Usually, and as per the experience I’ve had... They don’t have the same understanding nor empathy when it comes to women as they do for men. However, I’ve also seen many people (men and women) using their kids as an excuse FOR EVERYTHING ..

I don’t think she will win. First it depends on the state. In my state as long as it’s not retaliation for for worker’s comp. being a whistle blower, or one of the protected classes an employer can fire you for any reason they want. I’m willing to bet her state is like that. Because she has gender discrimination not just wrongful

Also I don’t think she should sue period. The gender discrimination reinforces the stigma associated with working mothers. Secondly if she a working mother it’s the parents responsibility to secure childcare. If she couldn’t then she should have taken FML time. The stimulus package includes a temporary extension of the FMLA. 1 of which allows parents that has a child under 12 and the school or daycare has been closed do to covid. The employer must pay 2/3 pay and they get up to 10 weeks. This is assuming they qualify for FML

This sounds a lot like those "I was fired for saying 'bless you'" stories, where it was later revealed that there was a lot more to it than that. I need more information. What was the noise? How long did it go on? Did the mother even attempt to quiet them or send them to another room? Was the mother encouraging the child because she thought it was cute? Did she then spend several minutes talking about her child during the meeting? Were there previous conversations with her managers about the issue? And lastly, why is the mere presence of a child an issue of gender discrimination? You're hurting the entire female workforce every single time you try to say that woman=burden-of-constant-babies and man=no-baby-burden-ever.

Working from home doesn’t work for everyone. Her employer probably thought that she wasn’t fit for their new structure. No matter the circumstance you should be prepared and professional especially on the phone with clients. She most likely was warned about this before she was let go.

Yeah, had to monitor 10 calls per employee and if they didn't meet the set standards we let them go. She would have access to sensitive member information as a call rep. If I called and heard kids yelling in the background I would have no confidence that the company is keeping my information safe.

I would assume she was probably getting too distracted by her kids or yelling at them while in the middle of a meeting or not making enough effort to keep them entertained in another room. I think atm, most companies would understand that working from home with small children means hearing said small children, which tells me it was something in her behavior that caused the company to fire her.

I work remotely which I’m required to take calls from customers. They made it clear to me that background sounds is unacceptable, including from children. I knew and acknowledged this. If you work onsite then you need to arrange for somebody to watch your kids. Just because you’re temporarily working from home doesn’t mean you have that luxury. That’s just how it is with remote positions.

Single parent- cannot have the kids watched by someone else, if their young they cannot be alone in another room. The company should know this enploying a single mother with two children and expecting them to be perfect on calls

I feel like this went on for a while with multiple warnings before it resulted in her being fired, she's onld enough to listen, send her to the other room or tell her to quite down or get her a tablet and put on Netflix with headphones while you're on your meeting calls.
