I cant tell you how much I appreciate this video. my children's mother left with my kids a few days ago just to hurt me. I've spent every waking moment with my kids since they were born. I've never felt so isolated. I've never wanted to be anything but a father in my life. I started farming when my first son was born to pass down a trade we could learn together. we run a farm together now and our little baby Willow tree isnt at the top of the stairs calling my name with a smile ear to ear after I feed the pigs. my heart beats so fast it makes me sweat when I see the walls of my house draped in memories of them. I dont know where they are, who they are with or if they are ok. I cant call anyone to help cause i have no rights as a father. every moment since i have lost my kids has been subsequently worst than the next. we were looking to buy a new house in 3 weeks and i have to pack my kids toys and i have no idea how when every toy i move makes me feel like I'm quitting on finding them. I sit outside this place or that place terrified I'll be seen or what to do if I see them. I'm steadily losing sight of my value. my oldest son lives with me full time still and now hes asking questions and noticing me spin into moments where I'm so hyperdocused on how I could have made anything better to not have them just taken.

This is what I needed, very informative! I'm planning a move in a few years so it gives time for the kids to be older and have time to grow into what they want, for me to get more established finacially after the divorce, trying to find a better school system for them and my parents who are their main and only babysitters will be moving also, so I want to be closer to them when they finally retire and move. My custody is supposed to be 30/70 but their dad only takes them 13.5% out of his 30 he's supposed to. I see no reason to stay without my parents once they move for a one day a week visit when he hasn't upheld the full 30% court order. A full summer and holidays would be just as much as and more than 13.5% of the time he sees them currently. Thank u for this info!

I'd be best to retain an attorney for move away case as they can be very difficult cases. Usually the parent that's asking to move has to provide the expenses for the child for example the round trip fare.

facing the judge tomorrow and thanks for the informative video. I've been more than open with his dad about moving due to job change and he's still taking me to court. I have 100 percent of education tie breaker that is largely ignored by him and he never keeps his time or schedules. Another judge grnted my son be with me m-f and weekends with dad for this very reason that his dad couln't be relied upon. Son has improved 2 whole grade levels and pandemic remote proved to be better at home in one place for him. We still kept up safe visitation 2 to three days a week and he still couldn't make it sometimes due to poor scheduling skills. I will look forward to court then. wish me luck!

@@DithsHauteSpot The move was great. So happy to be out of there. My ex doesn't have any rights to our child at this time. She stole her and ran out of state. I found her in Oklahoma 10 months later. Then she picked up 2 drug charges after she was extradited back to California. We are living a great life out here...... Amazing church, great preschool, great job, much better work/life balance. We are very blessed

You did good. Im in a crazy case. Judge bias denied me due process. Heard her side and then told me i was done when I said I was done with witnesses ( my ex on stand was hostile we got no place said I'm done with this witness I'm done. My exact words) he gave next call date ..came back thinking my turn said nope here's my decision I was shocked 3yrs haven't seen my kids boy and girl bother under 8. She has full control I got the shaft. It has shattered me. I am broken

What if the parties have joint physical custody but a 80/20 time share? Does the court consider the parent with 80% the sole custodian? Even if the actual order says joint?

I realize wanting to get ones’ children away from a normal parent is not a good reason, but what if there are documented abuse (not physically severe) to them over 2.5 years (children are 3.5 and 5) and 5 year old son is autistic. 6 year marriage- got married in Florida but we have lived in Maine for 5 years. There’s no custody or separation or divorce yet. I want to go live near my family and my father is headed to hospice soon so I want to move from Maine to Florida. I’m my dad’s power of attorney and health surrogate. I’ve been handling a lot remotely but have taken 8 trips in the last year and a half (4 of them 4-6 weeks long with the kids). Their father doesn’t want to. His blowups have gotten worse since his 6 month internet affair that went physical was found out. CPS was called by PCP and they recommended stress relief counseling and parenting classes. The kids’ Father does THC and several units of alcohol a day. I’m done trying to fix it. I have no family or support here and I. Are for the kids 80-90 % of time and I’m a PT and work with my autistic child daily. Please let me know how I can complete my goal of moving to Florida with my children. I have located a very good paying part time work- $45/hr and schools and I can afford to pay my way and my children’s way and help my dad much more than I can from Maine. My mom and sister are local and I have long term reliable friends in the Florida town in which I went to University.

Im a single father, child has been living with me for the past 3 years. He is thriving in school and sports he is 11 years old. We currently have no custody orders. Mother file exparte because we went on vacation to the Grand Canyon. Exparte was granted paperwork says child is to return to California. Which is wierd be cause we live here. She claims I kidnapped him through text messages cause i did not notify her we were leaving for vacation. My child mentioned it to her before we left which i had no problem with because from my understanding we have no order so i do not need to notify her of our vacations. She was in contact with him while we were on our trip. My child now is in tears do to him having to leave his school , friend, sports. She also lives 4 hours.

My child’s mother moved from Oregon to Hawaii, no restrictions on move. But I haven’t seen my son in a year…. Are only options moving to the state and revising with Hawaii court since new jurisdiction is there ??? Thank you

Moving to AZ dad is absent but I don’t know what evidence to prove that it will be beneficial. child has been with me since birth. father has showed per existing order 2 times per year since 2019

What if you were awarded sole legal custody and sent your child to the other parent and they failed to return them at the end of the summer?

If you have a court order in place you can call the police to enforce the court order. Or you can also go back to court that the other parent is not following the court order.

My son does not have the kids but he has to pay his cheating wife child support he took care of them when she left their marriage and her boyfriend didn't want any kids so now she broken up with that guy and is living back with her mom and now he has to pay her child support his no longer live with his wife too)

My sons Mother wants to move 3000 miles away with our 10 year old so that she can move in with her long distance boyfriend who she has never lived with. Her only reason for moving is what she wants because it’s her best interest. Our son and I have bonded since he was born, but a move this far away will almost certainly erode that bond. She has even said in writing that she wants to move in with her boyfriend because it would give her a better life and she would not have to work. The school district she wants to move him to ranks dead last in the nation, the school district he would be moving out of ranks number 2 in the nation. These lovers have never lived together and their are no guarantees that she will get him back here to visit dad as she promises. She simply doesn’t care about judges orders.

Hi I usto live in Pomona and my ex husband live there… but I just move to Compton with my 3 kids… but I still drop off the kids all away to Pomona….. is that going to affect me I have 80% of the time with the kids

If you have a court order it's not going to affect you, as long as you gave the other parent a 90 day notice of the move. You can also go back to court to modify the transportation of which parent will provide the pick up's and drop off's

They just have to respond to why the move will not be in the best interest of the child; the deposition.

I am in the same situation as the mother who married a Marine out of state. I have joint/primary custody of my kids that was granted 2 years ago in court. I am trying to move with my two daughters to live with my husband and we are expecting a baby in November. My children’s father isn’t very involved, doesn’t go to dr appts, doesn’t go to school events, will skip school conferences and stuff like that. He occasionally exercises his parenting time, but will often bail or bring them home early. I’m wondering how that case turned out with that mother or other cases you are familiar with. It’s a unique situation to be in, and I cannot find much info out there about my situation. What are some other reasons I could give the court for the move? We will have a house thats provided by the military and thats better than living with my parents now. We have a 2 bedroom house, garage, fenced in backyard, we will have the girls in a school that’s better than the one they’re in now and it’s right up the street. They have health insurance from my husband and I have always been the one to provide that. The girls are both very well behaved and haven't had any issues in school or health wise. It’s hard to tell if this could impact the girls in a negative way emotionally but we don't have factors working against us in that way. Any input would help! Thank you!

Why don't you do the right thing and NOT move. But yet again you only care about yourself, those kids deserve their father.
