संसद टीवी के ख़ास कार्यक्रम मुद्दा आपका में आज बात वैवाहिक दुष्कर्म की। दिल्ली हाई कोर्ट ने वैवाहिक दुष्कर्म यानि मैरिटल रेप को अपराध घोषित करने का अनुरोध करने वाली याचिकाओं पर खंडित फैसला सुनाया है। इस मामले में दोनों जजों जस्टिस राजीव शकधर और जस्टिस सी हरिशंकर में एक राय नहीं बनी। एक जज ने पति की तरफ से पत्नी के साथ जबरन संबंध बनाने को अपराध माना है, जबकि दूसरे जज ने कहा है कि कानून में इसे बलात्कार के दायरे से बाहर माना गया है। दोनों जज इस बात पर सहमत थे कि इस मसले पर सुप्रीम कोर्ट में सुनवाई होनी चाहिए। इस तरह 2015 से चले आ रहे इस केस में अब भी फैसला नहीं हुआ है। इस मामले में याचिकाएं दायर करते हुए भारतीय दंड संहिता आईपीसी के तहत दुष्कर्म कानून को चुनौती दी गई है। आईपीसी के सेक्शन 375 में जो अपवाद है वह वैवाहिक बलात्कार को अपराध की श्रेणी से बाहर करता है और यह दिखाता है कि विवाह में एक पुरुष द्वारा अपनी पत्नी के साथ जबरन यौन संबंध बनाना बलात्कार नहीं है। भले इसके लिए पति ने पत्नी की मर्जी के खिलाफ जाकर जबर्दस्ती की हो। दिल्ली हाई कोर्ट में 2015 से लंबित मुकदमे में बलात्कार की परिभाषा तय करने वाली आईपीसी की धारा 375 के अपवाद 2 को अमान्य घोषित करने की मांग की गई थी। इस प्रावधान को आरआईटी फाउंडेशन, आल इंडिया डेमोक्रेटिक वुमेंस एसोसिएशन और कुछ अन्य याचिकाकर्ताओं ने चुनौती दी थी। उनका कहना था कि पत्नी की मर्ज़ी के खिलाफ अगर पति जबरन शारीरिक संबंध बनाता है, तो उसे रेप माना जाना चाहिए। इन याचिकाओं का विरोध करते कई पुरुष अधिकार संगठनों ने भी याचिका दाखिल की थी। उन्होंने कहा था कि अगर धारा 375 के अपवाद 2 को रद्द किया गया, तो इसका व्यापक दुरुपयोग होगा। केंद्र सरकार ने इस मामले में अलग-अलग मौकों पर अलग-अलग स्टैंड लिया। 2016 में केंद्र ने कहा कि अगर वैवाहिक जीवन मे बने संबंध को बलात्कार न मानने की धारा को रद्द किया गया तो इसके व्यापक दुष्परिणाम होंगे। भारतीय समाज पश्चिमी समाज से अलग है। यहां ऐसी व्यवस्था का नकारात्मक असर हो सकता है. इससे मुकदमों की बाढ़ आ जाएगी। हालांकि, 2021 में केंद्र ने कहा कि वह इस मसले पर कानूनविदों, सामाजिक संगठनों और दूसरे लोगों से व्यापक चर्चा करेगा। उसके बाद वह अपना दृष्टिकोण स्पष्ट करेगा। ये तय माना जा रहा है कि मामले से जुड़े सभी पक्ष बहुत जल्द देश की सबसे बड़ी अदालत का दरवाजा खटखटाएंगे। मुद्दा आपका में आज बात वैवाहिक दुष्कर्म और इससे जुड़े कानूनी, सामाजिक, नैतिक और मनोवैज्ञानिक पहलुओं की। साथ ही आज की चर्चा में ये समझने की कोशिश करेंगे कि क्या मैरिटल रेप को भी अपराध की श्रेणी में रखा जाना चाहिए या नहीं?

Entire panel only talks about consent of wife, her choice , her decision. Fine , but what about consent of husband ? If a husband can force the wife then I do believe the opposite can also happen especially in cities and towns when most women tend to be aware the laws and can misuse it by harassing and threatening the husband! Violence need not always be physical in nature it can be in other forms too. Best way is to make the law gender neutral and make it equally applicable to both husband and wife . Based on the evidence presented in the case the courts can decide. But this not should not be same as the existing domestic violence and dowry 498a laws which are completely biased against men where men cannot even approach the court. These laws are applicable only to women and in case of false accusations and if the man is unable submit proper evidence as the proof of burden is on him , the man is entirely at the mercy of the woman's statements. Ridiculous!!

see our society is still patriarchal.. it is well said by one panelist that husband has taken his wife for granted which means she cannot say no to him...and whatever you said is also true but women who are facing such issues are larger than men who are being harrased due to misuse of laws... because no of womens who are aware of their rights are very less... forced relation cannot be called as marital rape... because it holds the very essence of marriage.. otherwise it would become difficult to sustain marriages in india in later time... so our laws should be such which gives space to both the parties to put forward their points .... such sensitive issues can be prevented with counselling and proper education because it is just the beginning of such highly sensitive issue... which needs lot of efforts from judicary as well as legislature of our country..and yes 498 (a) is arbitrary to some extent it needs immediate curtailment wrt controversial provision...

Absolutely.. the misuse of 498A in urban India ... The suicide rates among married men is way more higher.. the mental harrassment a married man goes is never brought into the light. No one talks about other aspects too like, delhi is considered to be the RAPE CAPITAL OF INDIA ( indeed women are suffering ) but 50 per cent of the cases are proved to be FALSE , this ratio is never shown my the media...
