When you sell a house / property with existing tenants, any existing lease agreements come with the property in the sale. In many states, even a non-paying person living in the home is considered the legal equivalent of a tenant on a month-to-month lease after a certain amount of time. So she would need to legally end that tenant situation before selling.

I know they mean well, but they're potentially wrong depending upon the state. I had a similar situation where an ex girlfriend completely refused to leave and the state (GA) completely sided with her. Between squatter's rights and eviction extensions/complications, I was looking at somewhere around 2-5 YEARS to MAYBE get her out. Oh, and in the state of GA, if you're evicting someone from a shared living space and there is ANY dispute over what belongs to who, they either have to evict EVERYTHING in the house (your stuff included) or send you back to court for yet another extension. Calling the cops and simply having someone removed is not how that works.

She has to give him a notice to get out (how long depends on the state, but usually 30 days) and THEN she can start eviction proceedings. How long that takes is super variable depending on the state. She needs a couple of men to move into the house with her in the meantime to keep her and the property safe.

He shows all the tell-tale signs of being an abuser - refusing her 'no' on breaking up and moving out. These may seem like small or 'personality' issues that can be dismissed, but they are exactly the early signs of an abuser. He also seems to be a sponge (another sign) with her paying the mortgage so that he gets subsidized accommodation. He possibly does not contribute to the bills, or reliably so, hence she is in financial distress. She likely would not have been in financial distress without him and his children there.

She is stupid for bringing her children into a situation of HER shacking up with a "boyfriend." What a selfish thing to do. The only good thing to come out of this is her being able to teach her children what NOT to do.

My ex husband wouldn't leave. He was physically abusive. So when he went to work, l packed up all his personal belongings except his clothes in boxes. It took him almost 3 weeks to find himself a rental and move out. Choose a realtor, sign the papers, tell your boyfriend to move out. Call the police if he doesn't leave. Tell the police that you've ended your relationship. Listen to your instincts. Listen to your gut.

Police will 100% escort an ex out of your home if they refuse to leave. If he is not paying rent, not on a lease or hold ownership they will watch him pack his stuff and leave the property. She does NOT need an eviction notice. Had a relative that dealt with this.

That all depends - state and local laws, whether or not there is any lease/paperwork, whether or not he pays any bills, etc. It's not the same in every situation or location.

He is a tenant and the unlawful detainer statutes need to be followed. Could take months to evict him. In the meantime, he and his kids will probably destroy the house. Lesson learned. Don’t shack up. Stay free until there is a marriage commitment.

He’s JUST a boyfriend, not a husband. He needs to grow up and take care of himself and his kids. She deserves someone who really does love her and her children.
