If it was another employee of the company who made the floor wet and didn't make him aware/didn't put up signs etc then he may have a claim. Would be interesting to hear what the company is doing, Have they sacked him because he can no longer do his duties or did they allow him time off to recover and continue to pay him, offer to make reasonable adjustments so that he can continue to work for them? Does the employer provide private medical cover, accident cover etc for employees - if so, that might be worth looking into. Clearly it was an accident on their premises during work hours, so even if they were not liable, they may have cover for it..... the employee might have cover on their own personal insurance, if they have any.

Sound like every 6 months the mouse trap gets a new coat of paint. If you are painting the floor, surely before you start, you carefully remove all obstructions in advance being wary of any risks of injury?

Yeah, and in the normal way, with your hands, rather than pushing it with your leg. Who paints floors anyway?

@billyhills9933 they do seem to do that in a lot of industrial buildings. It is a sort of epoxy floor paint. Makes it all easier to clean. They tend to stand and roller it. Used more to delineate access paths but it is used in garages to make cleaning easier since the floor is sealed.

There is an interesting side issue in that this paint tends to be fast drying and incorporates epoxy and VOCs which would mean there should be a COSHH or whatever it is called now Risk Assesment since the paint will have volatile ingredients that could damage you health. This would mean in any large company there should be a written procedure for painting the floor and what to wear when doing it. It would also sensibly detail that any items standing on the floor should be moved to ensure the work is done promptly. Generally when painting with epoxy floor paint in an enclosed area you should be expected to wear a safety mask and open all the doors to ensure adequate ventilation. Now, if matey or Dom had gone down that route, maybe there was a HSE breach but for possible lung damage rather than hand impairment lol.

I think I know the type of mouse trap he refers to: kind of irrelevant to the accident. And I loved that pause when the flaw in the argument was explained, i.e. they slipped on the wet paint they put on the floor.

To what extent does the employer have a duty to provide training and safety measures for task that aren't contractual or day-to-day? If an office manager is directed to resurface the car park, follows that direction and then suffers an injury doing that, I don't think the employer can say "well you burned yourself on tar that you'd heated yourself, you knew it was hot so it's your fault"

Well, depends on the mouse trap /s He didn’t burn himself on hot tar, he fell over

I agree - the poor have no aspiration and have lost all sense of proportion. A more effluent (edit - perhaps even more affluent!) person would have claimed that the mouse set off the trap whilst he was painting the flooor. The trap bounced off the floor, caught and almost severed his private parts from his body. As a result of which he will no longer be able to father a family who following cultural traditions would have looked after him in retirement. Therefore the compensation required for the loss suffered is £5m.

@@paulmitchell3131 Thank you. 👍You know, when I was about to post my comment, I said to myself must spell affluent correctly. The frequency of s*** dicharges into our rivers and lakes means that the word effluent has become an everyday word and therefore an easy mistake to make. Of course our friend above would probably blame that on the quality of the material flushed from the poor households.
