And also don't allow a cop to attempt to claim that this makes you look guilty for getting a lawyer, remind them that any cop being accused of a crime would get a lawyer first. OP made a few dumb mistakes, first not getting a lawyer when dealing with the cops, then going to visit his SIL by himself, putting himself in a position where a known liar could make up new lies about him. And she was totally arrogant and had no remorse for her actions. B thinks that because someone else has money that she is entitled to it. What OP should have done was let the rest of the family know what she had done, let them know what kind of a snake she is. The rest of the family deserves to know in case she tries some crap like this with them. WTF, CPS called? Under the circumstances OP would be the last person who would be considered as a possible guardian, also we had all those relatives saying OP went too far in punishing SIL, but none of those chumps could be bothered to take in the child.

Op you made the right decision. Imagine raising her alone in your home and always being on edge. You would have to install security cameras all over your home to protect yourself from evil. Of course, not in nieces room but in the hallway to record the coming & going of her door. That is not a life. You would be in a self-imposed prison

Agreed. You can understand that she was a child and manipulated, BUT she is old enough to know right from wrong, even admitted to knowing it was wrong and caved to the pressure anyways instead of immediately saying “mom is forcing me to say this” during the first interrogation.. I wouldn’t do it either he’d be living on eggshells for the next false accusations from her.. while I feel for her situation, actions (inactions) have consequences. Responsibility doesn’t fall to just OP, she has other family that she hasn’t betrayed.. yet 😕

OP was very lucky that he was cleared so quickly. It could easily ended with him losing his job and any chance of getting reasonable employment, loss of friends, his family repudiating him, and could well have ended in a long prison term.

@@virtualatheist which is why it is important to push for charges and, even if that is unsuccessful, use the information gained by the police through their investigation of the slandered party, to bury her in civil court. Go after every penny paid to date, plus damages, plus compensation. It is guaranteed to bring the truth into the open

Other men have had this done to them and ended up in prison, tortured and then.... OP was wise to not take in his niece. Imagine a few years down, her still being a teen, and getting rebellious -- making yet another accusation to wreck her uncle because she was irritated with him -- and this time making it stick. No one can trust her. She knew what she was doing. She's never going to accept that actions have consequences. Instead, she'd learned that she just needs to be even more conniving to get away with it next time. We've seen this all before.

Once an accusation like that is made, you go permanent no contact with that person and anyone else that enabled them, and hire an attorney for at least a consultation. Even if they retract, there's always an opportunity to repeat the accusation with a more believable scenario, especially if they want something from you. You also lawyer up and file a police report against the accuser as a foundation for defense against future accusations. The niece can stay in foster care or go live with another relative or in a group home. This man is crazy to even consider taking her in, there are other relatives. He says no to her getting an X-box, and off to prison he goes for SA.

This guy should have got a lawyer immediately and the second I found out the gist of what happened and that I was no longer a suspect I’d have gotten a restraining order against both the sister-in-law and the niece. I wouldn’t have been within 500 yards of either one of them for the rest of their lives!! These two would’ve had a restraining order against them permanently and everyone would know why!!

Taking her in was a non starter; highly unlikely the CPS would have considered it in the circumstances. He could never have taken a chance on being alone with his niece again, as she could have made another false allegation. Problem with that sort of situation is the 'no smoke without fire ' aftermath that often lingers.

My thoughts as well. If she was willing to do that once, even if it was part of a scheme from someone who wanted to take advantage of someone else's trust and she was a "kid" when she did, then she risks doing it again. And there's no guarantee that it won't cause worse damage than what could have happened the first time.

on the off chance this isn't fake, always have a lawyer present during questioning from the police. do not let them make you feel guilty for saying you want a lawyer because your rights guarantee you deserve to have one if you find yourself in a situation regarding the police. also do not consent to a search unless they have a warrant because if they find anything they deem as wrong, they will use it against you to charge you. finally, install cameras in your house to prove your innocence in case things like this happen. remember, you have rights and the police do not have the ability to tell you otherwise and say things like "asking for a lawyer makes you look guilty". if you weren't informed of your Miranda rights by the police, you can file a civil suit against the officer/detective

I woulda done it, but also would have security cameras put in EVERYWHERE. It’s someone OP’s niece knows. It’s true, you should be there for family. However, given the circumstances, there could be another chance of this happening, hence the security cameras, blah blah. There honestly was no wrong answer here. OP wasn’t wrong, but the kid needs a good parental figure in their life. Foster care sucks, but since the kid DID push back originally, it’s a bigger tell about her mother. I absolutely hate my family, and they’ve done some nasty, evil shit to me.

Many people get murdered as soon as that awful false accusation is made. It's not even a fast murder, it's usually a group torture. The commentary at the start bothered me. Were the situation exactly as it was initially presented, the protag believes this: that when this girl told her mother that she was being molested by her uncle, her mother should have brushed it off and believed immediately that her daughter was lying. And that when the mother and daughter went to the police saying this guy molested this 13 year old girl, that the police should have immediately declared it a lie and not investigated. Supposing it was a situation where she was telling the truth? Her own mother isn't supposed to believe and comfort her, and take action? It's mom's job to be on her daughter's side first, not his. Irl I'd be happy to learn that the police took it seriously. And while i can understand feeling weird about the kid, she actually does not 'know full well' the consequences of her actions. She has an idea, but there is no way she comprehends that this could end his life basically. She is only 13 and her mother coerced and coached her. The daughter is a puppet and blameless at her age. She is still fully under her mother's authority and trusts her.

The problem with that premise is that the accusation was contrived by the mother, not the daughter, as a way to blackmail and get money out of the OP. She took her daughter to the police station to file a false police report. Both knew it was an utter lie. Now, had the daughter come up with the plan by herself, then yes, the mother should proceed to have the accusation against the uncle investigated.

This is a complicated case, I feel like in the end, the one who's going to be more affected in the long road is the niece, Im not saying OP case is not important or I'm not even saying that his feeling don't matter, but that girl is not on the road to success, but at the same time I can understand OP's feelings about having her on his home. The worst thing is that OP's and the niece's mental state can either get better or go downhill from this moment.

When it comes to situations like this, informally and internally the police have decided you are guilty and you have to prove your innocence. Just shut up and lawyer up. Deal with it in court. Keep your lawyer involved if someone attempts to assassinate your character in the court of public opinion. Above all, don’t react to people and don’t panic.

CPS and the foster care system in general don't care for the childs wellbeing. They look for relatives who can take the child in and if there are none they go into foster care where foster parents are only judged based on 3 main things. Mainly a stable income, spacious home with stable food and water, and no criminal background. If they can pass these requirements and then take a class that teaches those who want to be foster parents how to foster children of the state, then they will start adopting kids to foster where anything can happen. There are lots of cases where the foster parent sexually abuses the child, or even cases where the foster parent is okay, but they take in a new foster kid and an older foster kid molests the young one. The foster care system is not good. You are basically just a person couch surfing until you either get adopted into a forever home or your real parents come to claim you back

I personally feel that anyone who makes a false charge of sexual assault against another person and it proves to be wrong, that person should be charged to the full extent of the law, as possible. Too many times, people have been charged, I jailed for doing nothing. On the occasion that these innocent victims are cleared of these charges, that horrible deed stays in the minds of others. Your sister in law should lose the support of everyone around her. As for the child making the false claims, In one case she is a victim of her mother. But in another, she is also guilty. At the age of 13, the child should know right from wrong. I have to agree with OP filing charges against his SIL. I hope he recorded their conversation. If others think you are harsh scr3w them, they did not live through this. Just the thought of losing everything because of a false charge is immense. I have to agree with him not taking in the niece, I agree that he would look at her and see that betrayal every single time and I think it would eat at him and her and destroy the relationship in the end anyway. In addition, what would happen when the mother returns?

He should have recorded the interaction with the SIL, there were too many risks in that confrontation to have no recording or witnesses (though witnesses could have made the SIL keep up her lies instead of admitting it).

I would've forgiven neice. How do you know she was abused by the mother? But that's pretty hard for an adult to deal, let alone a thirteen year old kid. She did in the end talk to the cops when her mom wasn't around. Maybe her mom was giving her threats or playing with her emotionally.

Sister-in-law is clearly an idiot. If you’re going to blackmail someone with a false accusation, you go to the TARGET with the effort, not the investigators whose job it is to determine the facts of the matter. You don’t bring the cops in unless it’s a consequence for failing to pay up, and you’re confident you can get the frame to stick.

So none of thw supposed family members berating them for letting charges proceed where willing to take the niece in actually just like they didnt help them to begin with. The others who understood op either couldn't or wouldnt either lol. But op didn't have to be such a droma queen about it. He had a niece who would have done anything to anyone for him if he took her in and gave her the basic necessities of life, emotional support and such.

Op should have talked to his niece she's 13 known it was wrong but pressured to do it by her Mom most people would have done the same thing in her situation I could have said if I was the nieces age in the same situation I would have said no but until I've been in that situation I don't know what I would have the chances are I would have do the same thing as the neice you'll do the things your parents say whether its right your wrong because you love them not sticking up for any of them (op and niece) mother (sil) deserves it but op and niece should have had along talk

The niece didn't deserve to be left to the system. OP should have taken her in even though she had a major part of his accusation. She was 13 years old, an age in which she was easily manipulated by her mom who she had the most trust in. As stated by the detective she said she knew it was wrong and didn't want to do it but her mom said it was the only way. This line of thinking leaves it obvious that the kid had no choice but to listen to her mom even if it went against her beliefs. Now that you have taken away the negative influence you now have the ability to raise and teach her properly without the idea that saying and doing anything is okay as long as it gets you what you want. But because the OP left her in the custody of the state she will grow up constantly changing foster cares and potentially being sexually abused by either the care parents or the older foster children that might be present in the home. She will grow up to resent the OP for leaving her in such a situation as well as being the cause of her being put in that situation for pressing charges on her mother which resulted in her arrest. In my opinion, the OP did the WORST thing by refusing to shelter his niece and his brother is probably rolling and cursing in his grave for leaving his daughter up to the shitty fate that is the US foster care system. Although they make it seem like they do extensive work to make sure the foster parents are up to standard and will give proper care to the child, in fact all that is required is a stable income, a big enough house with a stable food source, and no criminal background. As long as you meet these requirements and take the class required then you can start to foster kids and what happens after that will only be known by the foster parents and the child and those who these two parties decide to tell if they tell. There are no real wellness checks unless the child is known to be troublesome while all other meetings with the child and the service worker are done outside the home. In the end I just hope the mother didn't get much prison time so she can get out and reunite with her child even if she is a bad influence as I would trust her to care for her daughter more than the state. Perhaps seeing and experiencing the consequences of her actions will actually leave her as a better person due to this experience
