coloured Islam. These so-called staunch Hindutvavaadis are not much different from Saffron coloured Islamists. Due to centuries of slavery, our minds have become islamic more than we realise. Take for instance, Homosexual marriages. Literally there is not even one single authentic Shastra in Sanatana Dharma which prohibits Homosexual marriages. In fact, we find indirect support to Homosexual behaviour in Kamashastra and others. Yet, todays so-called Hindutvavaadis oppose Homo marriages in the name of religion! These people neither know science, nor Hindu Shastras. Sanatana Dharma is neutral about Homosexuality. It neither encourages it nor admonishes it. Homosexuals have always been a part of our civilization. They always had their life going, without being bothered by the majority Heterosexuals. Yet, today the viewpoint of these so-called Hindutvaavaadis and Islamists are identical. Islam prohibits Homosexuals. Hinduism does not! Period. So, let them have their rights. Let them live life with dignity. Let them prosper too! After all, the favourite scriptural statement of these Hindutvavaadis "Vasudhaiva Kutumbakam" includes Homosexuals too. Doesn't it?

Marriage is more about duty than of right in our society, yes a social duty towards the society to be a responsible person towards fellow partner & future of the society/country. Hence when you bind marriage in terms of just "rights" then you currupt the term marriage to lower it to self convince or certificate to just to attain sexual pleasure which it is certainly not. Marriage is pious tradition it can't be allowed to be polluted with LBGTQ+ delusions.

I also want you to research the list of most developed countries around the world. How many of these don't recognize same sex marriage? None (except Hong Kong, still they allow limited recognition in certain cases.)
