As for the issue of the (alleged) scam videos, there is virtually no way they are parodies. Even if one might be a parody of Got Talent or X-Factor (doubtful), that would only justify using imagery from Got Talent or X-Factor, not a copyrighted song that is not being commented on. And as for people not caring about Simon Cowell, the content ID system would give the ad revenue to the songwriter (or whoever the songwriter sold them to). So Simon Cowell is not getting screwed, songwriters are getting screwed.

well as I recall from the original video there were 3 levels, some where he sang covers himself and auto tuned them, some where he mimed, and the third level where they covered or mimed and then also claimed ownership. I think its a mistake to lump them all together. Definitely the ones where they claimed ownership were outright theft, but your analogy doesn't really apply as much to the first two. You tube has its own rules on taking down covers or distributing add revenue. It's not black and white, who knows what the copyright laws are in Malaysia or w/e. Didn't you just do a video where they wanted you to edit yourself out of your video? report them and move on.

A few years ago, there was a self-published romance novel and people figured out that the 'author' had taken excerpts from other peoples' work and calling it their own. It's the same situation. Think of the cases where people have sampled a small amount of a song or tune without permission ... even seconds of a sample or performance without substantial changes from the original has left people like Rick Beato demonetized. What do you think should happen to a mimed performance of a recording of the original artist!?! Hash tags saying something is a parody is just a lie trying to cover up theft. KZbin should ban left/right mirroring by demonetizing them as this is only done to break copyright. I know some people do this to shorts, because they are incompetent, so KZbin should provide a facility to un-mirror shorts for those incompetents ... and there should be a report of fraudulent mirroring available on every post, and these should not be ignored. I would also like KZbin to mark all demonetized posts with who is getting the money, so we can vote 'with our feet' ... and perhaps allow us to refuse our viewing counting to the fraudulent monetization.

Sellers are selling FAKE designer items like Lululemon, Louis Vuitton, etc. What I don’t understand is that many people say they’re okay with getting a knock off handbag or athletic gear. KZbin delete videos of people ‘reviewing’ or ‘critiquing’ artist’s performances if they don’t add enough original content to the original. This can be based on either the video or audio component. KZbin is really dropping the ball by allowing these songs to play in its entirety from start to end without any interruption at all.

At bottom, while all parody is imitation, not all imitation is parody. And therein lies the issue for the scammers (assuming YT or the IP owners choose to pursue the issue at all). So glad you’re shining a light on this scam!

Plus, lipsyncing over the official release isn't even imitation. They're using the actual song, not imitating it. They're imitating the show, KZbin's Got Talent... but we're talking about a music copyright. The show cleared the music with the song's publisher, before airing. The fake singer can imitate and parody the show, no problem. But if they use the actual song, they need to clear that with the song's publisher before uploading. If they don't want to share income with the rights holder, they could open up their DAW, and make their own imitation of the song, and sing as best as they could, and then use Melodyne and AI vocal replacement... then they could upload that as a legit parody. But instead they got lazy, downloaded the official copyrighted song, and lip synced over it.

Many people have a very strange attitude towards music. They would never condone stealing a painting from an art gallery or plagiarism, but they think nothing of downloading music for free, and they see no problem with content creators claiming ownership of a song they had absolutely no part in the creation of. The "who cares" people. As long as they can download and own the music they like for free, they don't care if other people pay for their downloads, they don't care if artists get paid, they don't care who's getting the copyright money from YT, and they don't care if someone fraudulently claims ownership of a song. All that stuff is just blah, blah, blah to them. It's just noise, and they don't care as long as they can access the music they want to listen to. It's a shame that integrity means so little to them.

I think it's differentiating between *how* something has been done as against *what* has been done.. If someone is watching the videos Fil is drawing attention to and all they're seeing is the ingenuity then they are as immoral as the person making the video. Hi Fil. Thanks so much for highlighting this. My husband is a musician, singer, writer, composer and teacher. He won the best rock folk artist back in the 70's (when he just turned 17) and appeared on TV with Tony Wilson and The Old Grey Whistle Test. He's made a living over the years but has had so many songs "stolen" over his career. Even now Spotify pays all his earnings to an American singer of the same name !!! It is maddening that people don't know (or seem to care) that copyright laws pay an artist less than 10% of the total cost of a recording and that decreases if the music is in a different region of the world but think there's no harm in reproducing recording, DVD's and pocketing the proceeds. Theft is theft. The majority of musicians, writers, composer's still have rent, mortgages, bills and are not living the highlife even if they or the song is well known. They do it because they are artist's and just like Van Gough and Mozart mostly never get paid :-(

It doesn't mean anything to them or they may even harbor some resentment toward people that do have talent. thanks for the update.. regarding the Simon Cowell factor, I filed theft charges on 3 individuals for trademark fraud. They bought cheap guitars, made them up as Gibson's and then pawned them. The Asst DA I worked with refused to follow through with the charges because she disliked pawnshops so much, "they can't be victims". That was 15 years ago or so and still stuck in my craw.

I have recently had a similar conversation with my daughter when she was frustrated with people "hoarding money", and other people don't have enough. She basically said the law should apply differently to them from the average person. I turned that around and gave her an example where something would apply to her to her detriment. Again, her intentions were good, but then she finally understood more clearly, "I may not like something, but the law is still the law, and it should apply to everyone equally." Of course, we know it isn't always applied that way, but it should be applied that way. I think blatant disrespect for the law is doing great harm to our would today, and I'm not talking about the criminal element that we've always had. In our country, the legal system is also being used to promote or hurt politicians. It shouldn't be for that, it should be about justice! Fil, thanks for your, in my opinion, very accurate comments! We need to be careful what we ask for, because we might get it!

Criminal Minds feel it is okay to take whatever they want, with no qualms or rational. However, wrong is wrong, and right is right, with no exception to the rules. And your example is correct. Unfortunately, we live in a world with unscrupulous individuals, with no conscience or accountability for their actions, thus scamming and fraud is prevalent in today's society.

Maybe the next video should show all the charities they are giving to. Thieves are not generally thought of as Robin Hood because they happened to rob a rich person.

I LOVED your hypothetical situation you have layed out for the people saying "who cares" about the entire fraud thing! I can only imagine if they get their stuff stolen as you said, they would then call the cops to explain the situation, and the cops would respond "who cares" and "you have to appreciate their ingeniosity".

Sure there are - loitering, for one. But this crime has an easy to identify victim - the rights holder from whom the imposter is stealing money. There's no need gor any mental gymnastics to find a victim... it's the person whose song and vocal identity are being stolen - monetized by an imposter.

Yes, and Al Yankovic is historically vigilant in getting the artist's permission before he does his parodies. If he doesn't get approval, he doesn't proceed with the parody.

Madonna actually suggested that Weird Al parody Like a Virgin and came up with the name. Weird Al gets permission from the writer/artist to record the parody.

Nice vid Fil! Music creators must copyright their music with the Library of Congress. Then the music is protected. A DMCA claim at KZbin forces them to take down any video that violates the Act. Adding another persons music, recordings, to a video is unlawful.

People got so used to theft of IP on YT they don't care anymore. I used to follow a channel on airplane history that steals their video covers from model plane box covers, I kept pointing it out and all I got in reply were similar comments bashing me for highlighting the issue of someone using the artwork somebody else paid for for exclusive use… 🤷♂️

Fil: It is apparent that few people actually understand what copyright is and what it covers. And music has become a commodity that no one wants to pay for, so the combination leads to theft at all levels. I see it my area of written publication- textbooks that I wrote that later were copied and sold to others without my knowledge, for example. It is hard to crack down on, expecially when people do not understand it is essentially theft.

You tube does have a "cover rights" clause/agreement with a ton of artists/labels/etc. There is no list though. And it has some very specific requirements to do covers. I believe one of them is that you aren't supposed to use the original music as a backing track. Or it has to be stated as such. I can't remember I'm just going by memory here, but the policy is written somewhere on creator rules.. I think green screen background has rules too.
