That is one case where I would be happy. Wells Fargo has no right to any money. There is an investigation still going on now and the exec's are going to jail. As a Canadian who travels frequently in the US I am quite frankly speechless. I don’t carry large amounts of cash as I have credit cards and a US bank account with Debit card. But ... I have travelled with $1000 cash for miscellaneous spending. Especially when heading south for an extended winter stay. I’m thinking I’m going to have to rethink that now. This is one of the most ridiculous, outrageous and egregious activities by the law enforcement community I can imagine. Shame on the law makers and politicians for allowing it to continue.

In SC the target amount is around $1-2,000. Apparently the presumption is that no one will spend $3-5,000 to have $2,000 of their own money returned to them. That fact alone is proof of just how wrong the whole forfeiture laws are.

Back in the 90's my dad and aunt were settling my grandmother's estate. Her neighborhood had a growing Asian population so it was no surprise when Asian immigrants came to look at the house. They brought their distrust of banks and government to the US because they showed up with $185k cash in a duffle bag to buy the home. Had they been stopped with the cash I suspect their fears would've been realized. Would've been damn near impossible for them to know how to fight it.

I have been searching Face Book Market place and Craigslist for scaffolding or a man lift for an upcoming home project involving redoing my colonial homes roof edge replacing built in box gutters. Believe me I am concerned. In this age of fraud strangers are very likely going to want cash. I have a long time fear of civil asset forfeiture after watching a special about Louisiana years ago. Great analogy with the cats and dogs! A couple of weeks ago my family was driving half way across our state with $2500 cash on us to go buy a puppy. I must say that I was rather nervous about being pulled over and having a cop take it. Thankfully we made it without being pulled over, however it was a concern at the forefront of my mind. I'm just glad that we weren't driving near Monroe Michigan 😂

Steve: I just saw your latest on civil asset forfeiture. For what it is worth I too am an attorney (in California) and I agree that this is outrageous. Let me tell you a concern I have as to me personally. I live in San Diego. A couple of friends and I often drive to Las Vegas to play blackjack. I regularly take $10,000 in cash with my friends taking a similar figure. There have been times that I came back with less than $4,000 (boo!) but other times I have returned with over $50,000 (yeah!) This is cash we are talking about here. Just imagine if we were stopped by the police, because we have imagined it, which is why we sometimes hide the money in the car during travel; maybe under the seat, or under the dash. But this points out a serious issue. We are damned if we do and damned if we don't. If we are honest with the police we are exposed to theft. If we are stopped by police and they don't find the hidden money, that is great, but what if they do find it? Now it looks even more suspicious. Do we hide the money from the police? (Don't get me wrong - I would never let the police search my car, but as you no doubt know, they are still known to do so without permission.) The money is legally mine, and legally obtained. But civil asset forfeiture has made us question whether we want to visit, and gamble, in Vegas. It demonstrates what I have thought for years - the police in this country are out of control. I don't trust them, and I avoid them like the plague. I have seen them lie in court, and I am sure that they occasionally plant evidence to ensure a conviction. It is a sad state of affairs that we must have a cynical attitude about police in America in 2020.

There were probably cops somewhere who were in possession of a StingRay device that acts as a cell tower and picks up cell phone communications who then contacted MI State Police and brokered a deal for a share of the 40k for the info on the driver carrying the cash. I'm just guessing that's what happened but I truly believe this happens and it is sad that money does this to people of every social class, every walk of life, every occupation etc.

Imagine if that person took money out of his bank and one of the bank tellers tipped off the police because the police have an agreement with the bank that they will give them a portion of any money that they seize. I wouldn’t put it past anybody to do that.

Good job Steve. I have a truck with a camper and travel the western US. Worst cops are in Nev and Az These are sheriffs deputies patrolling interstates. They have been trained to profile vehicles. I was stopped in Az on I-10 My infraction was that my mudflats were 9 inches off the ground. Az law is 8 inches. how can the cop tell the distance of my mudflaps from the pavement. As I was receiving my citation I returned my license to my wallet. At this point the cop asked me how much money I had in my wallet. He told me to give him my wallet which I did. He took the money dropped my wallet on the ground walked to his car and drove away. That was 46 dollars he got. This is how depraved these cops are.

There is a guy pulled over in Chillicothe Ohio. They found a couple of pounds of heroin and some other assorted drugs. Largest opioid seizure in county history. It was a one day story. They said they pulled him over for “registration concerns” which I think is code for being a black dude with Michigan plates in southern Ohio.

The greed of these police people will be their doom. No one pays attention if an issue like this only happens to a couple people in the whole country. But now that it has become thousands of people, things are getting noticed and a lot of people who normally would ignore this situation are beginning to stand up and complain about it. As for how much to carry? Myself? I carry no more then around $50.00 and my credit card is only that, a credit card. I have never had and never will have a debit card. None of my accounts are linked. So, worse case, they take my credit card and when I get home I call the credit card company, report it stolen and say that any charges after the time they took the card are fraudulent.

Early 90's, a Ross, Ohio cop pulled my buddy for speeding over and took his shotgun. Little did he know my buddies Dad went to grade school with the sheriff and that is the ONLY reason the shotgun was returned.... but it was returned with deputies name etched on receiver !!! Nothing was done to the deputy. This has been going on for a long time and we still do not have a formal recourse outside of hoping the prosecutor might take an interest. There needs to be an outside investigative department for police misconduct with powers to prosecute out of line officers.

I knew a many who had a multi state business. In one state the politicians start telling him if he wishes to remain a vendor in their state he needs to donate to their campaigns. They tell them who to write checks to and for how much. One of these state employees ask him for a loan. He says “ok, but I want this done legally so I will have my attorney write up the papers”. The attorney does so, the papers are signed and the money changes hands. Later the FBI begin to investigate the guy with the multi state business because they are investigating the politicians in that one state. The first thing the FBI does is seize all of his assets!! Everything the man owns and all of his money in banks are seized. He doesn’t even have the money to make payroll for his multi state business, all of this without him being arrested! Later the FBI decides the loan is a bribe and charges the man with bribery! He is in the process of selling his business because he can’t even make payroll. After he signs the contract to sell his business the FBI steps in and seizes all the funds from the sale. The man has no funds to even get an attorney. The FBI not only seized his money, but all of his ex wife’s money because they believe she divorced him to hide assets, when in reality she divorced him because just before the FBI started to investigate him, she found out he had a mistress in another state. In the end he took a plea deal because he couldn’t afford an attorney, and he thought the loan was legal and admitted to making the loan. Meanwhile, his ex wife is left with nothing! They took everything from her. In the divorce her ex husband was supposed to pay all the legal fees. He hasn’t even had the money to do this. The ex wife had 2 million dollars from a business she had before she married him, the FBI took that also. The ex wife was never involved the her ex husbands business in any way! Now the ex husband is incarcerated and his ex wife is being sued for the court cost and legal fees that her ex husband was charged by the judge to pay for their divorce! She has been a housewife for 20 years, and kept her money from selling her business 22 years ago in a certificate of deposit, her ex husbands name wasn’t on it, and it was under her maiden name. Lawyers have told her there is nothing she can do to get the money back because her ex husband took a plea deal! How is that for the government screwing someone over?

In the so called "'wild west" (states and territories west of the Mississippi River from 1865 to 1890) there were a good number of crooked sheriffs and assorted lawmen who also headed gangs that preyed on isolated travelers, stagecoaches, and other targets of opportunity. Unlike today, however, a badge didn't exempt them from wrongdoing. Most were eventually found out and either captured or killed in gun battles. Sometimes they were summarily hung. If lucky, they were tried and sent to prison. Justice tended to be swift. To use your chipmunk analogy, motorists today have become legal prey and their valuables treated like trophies or the booty of war. Ordinary people are looked upon as the enemy and helpless chumps. In order to forestall a possible revolution due to widespread public revulsion, every state in the union should hold a referendum on this issue as soon a possible.

9:28. Steve asked how much cash is a person allowed to carry on them in America was $10,000. I do not know now what it is or if it has been changed, but there are cases of less then $10,000 has been seized many times in the past from law abiding motorist. We as Americans are letting are Constitutional rights slowly taken away from us under the guise of the “War Against Illegal Drugs”, and the “War Against Terrorism” as a result of a very small portion of the population who commit these offenses that prompt these laws. Law enforce in America has been given to much authority that allow for law enforcement to interpret that anyone in with cash on them is a potential criminal. This has in turn corrupted law enforcement to the core. Like the old sayings, “Power corrupts. Absolute power corrupts absolutely”, and “Money is the root of all evil”.

The need to change the civil asset forfeiture to civil asset holds and if after reasonable period of time they don't charge and CONVICT you of something involving the asset, you get it back.

Just bought trailer for $3500 cash, seller got upset, seller told me the bank questioned the source of the $200 cash she paid part of her mortgage with last month. Strange country we live in now. Read Germans conduct almost half of private business in cash due to lack of trust of authorities, privacy.

Australia has legislation pending to answer this very question. The proposed law will make it illegal for anyone to do a cash transaction greater than AUD$10,000. The rationale behold this law is you only do large cash payments to hide it from the government and avoided the tax. This new law will force people here to do bank transactions for anything over $10k ensuring a reliance on the banks This did not work too well during the recent bush fire emergency where communications went down leaving shops with no eftpos. Many Australians were without money to buy basic food items.

$40K in cash is a bit much for any motorist to carry for a number of reasons, the least of which is a traffic stop. A car crash, carjacking, someone stealing the car while the driver is refueling. That's the problem with cash; it's convenient but impossible to recover once it's gone. Who's to say the police didn't take $50K but are only bragging about 40? It's the motorist's word against sworn officer. It would be nearly impossible to prove exactly how much they took. Yes, we should be able to travel with however much cash we please. I think if I had to travel with a large sum of money I would get a cashiers check. If the police grab it, the check could be voided and not worth the paper it's printed on.

As being in law enforcement. I don’t understand how law enforcement can seize money or any other evidence and keep it without charging and prosecution of a crime. It’s a clear violation of the 4th amendment. It’s like taking a suspect and evidence to find a crime. Not have a crime and follow the evidence to find the suspect.

Government entities should not be on social media at all. Think about this. There is at least one government employee, for each agency on social media, being paid taxpayer funds to post on social media! Cutting these jobs would be the quickest and easiest way to prevent government waste. It should happen ASAP!

And I'm bewildered that police don't understand that this is robbery - after a baseless accusation, and they're law enforcement! My neighbor that I've known for around 50 yrs. recently bought a used truck, paying cash. He paid over $35K for it. If he was stopped in MI (Thankfully we're in Indiana.) on his way to the dealership, he wouldn't have the truck and would be spending more money to a lawyer to get his money back. SMH. JMO.
