We'd better have a decent impartiality solution ready to hand then -- lifetime appointments do tend to shield courts from the baying crowds and their populist, often minority-victimizing whims. A fixed retirement age, regardless of age at appointment, is one replacement to 'lifetime'. The worst outcome would be to have judges with renewable terms, where they could serve for more than one term, and thus would be incentivized to be 'popular' or 'politically attractive' in their decision making. One virtue of 'for life' is that it precludes the possibility of further periods of service, at least as a judge here on Earth.

I'm confused. A judge's daughter who doesn't live with him and doesn't have any legal entanglement with him, can cause the judge to be conflicted. "This is pathetic….a Supreme court cannot loose the confidence of the nation and still function" - On the contrary, a Supreme Court can continue to function even if the entire nation absolutely despises it. As sad and pathetic as it is, the regular citizens mean nothing to and have no control over the Supreme Court. The only ones with any power over the Supreme Court are those in Congress, with the power of impeachment (which is now impossible for any Republican judge/justice).

No need to impeach, the constitution does not specify impeachment for Judges. The standard for removal is nowhere near as high as "High crimes and misdemeanors", judges must merely maintain "Good behavior" which clearly bribe taking, in the cases of Thomas and Alito, is NOT Good behaviour.

The full standard in the Constitution is “treason, bribery, high crimes and misdemeanors“. The reports of both Alito and Thomas taking money and favors from people with interests in cases before the Supreme Court make a strong case for impeachment and removal on grounds of bribery.

I believe you are right that the American people should have the right to vote in, and out of office Judges, but we haven't been doing so good on electing members of government in a while. We make choices from what we are given, never really doing research on them, just from the party that they represent, and the lies they tell to get elected. Who in their right mind voted for a Pay To Play Bobert or M.T.G. thinking this was a good idea. Or people like Rep. Jess Edwards that referred to young girls as being "ripe" and "fertile" this week when trying to block a ban on underage marriages.

Alito has recused himself from decisions before when he and his wife got shares in various companies from her late father's will . So what's different this time ? It appears that while he's happy to do the right thing when money is involved ( as he should ) he's not prepared to do that on ideological grounds . As a member of SCOTUS this is an unacceptable position as it would suggest that all his previous decisions were influenced by his ideological bias rather than a cold reading of the constitution . The duty of the Senate is clear in this matter and both Alito and IMO Thomas should be investigated and also prevented from making any rulings untill those ivestigations are complete .

@@selftaopath Because if Biden did pack the court then it would lose all credibility, since for all the Republican-minded people out there it would feel like court tampering for political reasons. Short term there'd be a new SCOTUS with 13 judges, but then a new president takes over and the SCOTUS suddenly has 17 judges, then 21, then 25. Packing the court is a trainwreck in slow motion that ultimately removes any credibility of the supreme court.
