If the case was empty, he would've opened it fully so he could make sure there was nothing in it. Is very unlikely he'd open it slightly and see nothing then assume that means there's nothing in it. Unless he was told to only open it slightly and from that he'd be able to tell if it's in there or not, but we won't know that.
