As long as the prenup gives protection to both parties and your future kids it is fine. If for instance he wanted her to quit working to be a sahm her future earnings will be impacted. She loses years of experience and seniority. The prenup should protect her in that case

Agree with this! Usually there are clauses that protect the other partner. It’s not clear cut like he keeps everything most prenups have clauses like “if married for x amount of time the other party is entitled to xx% of the others assets” “If they have kids your entitled to xx% of assets” My brother signed one with his wife since she has alot of family assets before they got married. After years of marriage and 3 kids the prenup clauses essentially say if they did get divorced it’s 50/50 If the prenup isn’t “fair” it can be contested or thrown out

Well, as mentioned, it make no sense to demand this. he could make sure that his wealth BEFORE marrying should be safe, but i have the strong attitude that if you are in a relationship, you share everything. Maybe it is different in other countries, in germany you will be seen like this He: 1 Million, She zero. Married for 10 years, wealth after divorce - both 3 Million. So 1 million is his, 2 Million are shared 50:50... that is something that is fair. Maybe it is different in other countries?

The flat out rejection of a prenup without even asking about terms is the relationship equivalent of a mugger aiming a pistol at the op's face. His future inlaws getting on board tells you they already considered themselves interested parties in his impending divorce. He must be a complete "bunny in the headlights" for them to let their incredible arrogance get so far out of line he eventually caught a clue.

They ARE!! Any asset you bring into a marriage is YOUR asset. Obviously, there are a few nuances, but that’s the general rule. I know a lot of people think attorneys are blood sucking vultures, but you could lose a lot of assets during a divorce, if you think once you get married 50% of your assets automatically belong to another person, and you don’t seek legal advice. I don’t see why anybody would ever marry, if they would automatically lose an ownership interest in their property.

@@treco2583 they aren't is the thing, major assets are usually protected but it isn't a guarantee for your money. The same way men have been ordered to pay child support for children that aren't their own after filing because their partner cheated, a man was ordered to pay a woman he never married and never even lived with alimony, etc.

You hear about the woman who had sex with an underage student. He grew up became a doctor and then she came after him for child support off her rape baby. Look up Nick Olivas as well. Got a 20 something year old pregnant when he was a minor. She never told him 6 years later the state said he owed 150000 in child support plus back taxes

That's particularly good advice. In many stories where a prenup was brought up just before the wedding, the woman was able to break it by claiming she was pressured into it at the last minute. Something settled before a wedding date was even set would have much stronger standing.

She said she didn't agree to the prenup cause he "didn't trust her" but turns out, he couldn't trust HER as it was obvious that she would stoop so low as try to have an affair with OP's Ex-Best Friend. And even without the prenup, if you had your money and home before the marriage, she wouldn't get a single dime of it and she wouldn't get alimony or property division in the case of infidelity.

This OP has absolutely no spine. When his fiancee was upset at the prenup, all he had to say was either you sign a prenup or give me back my engagement ring. A real man should always be prepared to walk away from ANY relationship. This girl proved she was not worth his time and he would have saved himself a lot of trouble and money by walking away at the beginning of all this drama.

If he told her to sign it or else, she signed and the marriage still failed, she’d walk into court and say she signed the prenup under duress. A judge throws it out as invalid and ALL his premarital assets (the stuff he was trying to protect in the first place) are on the table…and he still gets hosed.

The correct reaction to being asked to sign a pre-nup is to get your own lawyer and make sure that there is a fair settlement in case of divorce. A cash amount could be specified. Regular deposits could be made into a spousal IRA. An agreement on educational funds for future children could be specified.

If you hear a stuttering word about a prenup being “unromantic,” or “don’t you trust me?” or “that’s planning for divorce,” you’ll KNOW you’re dealing with someone you shouldn’t propose marriage to… BTW, this is also why it’s a BAD idea to live with, blend finances or have children with somebody you’re not (and maybe wouldn’t) marry.

Exactly. I'd done this with my first husband (he passed away). A pre-nup not only will protect assets accrued previous to the marriage, but it also protects a surviving spouse if the primary spouse dies, among other protections, ESPECIALLY if you live in a community-property state like I did. In my case, my husband had a rather large debt-load he'd kept hidden from me prior to our marriage. I didn't find out until we first filed taxes together as a married couple, when MY tax refund got yanked to pay debts. When I questioned him why, well, the truth came out. Over $263,000!!! Neither of us had income to pay that kind of debt! What was I going to do? That's where the pre-nup came in. My parents put me in touch with their lawyer. After he'd went over the pre-nup, he found it was basically a bog-standard agreement AND that I was NOT liable for any debt-carryover on my husband's part per the agreement. The other thing I had going in my favor was that I had not benefitted from this debt-accrual in any way - only his ex-wife had. It took time and not a few court appearances to straighten out, but I got my refund (plus interest, courtesy of Attorney Schlink (not his real name) and was not held liable for his debts, only my own ($1,200 for furniture for my apartment while I was still single) and what we'd accrued together ($0!). Whew! After my husband died, however, the IRS and some other debt-holders sued for his debts. That pre-nup saved my butt again, as did the transcripts and adjudications from the previous legal actions. I did wind up not inheriting the moneys and assets he'd gained from his deceased parent's estates, but that was okay. What didn't go to his debt went to his children from his first marriage. That was fine with me. I had his life insurance as sole beneficiary, a smallish amount, but it helped me to have enough funds be able to move with my little boy (from previous relationship prior to meeting late 1st husband) and to live on until I found other employment & a place to live. So, signing a pre-nup really helped ME more than it helped my late husband, who requested it, in the end.

I would have called off the wedding the second she refused siting that "I guess we aren't ready". The parents I would turn into the police. They assaulted OP, they forged documents to sue OP and they harassed him too. They'd spend years in jail. As for your now ex, make sure to tag her in your wedding photos and be passive aggressive towards her. Also, if your ex-friend comes by to defend her, ask him when is it his turn to ask her to sign a prenup, you'll find someone new to lie about you and for her to cheat on him with.

Honestly, hindsight is always 20/20. I’d like to say that as soon as the future-in-laws hired a shoddy PI, and the fiancé was blatantly ignoring her parents terrible behavior, that I would end it right then and there. However, if I put myself in his shoes, I honestly don’t know if I’d have handled it any differently. I do hope that he drops the “best friend”, Mike. That’s not a friend, if you ask me.

I would have stopped trying to keep the relationship once it was clear she was okay with all he parents were doing. I see no reason for the engagement party. By update 2 or 3 I'd step back and see what they're doing next. You want out, don't let the door hit you.

Yes. It was ridiculous that he was still insisting on an engagement party when they hadn't resolved the issue of the pre-nup. They should have put everything on hold until they reached an agreement. OP doesn't come out of this one snelling of roses either. He sounds arrogant and controlling. Banning her entire family from the engagement party before even speaking to her. Not even entertaining the idea of cancelling the party when she said she wanted to. OP is clearly used to getting his own way due to his money and didn't even consider that she might disagree with having a pre-nup. This was never a partnership, and when she realised she'd not be a financial partner, she baulked.

The other problem is that there were no rockets or planes large enough to carry it at the time it was just too heavy. so it was detonated on the ground as a show of how mighty the USSR was. Not really how practical it was IMO

If she didn't want you for your money alone, she would sign the pre-nup. She clearly wants your money and you're in the way of it. You can also bet on it that she wont want a paternity test if you have a child, "because if you loved me, you should just trust me"

No. A prenup is literally pre signed divorce papers. I have never seen a marriage last that had a prenup. And how can it when one or both people have one foot already out the door. And while my experience with these is limited at best. I can honestly say if you feel the need to have a prenup then you aren't ready for marriage.

The prenup isn’t the cause of the divorce what it does do is prevent the other party from taking away premarital assets that they contributed nothing to. There is factual proof that prenups have helped a lot of people or loose everything they worked pre marriage.

Prenups are more helpful then harmful. The only people who have issues with prenups are the people who are looking to screw someone over.

Two things in life one must remember 1. Always get a pre nup, especially if you have major assets, money, property, successful business. You never know what will happen. 2. Always get a DNA test before you put your name on the birth certificate. You don't want to be pay child support for the next 18-24 years

First, always discuss the pre-nup often and long before proposing marriage. It should never come as a surprise but make certain it doesn't by actually communicating. Second, if the girlfriend and her parents lose their minds over the mention of a pre-nup, run! If any one of them does, run! Next, this guy must be lying. He sounds like "everyone is against me." His best friend throws him under the bus then gets involved with OP's fiance even after seeing how crazy they are? Run OP! Run!

Sorry boys & girls, I put the full blame of this situation totally on OP. The moment 'Sarah' put up resistance to a prenuptial, the ring would have been back in my pocket. In fact, the introduction of the prenuptial should have happened long before the proposal ever took place. Her intentions fore or against the pre-nup concept needs to well cemented and understood before the offer of marriage be made. The only drama here should have been how soon can the now Ex be out of the home. Period!

If sarah brings her parents into it and makes it their business that's why they're in it. She is their daughter they are only worried about her best interest not yours. She and her parents are making way too big of an issue out of this so yeah I would be worried about Her trying to take everything that you have. Don’t blame OP for looking for support. (He said he was low on family so all he really had in terms of support was his best friend and Maria(so what if she was his ex. It’s a testament to their characters that they could remain friends after their break up)). His ex sicked her parents on him and his so called best friend betrayed him. If it hadn’t of been for Maria he may have been gaslighted into giving his ex fiancé no prenup then he would’ve been boo-boo the fool while Sarah and his bestie were having an affair under his nose and taking him for everything he got. The only person who wasn’t ready for a relationship was his ex fiancé. All this did was show OP he was with the wrong woman the whole time. He’s reasonable and rational and to me is ready for a healthy relationship.

It would be very difficult to price after the amount of harassment he endured WITH witnesses and the fact that both parties had new partners. Add in that he technically agreed to marry her under the condition of a prenup, then they were never officially contacted by promise to marry. She opted out.

I have got to be honest here. The way OP is acting right now tells me he didn't bring up the prenup politely. While I understand OP was upset he doesn't seem to care Sarah was upset about it. And OP has a right to protect his assets yes. But she has feelings and he needs to be mindful of that. And if it makes her feel better to talk to her parents she can do that. But her parents didn't have a right to do what they did.
