It depends on what state you live in it's different in all states. For example, child endangerment laws do not typically apply to cases wherein parents have simply made a mistake, like leaving a child in a locked car with the engine running while they made a quick trip into a store. Child endangerment laws refer to people who deliberately put children in situations that would more than likely put them in danger. If a mother were to take drugs or drink alcohol, and then drive with her child in the car, this would be a better example of child endangerment. She is more likely to get in an accident that would injure the child, and she was aware that what she was doing was dangerous for her child but did it anyway.

The sentencing can be very similar and enhancing or reducing from felony and misdemeanor typically has to do with context, extenuating and mitigating factors, prior criminal history, and other restrictions may be placed as part of sentencing to "pad" a misdemeanor allowing for someone to avoid a felony record but essentially having similar sentence as a felony with for example more restrictive probation, higher fines, longer real or potential (suspended) jail time, and in a case like this typically some pretty intense oversight and monitoring and requirements for parenting classes, limitations on contact, substance dependency eval, drug patch, breathalyzers, mental health counseling, etc and so forth. Not saying I agree with the course taken in this case I think given the two occasions in close proximity to one another and the nature of her actions and lack of remorse, total inability to appreciate the gravity of her actions etc would make it clear this is not a one off and perhaps a heavier consequence would be appropriate here. I have to consider the odds that she likely has done the same or similar on many an occasion before and only got caught on these two due to immense carelessness and sheer luck. The fact she seemed nonplussed, tried to justify with some pretty ridiculous logic, wasn't scared shitless straight to even sneeze wrong after incident number one, and dared to do the same thing same place aame everything mere days later tells me she's very comfortable and the kids seem largely unbothered by the whole thing which is really sad. I tell u if I hypothetically left my small kids in my SUV on a random street (for argument sake let's say in front of my brothers House), and just left, they'd be like wtf?! 😳🤔 Even at 5 years old my kids would be like dammit something isn't right about this we need to get help, they'd be pitching a fit, they'd probably get out and be pounding on bros door saying help (if in public I'm not sure but they'd certainly act out some version of what I always telk them to do if they are lost or if some emergency happened to one of their parents or caregivers) and if the police showed up in numbers and started questioning me etc they'd be glued to my side, probably crying they'd be freaked out and Afraid bc they know not to be afraid of police, but they also know how to read the room & that police don't just show up when everything is going awesome to say hello. I remember the first and only time I've ever been pulled over with my kids, they were probably 7, and 4ish, initially they were panicking like oh no what is MOM getting pulled over for? What did u do mom? Mom why are they taking u to jail? Etc when the cop came up to my window he said I had only my running/fog lights on on my new pickup and it was dark, I didn't even realize bc the fog lights are VERY bright and high off the ground, and the switch is automatically defaulted but I figured it got bumped when they were wiping it out at the car detail/wash place earlier since it's not easy to do on accident. He was real nice he could see the kids in the back and was like hi kids everything is okay I just wanted to let ur mom know that her lights were not on, whatever whatever hes like have a great night and safe vacation. So I used it to explain to kids that yes, we call the police when somebody does something illegal or bad and the police DO arrest the bad guys and normal people don't Have frequent interaction with law enforcement showing up to their location, BUT they also have a job to keep people and the roads and public places safe and keep bad guys away and help people who had an accident or car trouble or lost kids or puppies, to help people who get hurt or if there is a medical emergency, etc. So not to be afraid of police cops or LE vehicles. Even still they'll see a cop car and be like mom watch out there's a cop! And I'm like so? 😂 I'm not a speeding I didn't commit a crime he's not worried about us son. Ironically now I myself am a LE officer and my kids still don't make the connection, bc I don't drive a marked patrol vehicle and I obviously don't wear my uniform at home with my family. My point is, most kids have a healthy fear of the law as they understand it and authority, and are not desensitized to the presence of LE units and domestic dramas and mom going to the bar mid-day (while they're in the vehicle no less), and so forth that would be very affecting for a child and u can see they seem to be rather arrested in their appropriate developmental skills for their ages, they're half clothed, in diapers, and soiled, and running and clambering about in this situation I can't even imagine what home life consists of for them

My ex went to prison for 3 years for driving intoxicated and wrecking her mini van with her 3 kids in the car. One child broke her arm, hip, and leg. Another one was thrown from the van as it rolled and suffered permanent scarring on her body. My ex walked away unharmed and was arrested at the hospital.

It is hard for me to judge the aunt for her response once she knew the boys were in the car. Her sister is a user and a manipulator. The system sends the kids right back to the mom. The aunt has likely dealt with this the entirety of her life with her sister. It wears out the empathy in a person. The biggest concern I have is for the boys. There mom is selfish and has worn out all the supports she had. She is a lifetime victim. Those boys need someone who wants them and puts their needs first. The system is set up to put the mom’s connection to the boys above everything even the boys need for security and love. It breaks my heart.

Myself and brother and sister were left in the car at a bar while my parents were inside drinking. Every hour or so they would come out with bottles of pop and bags of chips. This was in the 1970's when the world and summers are not as brutally hot as they are now. It still sucked.

Does anyone else find it strange that the supposed aunt KNEW those kids were in the car alone for “half an hour” and it was a random stranger that reported it instead of her? Edit: for those saying she didn’t see the kids in the car, I just find that very difficult to believe. You mean to tell me that the car was sitting right outside of her house for 30 minutes and she didn’t see those two clearly rambunctious kids in the back? People can say what they wanna say and, in my opinion, of course she’s gonna tell the cop she didn’t see them in there. Because she doesn’t want to be liable for enabling neglect.

just last week or so in marana Arizona just outside Tucson AZ a man was released with 0 bail for a murder charge on his 2yr old baby girl. Yes a murder charge on his own baby.... And the state was requesting a million dollars bond too yet the judge actually said nah ima let him go home with 0 bail..... Christopher Schultz is his name I think. She's lucky could have turned way worse

So did she sell her Link card for money to go drink in the bar? What are her children eating? If she's able to get food stamps then she probably doesn't have much money. How does she have so much extra she can sell her food stamps? It makes me so angry when I think about people in this country with food insecurities and I've heard them say it's not enough food stamps for them to eat in a month. This happens a lot. People think that if they admit to lesser crimes, it'll make them seem honest and they'll be able to get out of the bigger crime(s). Also, the fraud aspect requires an investigation and isn't something she'd get arrested for immediately, so she'd rather go that route, if possible.

Probation for now two times leaving your small kids in the car by themselves while you go into a bar. This is what is wrong with our justice system. This mother deserves jail time not probation and those kids need to be removed for their own safety. This is exactly why we have young boys and girls running the streets wild because they have parents like this. These children are doomed for failure unless someone steps in and helps them.

The "system" doesn't help either. Go find the homeless and incarceration rates for former foster kids. Not to mention the abuse, sexual, physical, psychological, in foster care. I'm not saying there aren't good foster parents out there. I'm saying they're few and far between. Even fewer that will take on kids that are just north of feral. They would bounce from home to home, then group homes, until they aged out and had no one and nothing. Sometimes the outcome is the outcome regardless of the intervention.

The government isn't going to do anything to her. Nor will DCF take the kids. She's breaking laws left and right yet nothing is going to happen.
