So I filed a mental health claim secondary to tinnitus on 11/07/2023, got my nexus letter from y'all. I got an update letter from the VA today apologizing for the delay and that they are still working on my claim. I went to my VA app and saw on my "Claims Details", "Status", that my "Evidence gathering, review, and decision" date was updated to March 14, 2024. Here's the kicker, I just happened to click on the "Details" tab and saw this: "What you've claimed": Anxiety, Stress, Depression, Sleep Disturbances (my original claim) and the following conditions that the VA added: indigestion/acid reflux, dizziness/vertigo, migraines, jaw sore, baldness, and weight gain. Has anybody else experienced the VA adding conditions to your claim? Did you have to take more C&P exams for the conditions that the VA added to your claim? This is just so weird that they would add conditions. Any input would be appreciated. NOTE: All of those conditions do exist in my health records.

I responded with a list and public Army press release of NATO training exercises, proof of all my assigned combat or combat support units ( I was never stationed at hospital unit/medcom/meddac), and deployments. Prestige did my DBQ, nexus/IMO for migraines secondary to tinnitus. I had Migraine Buddy showing 2 to 3 migraines a month where I was in bed with nausea and vomiting, and almost daily headaches. My tinnitus is 24 hours a day. The C&P examiner said there is no connection between tinnitus and migraines, it was more likely caused by diet or heredity, she never asked about either. So I got denied. Kind of makes me mad when I see many people getting 50% secondary to tinnitus.
@prestigeveteranmedical2 жыл бұрын
Hi sir I am very sorry to hear this. Every case is different of course but it has been proven over and over again that there is a relationship between these disorders. This is evidenced by tens of thousands of veterans that have a secondary service connection for headaches related to tinnitus. To blanketly state that there is no relationship and that most headaches are related to diet and hereditary factors is just completely incorrect. You should consider continuing to pursue this with the assistance of an accredited agent or attorney. There are many reputable agencies that would assist you with this and if you need recommendations just send us an email and we will provide you some names.

Does a migraine have to be debilitating or can it just be persistent? I've had tinnitus since 1991 along with hearing loss that was discovered before leaving county after Desert Storm. I got the customary 10% for tinnitus and another 10% for spondylolisthesis. Since coming home, I have had a headache almost every day that radiates from the base of my skull and goes around to the eyes and then upwards. It is not debilitating but it is distracting to say the least. Thank you, Leah. ~John

As you know, it's mostly about medical evidence, **your statement**, and the 50/50 standard. I received 50% for the same claim about 2 months ago. I credit the VA neuro diagnosis of "typical migraine", a PCP comment in my record that my migraines are "brought on by PTSD", basically an Excedrin prescription, a log from a year ago i uploaded via msg center (not sure if they even looked at it as I didn't upload it with my claim at all), and a couple of ER stops after the migraine occurred. ER gave "information about your diagnosis of migraines" in their release papers. I also paid hers truly for an IMO and submitted it with my claim. The IMO supported everything I said with medical studies. And finally, the statement I wrote was simply on point and written for a 50% rating. It was 38cfr "schedule for rating" approved. The claim was scheduled for a records review C&P exam for 2 weeks out, but was completed in a few days. edit: Also included 2 letters from coworkers who knew of the headaches, one I called from the ER and sent a picture of me on the gurney, joking about it.

Hello. Great video and channel. I currently have 10% service connected for Tinnitus. I was a Navy Builder (BU) in the Seabees for over 8 years. I plan on doing secondary claims for Migraines and Anxiety soon. During my C& P exam the doctor giving me the test also told me I should also file for hearing loss because I have moderate to severe hearing loss . She further said that if I file within 3 months it will be approved because the report the she prepared will cover it. Does that make any sense. Also how do I file secondary claims ?
@prestigeveteranmedical2 жыл бұрын
I am glad you are enjoying the channel. If you are unsure of how to file a claim, a VSO would be a good place to start. VA.gov also has a good amount of info on the claims filling process itself. I would imagine that your C&P doctor is noting in her report that she believes your hearing loss to be related to your in-service noise exposures. Technically she has the ability to state as such as the VA has what is known as a duty to assist to add that in as a disability. It does not always happen that way but it should.
@johnnyc55872 жыл бұрын
Yes. That’s exactly what happened. My nexus letter was very strong and It was from a renowned Audiologist Doctor. Additionally the C& P doctor gave me a full array of tests and she said the results of my hearing tests were exactly the same as the tests performed by the treating Doctor and who prepared my Nexus letter. The VA had sent for them months earlier. So I’m guessing that’s a good thing. So then she said I should’ve filed for hearing loss and told me to do so.

@@prestigeveteranmedical "The conditions of migraines and tinnitus are not medically related. MIGRAINES is neurological disease and should be viewed as a complex brain network disorder with a strong genetic basis that involves multiple cortical, subcortical and brainstem regions to account for the pain and the wide constellation of symptoms characterizing the attack. Tinnitus, which is very common, results in an intermittent or constant “ringing” sound in the ear. It may also be perceived as hissing, whistling, or buzzing. While medical literature supports a relationship between tinnitus and headache laterality and a temporal interaction of both disorders, there has been no clear determination that tinnitus causes migraines. I have moderate hearing loss and the VA recognizes that but will not give me a rating. I have been having migraines on and off for the past year. The Tinnitus is continuous. I may try the migraine route but these migraines recently started.

I am sorry to hear this. As far as the specifics on how they consider ratings you will want to check with a legal professional like a VSO, Accredited claims agent or an attorney

It could mean many things but if you have a legal professional like an accredited claims agent they should be able to look in your file and provide you feedback

Not a causative or an aggravational one most medical professionals opinions. There is no way that ringing in the ear makes the upper airway collapse

I've got some serious migraines that make it extremely hard to function at least a half dozen times a month, and some that just make life miserable another dozen or so days a month... I have told the VA about it time and time again. My primary provider changes about every 6 months or so, but I had one a while back that acted genuinely concerned with it, and tried to help with medication ( non narcotic because I refuse to take narcotics ) but other than that 6 months or so that I had that provider, nobody seems to care about it... I am not service connected for migraines though I am for tannitus, I haven't put in for migraines yet because I'm still waiting to hear back from 2 other claims. I was told that it's not a good idea to put in ALL claims at the same time because they cherry pick ( in their favor ) and toss the rest out forcing you to apply again and again. I hate this stupid game they play. I'm working on 10 years and have only gotten to 70... But at least that's mostly in larger primaries and haven't even attempted secondaries yet. Waiting 6 to 10 months at a time for answers really slows down the process.

It is so tough sir I wish you the best of luck with your ongoing claims. You may want to check with a VSO and see what kind of feedback they have on strategy for filling.

Leah, I will be watching TV with my wife. For some reason I would get a terrible pain in my forehead with nausea and dizziness. In fact, I will wake with these same symptoms. I always thought this was related to stomach problems or could it be a migraine? I did receive 10% disability from the Army for tinnitus. Please let me know what you think. 😢😢😢

@@prestigeveteranmedical I’m here waiting lol hey btw I have my c&p exam tomorrow for migraines secondary to service connected tinnitus. Prestige did an IMO for me but couldn’t do DBQs I believe it was because the forms were expired by the Va. The VA now has the DBQs online and available when you did mine in December a few months back you were not doing them. Are you going to do the Migraines DBQs again? Might be something you can discuss it may already be in your agenda. Thanks SGt Canelo

Ok a question, if medicine helps with migraines still can get the higher rate? Migraines is everyday, and some times I can’t function, I don’t even wanna talk or hear any noise. And other times i try deal with it but can’t concentrate on anything. Literally people talk to me and give me instructions and I already missed what they just said. They think all the time I don’t understand English (iam foreign born and raised) i do understand. I did SFLTap classes and don’t get all the information, have no idea of what is gonna happen to me outside. Iam going to just reenlist. I don’t see better choice
