HOA's started in the 1950's. They were originally formed to save the home owners time and money with trash and snow removal, lawn care, etc... But over time HOA's became bureaucratic and now they are downright authoritarian!

Dave honestly didn't sound like he really understood the situation. His answer felt just very "let's go to break", it was in no way helpful or informative...disappointing.

@@matthewdeanl5884 That is the problem. Why do you buy a home with an HOA? Buy a home that is free and clear of an HOA. That is the only way to deal with them. The HOA will ALWAYS ALWAYS ALWAYS ALWAYS are going to find something to display power over your home. They operate like mini goverments

Sadly some parts of this country, every home is part of an HOA. Arizona for example, every place I've looked has an HOA. It's honestly one of the reason I don't want to live out here long term.

They simply launder money by paying for overinflated “repair & maintenance” costs where the contractor then secretly funnels money back to the board member(s)

Not true, HOA was simply not collecting enough money in the past for the foreseeable maintenance. Now new owner have to swallow the bills. Every state should have in place precise rules of condominium good management practices. In Canada, those stupid malpractice stopped in 2000iiish by setting minimum condo fees and others management guidelines

@@Todjcam yup thats exactly how it works. I as the contractor put in a bid for say 10k well they add 3-5k on top and pocket the difference, then its just a matter of writing up the books

No HOA should be able to put a lien on your house and be able to kick you out of a mortgaged house or own house merely because you dont abide by the rules… I think that is a step too far. Fines, community service if you need to work them off… fine but to take someone’s house because they have improper landscaping or colors not approved on the house or something similar… NOPE. Sounds too socialistic. We are so adverse to dealing with ANY risk in life now we are willing to pay to not be free!!! It boggles my mind!

@@robinrynearson7212 I wonder if the individual homeowners are contractually obligated to have the HOA represent them in the lawsuit. It sounds like the caller was not engaged from the beginning. In my neighborhood, people are on social media all the time and word spreads like wildfire whatever issues like this come up, so you really have to be hiding out in your home intentionally trying to ignore people to not know what is going on.

Some people don’t want to live in a neighborhood where the neighbor can accumulate junk cars on their yard and driveway. That’s literally one of the reasons my parents wanted to live in one 😂 To me the lack of freedom isn’t worth it.

Indeed. Heck I hate that kind of stuff. That's why I live in a condo. I like things nice,manicured,orderly,secure,etc.. Even our driveways are stamped/stained concrete. The people where I live aren't the type that needs to work on cars including myself.

I live in a condo in Phoenix, we have 200 units. A few years ago the HOA replaced the roofs and the contractor found three units where some rain had gotten in and caused some mold. We don't get very much rain in Phoenix thank goodness. The HOA took care of the problem for the three homeowners out of the general fund. I think that was the right thing to do rather than charge them thousands of dollars. We have a well managed HOA.

Not Dave's finest hour. No one is gonna buy it, he's gotta disclose the $27k legally and as a good Samaritan. He can try but "just sell it" is incredibly obtuse.

Yeah, selling it *might* be the right course of action, but it's impossible to know without more information. Does this guy have 27k in the bank to pay the bill? Does have have 27k in equity in the townhouse? If he has it in equity, it might be worthwhile to sell it for 27k below value with the buyer expecting to pay that 27k. But just telling him to sell it is useless. My advice would be to call a lawyer. A lawyer needs to read through the HOA document and find out what recourse their is for failing to administer properly. Do members have the right to look at the books? Can he hire a forensic accountant to look at the books? These questions need to be answered before the HOA gets a dime.

Yeah, plus the caller sounds like a novice owner anyway, he asks if he should talk to his neighbors?? Duh! When my HOA board suggested raising fees a lot recently, I spoke to a few neighbors, and so on - that kind of news spreads like wildfire. Then a bunch of us joined the zoom call, and problem solved.

See, I respect this. You know an HOA isn’t for you and you intentionally choose to buy outside of one. Completely valid perspective. I struggle with those who buy inside an hoa community and then somehow think rules shouldn’t apply to them. It’s a decision that should be made before dropping $$$$ on a home, not after.

This happened the me in Maryland but it was 44k. Here’s what probably happened. The HOA used all their reserve trying to fix individual homes hoping it was isolated and it’s not. Terrible contractor and probably more than one. I lost my place because the monthly special assessment was more than my mortgage and not enough equity. I’ll live in a tent before dealing with HOA again

That's only the HOAs that you hear about. I just bought land with an HOA. There is no annual assessment. There are only special assessments when the gravel road needs to be re-graveled. And the restrictions are very reasonable.

I live in HOA. The pros are the upkeep of the grounds, security patrolling, resort style amenities. But having to get permission for every little thing is annoying & having to jump through hoops for requests. I wouldn’t buy in an HOA again.

I hope they did it for good. Those little hair cells in the ear are damaged by loud noises and they don’t heal. We don’t want our retirement hampered by hearing loss. Now they need to do the same for Chris Hogan’s show. Way too loud.

I learned this lesson from my parents. They had a house with a HOA, and it was nothing short of a nightmare. I recall that they were trying to charge every homeowner a ridiculous amount of money to invest in a road that doesn't need to be replaced. I'm considering buying my own home in the future, and I won't touch a HOA with a 10 foot pole.

If you have to buy a property with an HOA, make sure to get the meeting Minutes. That is where the Board members discuss the issues within the community. Needed repairs is a given for an older property. I have owned a townhome for over 25 years and special assessments are becoming more frequent due to the age of the property, AND due to the failure of the Board to consistently increase HOA dues over the years to avoid special assessments.

@@giveme10feet Insurance costs, management company costs, etc., can rise, and the state requires so much money in reserves. I would prefer to deal with an every other year increase rather than being slapped with a lump sum special assessment. I am on my fourth special assessment. However, instead of a lump sump, they allowed us to pay $600 a month for 10 months. This is additional to my $300 a month HOA fee. I never plan on buying home regulated by an HOA ever again.

Sounds like the property owners should join together to sue the HOA for mismanagement and loss of value. But yeah, selling sounds like the best way to avoid long-term headache, even it is at a slight loss.

This is why I think all HOA board should automatically be jailed for life and have key thrown away. There is no such thing as good HOA. I never met a good one and probably never will. It's like giving a gun to toddler and now toddler is shooting at everybody.

Typical- hate the neighbors who are willing to volunteer their time to do something you’re unwilling to do. You know if you’re in an HOA you can run for the board and help make sure that it’s doing the right things? Guessing you’re one of those who would never read the CCRs, never understand what they bought, and then blame the “evil board” for your failure to meet legal commitments.

Nothing would be accomplished other than the guy now owing another 10k for the retainer to the lawyer. Situations like this are difficult to prove there was fraud involved. And he would still be left with a rotting structure.

You can always take them to court. I used to work in Small Claims court and HOA vs tenant / tenant vs HOA were there all the time. There's more to this guy's story about what the HOA is trying to do I'm sure.

They wouldn't be since the seller has firm knowledge of the situation he must disclose the issue. This in turn rebalances the sales price downwards to accommodate for the cost of the defect. Bottom line is that he's stuck with the financial impact.

I pay 300 per month in Portland, OR for my HOA, I get a yearly budget. I know where my money is going - you have a RIGHT to know - your are the OWNER, you and your neighbors own the place NOT THE HOA.

Yup. It’s a liability buying into an HOA neighborhood. Read the financials before you buy a townhome or condo. Underfunded and poorly managed HOAs are a nightmare. I learned the hard way too.

There are a lot of areas with no HOA you have to look a lot tell your agent NO HOA at all and they will find those pockets and communities with no HOA. Florida is really big and barely built out yet. Get out of Miami and downtown Orlando etc... 15 m more outside the cities you can find no HOAs.

Location, location, location. They're usually started by the initial builder/developer. Then it's almost impossible to get rid of them because it takes a super majority of the owners to disband them. They're good if the units are for meant renters (if you're the landlord). It keeps other tenants from discouraging another tenant moving in (like if the grass is overgrown, with trash in the yard, and a car up on jack stands).
