It is a crime. A police report is a filing affidavit of probable cause as required by the 4th amendment. This is done under oath and penalty of perjury. The problem is DAs and Judges holding them criminally liable. The DOJ could have stepped in and charged him and the others with 18US241 Conspiracy to deprive and 18US242 Deprivation of rights under the color of law. But we see that they have chosen not to enforce the law. That is why we don't see reform in law enforcement. Not because we don't have the legislation or laws.

@@dhtango In the first video it showed the now fired cop saying to his supervisor on scene what happened, he explained how she cracked the window and then says how because she did not get out the car he pulled her out and slammed her to the floor. During all of this the supervisor is seemingly accepting everything he says as routine procedure. The supervisor should have asked "why did you want her out of the car, did you suspect she had a weapon? Why did you reasonbly suspect her to have a weapon?" "Why did you slam her to the floor? What reason was there for that level of force?" Supervisor and the culture of US cops is the problem.

As a former law enforcement officer in Florida I can tell you how to solve this 1)Require all departments to have recruits take the Minnesota Multiphasic Personality Inventory Assessment test to identify mental disorders of recruits before hiring 2) Hold Field Training Officers accountable for all officers they train 3) Hold the immediate supervisors accountable for the performance of their subordinate officers 4) Require agencies that terminate an officer for violating laws and policies to petition the state to remove that officers certification When an officer has his certification revoked he cannot work for another agency. I agree no law enforcement officer should ever strong arm any one for something so trivial as this minor charge when clearly there was no clear threat or provocation. Additionally, this officer and his supervisor apparently violated the civil rights of this lady on several counts. However, it should be noted the young lady was not a minor and had reached age of majority. I really hope the jail or processors did not run her through the "ringer" at booking and processing. This young lady by rights should retain counsel and investigate going after the officer individually and the city for possible civil rights violations and whatever else may apply.

Or because he wasn't there and the stop involved a kid he knows, the officer could have been saying "whatever you have done here better be fully documented and corroborated by evidence or witnesses". Knowing the resource officers at my kids schools, they all have had the every kids best interest in mind. Even the trouble makers, the resource officers always wanted the best outcome for the kids. Maybe this is just in my experience, and yes there are always exceptions to the rules.

The one I think you're probably referring to as 'his buddy' in all fairness had no knowledge of what happened before he arrived, he pulled up after the girl was off the floor and back on her feet didn't he? so all he may have had to go on was what the officer told him, and nothing left for him to intervene in by that time. Also iirc I think someone said that one was campus police? so is that a real cop or just glorified private security staff employed by a university? that would make him about as able to intervene as an ordinary member of the public wouldn't it? and just as likely to end up cuffed and arrested if he tried I imagine? assuming (being clearly armed) he wasn't shot 'in self defence' 'for the officers safety'

@@pelinoregeryon6593 Most colleges and universities have their own sworn police department. At least where I'm at (Michigan). Most likely if he was associated with the college he was campus police; dually sworn and with full law enforcement powers. But if the offense took place off campus jurisdiction defaults to the local/county department. On that scene he wouldn't have much power or authority unless the city has a reciprocity agreement with the college granting them jurisdiction authority.

I’m 99% certain this case will not fall under qualified immunity. For starters if there was a case that is somewhat similar to this in their jurisdiction then that will take away qualified immunity. Lying on the police report also takes away qualified immunity. The fact that they fired this cop shows that they know he done wrong which will help with a lawsuit but instead of admitting they done wrong they said they fired him for safety reasons. I believe they said safety reasons that way it will be harder to win a lawsuit. Them saying it was for safety reasons was just to cover their tails. Regardless though they will win a lawsuit but when no one is hurt then it’s usually under 50 thousand. Most times if someone wins millions in their lawsuit then someone either died or was seriously hurt.

The City prosecutor has to rely on the information his or she is given by the police. There is no way in the world that he can investigate every charge for veracity. I do agree that the now ex-cop should be charged for filing a false police report (among other things), which his a crime.

@@Shylock10 you can't honestly do your job if you don't have some sort of way to verify the info provided by police is true. this case exemplify the reason why. once you decide to prosecute someone, surely the gas station video as well as the dash cam and body cam are available. these would be crucial to make your case in court. why did the prosecutor ( and his office) not catch this but TCRL did? someone isn't competent at their job.

But what I'm dying to know is; since we all know that pretty much the entire pretext the officer gave for assaulting and falsely arresting (kidnapping) this poor girl is an outright lie, what is the *REAL* reason why he decided to abuse his authority and attack her? She's obviously being completely compliant in the video, so what was this asshat's problem with her? Has a court specifically ruled that's it's illegal to bodyslam a blonde at gas station after fabricating a pretense about her window? Maybe a court ruled on something similar, but she was brunette at a McDonald's??? In that case, this cop might still have a chance!

The officer lied through every step of the process, hence the reason all charges dropped. He proved himself untrustworthy. That's the reason he was fired. Falsifying a report is a felony offense, but I imagine you're not bright enough to much of anything pertaining to law. The fact the girl's driver license was on the ground would mean she did have it in hand until she was brutally removed from her car for no probable cause and brutally slammed to the ground. The best part is she was the only one with a level head during the whole situation. But go ahead and live in your liberal dream land where the world revolves around your brain dead ideas. If a black was in the same situation it would have been on every major news outlet.
