Well as you may already know, a warrant NEVER goes away. It just hangs out in a file somewhere in Warrantland until it is either served or withdrawn (recalled) by the issuing court or magistrate. Not the most efficient system but that's kind of how warrants work.

Some additional information for how this happens. In Michigan, if you are caught driving while never having a drivers license, and ticketed or arrested for that offense, that information is transmitted through the courts to the Secretary of State. The State then issue a drivers license number and suspend it, preventing that person from getting a license until advised by the court the matter is resolved. One STILL has to go and pay the fees for reinstatement of driving privileges before a license can be obtained. This is what Judge Simpson was getting at when he spoke about the man first getting a State ID at 19, not a drivers license. He had already been caught driving without a license, and the above described steps were taken. He has known the entire time how to get his license fixed, he does not care. His license was not suspended just due to unpaid child support, he is a scofflaw. He does not care, and he is very adept at fooling the weak minded.

@@robertsmith2956 No, you are not paying attention. You can't drive because it is suspended. You would get arrested just like he did! He COULDN'T get a license because it was SUSPENDED! He could not go into a Secretary of State office and get a license because it was SUSPENDED. Every time he drove and got caught he got ARRESTED, because it was suspended. It being issued DOES NOT MEAN YOU CAN DRIVE, it means you CAN'T because it is SUSPENDED. That is why he kept getting arrested. He didn't want to PAY, which is why it was still SUSPENDED. It will stay suspended until he pays. Suspension means YOU CAN'T HAVE A DRIVERS LICENSE. It doesn't make it FREE, it makes it so you can't get it until you pay.

I beat such a case when the state (DOL) could not produce a law allowing it to issue a license and: (1) waive driving tests; (2) waive written tests; (3) waive license fees; (4) waive the photo requirement; and, (5) waive the signature requirement.

My father never passed a driving test!!! In WW2 he was in Italy with the UK forces. His squad was paired up and each pair were given a truck to learn to drive. After that, the entire group was given Army Driving licenses in Italy during WW2. Army driving licenses are valid for driving civilian vehicles. Many years later in Germany, he was commissioned. He became the Army driving tester. My father was testing Army personnel on passing they obtained a civilian driving license. He considered this stupid as he did not have a civilian driving license. Hence he signed his own pass certificate and it was accepted. That's how my father gained his Civilian Driving license. Having never passed a driving test.

While signing his own test is goofy, it's certainly not that unusual for WW2 soldiers to have learned to drive in Europe like that, and to not get a civvie license until many years later. In the 40s, cars weren't as ubiquitous as they are today, so a lot of the teens and twenty-somethings going to war had never driven a car in their lives (especially those from cities, which were more friendly to walking and public transportation back then). There were jokes about how many jeeps got wrecked by soldiers who didn't know what they were doing.

SNORT. Back in the latter days of Nam, I drove a jeep in the Army. My first drive was to take our captain to where we'd bugged out to. Half way there, it occurred to him to ask if I had a license. I told him I didn't. He asked me to keep that between us. They still let me drive, though I refused to jump through their hoops. Without me driving, they would not have had radios with which to communicate.

@@jacobray7494 my first thoughts were “why is he behind on the child support?” There are a myriad of factors that people get hind that aren’t “oh he’s a deadbeat asshole!” Could have had a number of financial hardships Lost your job due to cut backs or shutting down. Your job didn’t offer affordable healthcare and you get sick or injured and get hit with outrageous medical bills. Then you miss work because of the injury or illness. Your landlord raised your rent on you and your job hasn’t or won’t give cost of living increases. Your car breaks down or is in an accident and is unavailable to be used and your boss gets fed up with you being late/missing work and fires you or retaliates by cutting your hours Oh and furthermore suspending someone’s license for nonpayment of child support is rather stupid for a car centric country like the USA We have a society that believes the great lie that you need a car to be free! So we built our infrastructure around car culture. In quite a lot of places there is no form of public transportation, or it’s so laughably bad that it’s not worth having. For example look at the new river transit in WV 8:30am to 8:30pm No weekends and no federal holidays And WV has terrain that described as “fuck you and your entire family!” It’s either minimally flat, moderate hills, steep hills, and fuck off hills. So getting back and forth to work is already difficult enough. Most roads do not have biking infrastructure let alone side walks and the sidewalks that do exist are very poorly maintained. I know a person who drives 80 miles total a day for work because there’s nothing where they live, and the bus doesn’t run up anywhere near where they live so fuck the if they get car trouble. So excuse me for having just a little bit of sympathy for a guy suffering from a frankly ridiculous punishment

It was because I could barely afford a roof over my head while working 2 crappy part time jobs. Do people who are poor and can’t afford all of these regulatory fees not deserve compassion? If you are unable to maintain what is required to drive then be responsible enough to not drive. So that if someone driving illegally with no insurance hits you then your insurance will cover the cost to fix your car/cover medical bills. Also insurance rates are based on where you live. So if you live in an area with a higher then normal amount of uninsured drivers you also pay more. So they actively cost responsible drivers more by driving illegally.

This reminds me of my case when I was 15 (I'm 50 now). I snuck out and went joyriding in my mom's car. Got caught of course. They created a DL number on the spot in order to suspend me. Fast forward a few months, i had turned 16...one of the conditions the judge ordered was for me to complete driving school, and acquire a legitimate license within 90 days or so. Wasn't really a punishment, I was thrilled. But really the judge was wise and good hearted. He very much likely saved me a TON of future trouble by doing so. It was definitely a better bookmark in my life, he could have declared me delinquent or whatever.

Saginaw Friend of the Court did exactly what they should have. Oh, and that warrant they jailed him for? It's from 2015, for driving without a license.

I would sit in the living room listening to the grandparents on both sides and my parents hold conversations. 6 people all talking to each other and there would be 7 different conversations going on. You don't need a license to have car insurance or registration. You don't even need to be a natural person as a car can be registered and insured to an entity such as an LLC, Corporation or Trust. The insurance and registration are on the vehicle.

While I sympathize for your injuries that accident could have happened because of anyone with or without a drivers license. It just so happened that it was a driver that had one suspended or not had one at all. I know many people that should not even have a drivers license yet they have one. Hell even back in HS a friend of mine had an accident on his way to take the drivers exam and on top of that he has wrecked every vehicle he has owned since up until his 8th vehicle.

A guy I knew got caught stealing cars when he was 15 so he wasn't allowed to get a driver's license for 5 years. He never got a driver's license but drove anyway. He didn't get caught until he was 65 when somebody ran into him. The DA offered to drop the charge if he got a license so he did. Then he got caught for two DUIs within a year.

American road laws are really strange - Trucks are held very rigidly to axle loading, dimension and a strict 80,000lb limit and it is apparently very hard to get a oversize permit. Whereas you can drive for decades unlicensed and drive vehicles without brakes out of a mechanic's workshop and with the frame totally rusted to the point it might snap going over a pothole. In Australia the police and Highway Patrol have cameras that read license plates as they drive which beep and indicate when a vehicle is unregistered, recorded as stolen and even if the registered owner has a valid license. The police conduct RBTs (random breath testing) quite often, when they do this they check your license, in most states you will lose your license on the spot for 3 months for low range drink driving. We have a demerit system where you get 13 points for 5 years. We have mobile phone cameras which detect if you're looking at the phone and you get 5 points off and a $550 fine. We have speed cameras, red light cameras and trucks have avg speed cameras (between two points in some rural areas). Definitely I'm not a huge fan of all of that, but it does seem like more people obey the road rules than in America and far less people die on the roads

yup, also most likely living off of government checks on top of it all. Judge Simpson is one of the more no-nonsense judges you will see. He's compassionate and fair wherever he has the opportunity to do so, but doesn't tolerate stuff like this at all. He most especially takes offense to liars, and this guy is a professional liar.I just wonder how much go-fundme money he raised with this whole thing.

Sounds like quite a sweeping generalisation that imparts a rather unduly harsh judgment on them. Maybe they struggle with motivational/mental health issues, life can deal some real shite hands etc. A bit of help getting him back on his feet can go a long way, as likely as they are guilty, they could also be a victim. And they're definitely also human.

@@robertsmith2956, that clue will be missed by all but a few. Was talking with an attorney about my DL and my reservation of rights regarding it. His response was, "well, you accepted it." My response was, I added the reservation just above my signature, handed the license back to them, then they encased it, signifying they agreed to the terms. He admitted that changed the game. SIDE NOTE: We The People may do ANY act not LAWFULLY proscribed, but public agents may ONLY do those acts LAWFULLY prescribed.

From the English perspective (being much more familiar with English law but I'd imagine most of the principles hold) driving whilst disqualified is a relatively serious traffic offence but not a particularly serious offence in the grand scheme of things, perverting the course of justice (which can include lying to a judge [which he did]) or contempt of court (which can also include lying to a judge) are, however, serious offences and on conviction on indictment punishable by imprisonment for a maximum of life.

That judge in my opinion is being way too easy on this guy. The fact that he is still driving without a license he should be in jail. Due to my medical conditions I have to get medical clearances to drive, if those clearances are not in on time they suspend my license. I cannot submit them till they send them out to be fill out and they only give me 3 months to have them filled out by specialists. So 2-3 weeks to get to me 1-2 months or more to get into the specialist another 1-2 weeks for the forms to be filled out by the doctors and by that time my license has been suspended every singled time. No matter that I have called them that the an appointment has been made. No matter that my doctors have called and sent copies to the DMV my license has been suspended. Until they get the originals by the 12:10 doctors my license is suspended. I did finally find a work around thank gives my a 30 day hardship extension 😊for the paperwork to arrive but that only allows me to drive during my working hours. Luckily the paperwork normally shows up within the first week.

Spoiler: At the end, it turns out he's been dead the whole time. He just had some unfinished business and after August he'll receive a certified copy of his birth certificate and finally be able to rest. The funeral home will make an exception and allow him to drive his own hearse to the internment plot next to the DMV, and everyone else will live happily ever after. In other news, the Michigan Coroner's Office has announced the resignation of it's director, M. Night Shyamalan, due to health issues.

I agree he should have handled his business quietly, but want to point out two things: 1. When he got the suspension, that actually entailed his driving privileges being suspended, not just a physical license. 2. In lieu of his non-existent license, the state issued him one on record and subsequently suspended it. He needed to pay to get his driving privileges reinstated before he could apply for a license (which he has yet failed to do.)

Actually you can. When his license got suspended for the child support, they suspend you even if you don't have a license, so that if you get one, then it will be suspended from the start for the child support.

Omg this is more like Shakespearean play. He was driving in a suspended license, it was suspended but an error in the system, and now he never had a license? I'm sure the judge made a couple extra calls just to make sure, because that's not a mistake you're going to make when you have so many enthralled in your cases. I'll admit, I had my own thoughts based on the info available, but it's gotten pretty interesting.

I dealt with a case in which the court and DOL made up rules on the fly. The court tried the "driving while suspended" relative to a child support case, but could not produce a license. The only thing it could come up with was, DOL issued a license, and labeled it suspended. FUN ENSUED. First, I applied the State of Washington Public Records Act (chpt. 42.56 RCW) to seek how I could go about getting a license without: (1) paying the fee; (2) without taking the written test; (3) without taking the driving tests; (4) without a photo; and, (5) without my signature. Specifically, I sought the laws and policies (WAC's) DOL was relying on to issue a license without the aforementioned things in place. Of course, the response was, "no such documents exist." SIDE NOTE: We The People may do any act not proscribed, but government may only do acts prescribed. I went to DOL and sought the record DOL was relying on to refuse to issue a license, or even allow the individual to pay the fee and take the tests. The agent kept rambling about a document on the computer. At that time, relative disclosure laws were set out in RCW 42.17.260 and required DOL to have given notice of the document, and to make it available. It would not, but still insisted it could refuse a license. SIDE NOTE: DOL maintained that absurd position for twenty-seven years. Excessive penalties? The involved district court participated in the game of stupid. The Chelan County [Washington] District Court had on record the individual's current address, but issued a warrant for failure to appear, five years down the road. I called the court clerk and the idiot claimed they gave notice in 97, five years earlier, so no longer had to give notice for future hearings. Challenged, she was kind enough to enter this claim on to the court docket, certify it, then send me certified copies. Comically, the fellow was driving his large step van when a bike rider, using the bike lane, ran into his van, as it made a right turn, destroying the bike. Cops showed up and the usual "license, registration . . . ." ensued. The response was, "I don't have those things," then, "Oh, wait, I've got I.D. and registration." He ran back to the van and grabbed the registration, then handed the cop that and his state I.D. Meanwhile, a businessman in a Mercedes came forward and offered to be a witness, informing the cop it was the bike rider's fault. The speechless cop went to his car, came back, then told the bike rider he wasn't going to issue him a ticket for passing on the right, turned, left and the fire trucks and ambulance left with him. Leaving the van driver somewhat as bewildered as the cop seemed to be.
