Not necessarily, from an employment law context you could simply utilize a label that isn't associated so heavily with misogyny in the view of the public.

@@JobAttorney Then it's problem with the public that they are prejudiced for the term INCEL which literally means a virgin. Someone can identify as an incel and it shouldn't be a problem. What's more important, actual actions/opinions or an ambiguous label? People like you make me sick, you only care about label, not substance.

@@DeeJayBanana44 Definitely true, the problem does seem to be that some of the people using the label feel the label has a different definition than how most of the public would define the term. And that's a problem, because the public's definition includes so many hateful and problematic things.

If a person is trans and identifies as a heterosexual male, then they are a heterosexual male. The only assumption here is that I can trust in how people self identify.

Are you asking what a woman might do if she finds out her boss self identifies as an incel and believes that he is acting against her based on gender? Her first step would be to either speak with HR or call an attorney generally.
