I looked up “abuse of a communication facility” because I’ve never heard of that charge. Sounds like this guy is in some really serious sh!t in a bunch of places, maybe even with the feds. Unlawful use of a communications facility is a federal crime and a state crime in Kansas “that is usually attached to federal drug crimes involving trafficking or selling drugs. Under federal law, a “communication facility” refers to all mail, telephone, wire, radio, and computer-based communications.”

Yes, the use of a communication device during the commission of a felony. It is usually reserved for big time dealers moving a large quantity of "product" and/or distributing to multiple states. Law enforcement probably had their eyes on him, and his brother, for some time and obtained warrants for a SWAT type raid to make the arrests and search the property. This would explain why he made the statement about his grandmother being traumatized.

This charge is the least of his problems. It can indicate something as simple as talking on the phone about meeting up to make a deal, which is something that just about every neighborhood dealer is doing, whether with customers or suppliers. And the "computer-based communications" part is there for the idiots posting on various social media about having drugs for sale.

OSG, this isn't a mere possession charge. This is a distribution charge due to the amount he had. And possibly a confession. Distribution carriers higher penalties than a possession charge. Possession charges are for small amounts for personal use. Distribution charges are for transportation of higher amounts of illegal substances between the middleman or the drug dealer. So no, the punishment doesn't go higher as the charge lessens as you implied with the on-screen text.

Distribution is the actual act of making a drug transaction. Usually it's charged when an undercover or an informant makes a controlled buy. It's a VERY serious charge
