I was just in a bad car accident Tuesday. The other person ran a red light. I had a spinal cord stimulator implanted 6 weeks ago and it's now not working after the accident, among other injuries. I've had 9 operations in 3 years, and am a chronic pain patient. I have a lawyer, and hope I am compensated justly.

@Gustavo Go the driver had the minimum insurance required by law, so I used my underinsured driver part of my plan. I got 6 figures in the end. Still suffering though unfortunately.

I have question. I had a car accident about 2 years ago? So I have pictures on my Facebook that I uploaded with my kids playing with me in the pool and they found that as a physical activity. And then I went live on facebook one time while I was driving phone was mounted. They wna use that against me as a un safe driver? And also saw one old video I posted after the accident jet sking which was before the accident? Now they trying to use that against me?

I'm currently in a sticky situation and would love your advice on. I was recently in a car accident last week where my car was totaled. The other driver was cited for failing to yield to oncoming traffic as she tried to make a turn and we collided. Her insurance has accepted blame. Unfortunately I had a lapse in my insurance so technically I was uninsured during the accident. So I guess my question is what would be the easiest way to make a claim? I've had about (I kid you not) a dozen lawyers call me the past few days who recommend we sue the the other party's insurance. I'm not really sure what to do. What would you do in my situation?

We are sorry to hear about your accident and your car being totaled. It sounds like no one was injured, which is great. Unfortunately, Michigan law is very unforgiving when it comes to driving without insurance. If a person is driving his or her own uninsured vehicle and is involved in a crash - even if another driver is 100% at-fault for the crash - the person driving his or her own uninsured vehicle will be disqualified from suing the at-fault driver for pain and suffering compensation and/or for vehicle damage repair costs under Michigan’s mini tort law. Additionally, the person driving his or her own uninsured vehicle will be precluded from recovering and collecting No-Fault benefits. These severe penalties apply whenever a vehicle was uninsured, i.e., not covered by a valid Michigan No-Fault auto insurance policy, at the time of a crash - regardless of the reason why no coverage was in place. @@clarkgriswold4057 Thanks for the clarification. It is not uncommon for non-No-Fault states, i.e., pure tort, at-fault states, to require drivers to carry auto insurance for their vehicles. As such, whether you were required to have insurance and whether there is a penalty for not having insurance will depend on the laws on the state in which your accident occurred. We recommend that you contact an attorney in the state to discuss your situation.

I'm a medically retired driver and I've been ran into 3 times while legally parked in front of my house. The first one went to jail and the other 2 filed suit. The 3d one even wanted money for medical bills yet when he left the scene it was not by ambulance but in the car of whomever he called. The 3d guy also showed anger when he saw me taking pictures of him walking around unhurt and lifting what looked like a heavy case from his trunk. All pictures were sent to my company's insurance and lawyers. Both lawsuits were dismissed and neither new that one of my duties while on active duty was taking pictures of wrecks. Doing this I learned how to read skid marks and debris and can be close to being spot on in telling what happened. They said that they couldn't see me parked there.🤦🏽‍♂️ It's not my responsibility to make sure you can see. It is yours. I learned how to drive on active duty and one of things I learned was keep your windshield clean. Both sides. Dust/pollen can build up on the inside of the windows so don't just clean the outside. You also need to clean the inside. Otherwise a haze will build up and when the sun or street light hits it just right you will be blinded to what is in front of you.

I was hit by someone and my car hit the front pick up truck. Both of them ran away. I informed my insurance company the same day with dash cam video and file DMV report since I waited the whole day and police won't show up. Now the front pick up truck driver is sueing his insurance company and put me in the case....I am contacting my insurance company and wish me luck :(

Also, make sure you keep your dash cam video and the report you filed. The dash cam video will likely be very significant to the lawyer whom the insurance company assigns to defend you - as the video will potentially show how you were hit and how the vehicle in front of you left the scene. @@MichiganAutoLaw Thank you for your reply. I am still waiting progressive give me a confirmation that their legal department jumped in. Claim adjuster called me quickly. Yes. I kept a copy of my DMV report, the dash cam video which my insurance already had last year, images showing my car got rear end and front bumper got damaged and my phone calling 911 whole day record. Wish me luck ;( Whoever see this comment make sure you have both front and back 4K dash cam installed. My front 1080p dash cam can’t capture the hit and run car license plate clearly;(

Because you had insurance at the time of the crash - even if you are no longer with that insurance company - the insurance company should be providing representation by a defenses lawyer under the liability provisions of your policy. We recommend that you check the terms and language of your policy and then contact your former insurance company.
