Yes but their trademark is only being applied to merchandising, and considering its the name of their shop, I think it would survive in court. You can't make merch with BLEGH as a prominent feature, but they can't stop people from using it, especially in songs

@@King63Kobra BLEGH is in wide use in merchandise. She sells Metalmerch, trademarking BLEGH was a hostile takeover of a widely used term. People that used and sold merch with the BLEGH print prior to her can file for nullification of the trademark. A lawsuit would only be needed if the trademark office declines the nullification filing. But it simply wouldn't hold up in court. On that note, I think I'm gonna look at terms she also uses in her shop and try to trademark them.

Not true. It can't be used in a descriptive sense for that product. You can't trademark "windows" alone for windows etc. you can trademark it for something other than windows. Likewise you can't trademark glass, clear, frosted for windows because they are purely descriptive. Blegh is not descriptive for a T-shirt or a mug (and it's not how you spell bleh). Ford is a commonly used descriptive word, but it's a valid trademark because it's not descriptive of the products trademarked. Also trademarks in Germany don't apply elsewhere, not even the EU (you can file an EU trademark, even would trademarks although for the latter you need to specify which countries).

There's nothing intrinsically illegal here. It's not uncommon, nor illegal, to trademark a commonly used word. Remember, someone trademarked the word "Apple," which is a fairly basic word. But they've kept it because it's trademarked in the context of electronics, not fruit sales. (where it would have been a legitimate barrier towards operation of companies dealing with apple sales)

getting the trademark and actually defending that trademark in court are very different things. give it time, they'll lose the trademark in time. It's not exactly the same thing but it's kind of like how photoshop tried to crack down on the use of the term as a verb and lost.

In order for something to be a trademark it needs to posses “distinctive character” ie. a consumer would need to see/hear etc the mar and be be able to associate that sound with a particular brand/company without any likelihood of confusion between other brands (or in this case sounds). So yeah, super unlikely this’ll happen, and even if it did it would be pretty much impossible to enforce anyway. That being said you can absolutely trademark sounds - think of the Windows startup sound for example (though these are still very niche).
