Sir hamara land collecter ka 98 years ka lease tha wo finishho gya 2012 mai building banane ke time par conveyance nahi kiya & land society ke naam pai nahi hua society registered hai par in collecter land abhi devoloper ke name pe hai lease renew karne ke liye wo ab kehta ke hai ke mai landlord hu or hame tenant hona padega bldg in delapilate condition sir hum bldr se ye lease renew society ke name par kaise le sakte hai pls advise

Sir stamp 0% stamp duty k baad registration ka bhi hoga 6 months tak aapne video me kaha tha wo abhi kab hoga pls is bare me koi video banaoge..

Hello sir, I am owner of 1 flat where I have been residing since 2019 and from the date of possession of said flat, I have paid each and every due of maintenance and i also paid the amount what builder sales guy asked us to pay as maintenance amount for last 6 months while purchasing...But now our society is asking me to pay maintenance before my possession date as they are unable to collect it from builder. When we asked the builder, he said he doesn't have any information on this and even he don't have any data or previous bills. Am I liable to pay the pending amount? If not, what are the actions need to be taken

Dear Mr. Nilesh, As per your query, the society was registered 6 months prior to taking possession of flats by you. During this 6 months, builder should have paid the maintenace as the same was in his possession. Since he has not paid the said amount, the same becomes liability on the said flat. Therefore, it becomes your responsibiilty to pay the same. You may in turn recover the same from the builder. Before buying the property, you should have insisited the NOC or no due certificate from the society. This mostly, you might not have obtained.

Dear sir, Society was registered in 2017. And I purchased in 2019. However as you said I was not aware to obtain NOC or no due certificate from society. Builder sold the same flat to one of the investor prior to us.and we purchased it from that investor in 2019.

Registrars don't know the procedure for issuing DEEM CONVEYANCE for CONDOMINIUMS with 5 members nor they have any process in place how can a condominium with 5 members can transfer from Registered Condominium to Society with 5 members. Can you provide reference of any GR government has issued to the Registrars for changing Condominium to Society immediately and apply for Deem CONVEYANCE ?
