The morning session of Day 26 of the ongoing trial of romance novelist Nancy Crampton Brophy is underway.
Crampton Brophy was arrested in September 2018 in the shooting death of her husband Daniel Brophy.
Daniel Brophy, 63, was killed as he prepped for work at the Oregon Culinary Institute in southwest Portland on June 2, 2018.

Overstreet is a rockstar. His cross examination of Nancy Brophy will be something watched for years to come. His understated and relatable approach was fascinating to watch. No arrogance. Just passion in pursuit of justice for Dan. He was the perfect opponent for NB. I'm embarrassed to say how many times I've watched that cross.

There were too many unexplainable circumstances. The defense was essentially forced to put her on the stand. But NB was convinced she’d be able to weave her story & sway the jury. That’s always the fatal flaw of narcissists-they overestimate their own abilities & underestimate everyone else around them.

😂 he asks ill-formed questions and then gets upset when people don’t respond according to the script that he has running in his mind. He’s B grade at best. He’s lucky this defendant is so obviously guilty.

Prosecutor is doing great, really presenting everything clearly and methodically breaking down each aspect of the crime and the planning. And directly calling out the total BS the defense has been spewing. Was particularly glad he highlighted the instructions about racial bias, and how offensive it is that the defense is trying to do just that in attempts to implicate Oscar Taylor. Enjoying this immensely!

@blueneptune825 I was hoping the camera would have focus on her during Mr. Overstreets closing too. At least the jury got to see her. I bet she was looking down and writing / taking notes. Her notes probably were. I am Fu}%ed and going to jail. Almost like a grade school teacher would make a student acting out of sorts to write 100 times I will be a good boy/girl for my teacher . Lol think about it . (Her writing that 100 times) Not sure if anyone reading this remembers when NB atty Ms. Maxfield asked NB what she has bought to further her writing , all she mentioned were handcuffs and night vision goggles , why didn’t she say a ghost gun or the slide and barrel ? At this point everyone knows she bought it . That kinda threw me off. If she truly bought it for writing it would be fine to mention it , actually not a bad idea to.

Considering how protracted this trial has been the Prosecutor did a great closing. He's very easy to follow. Unlike the Defense he doesn't go into long tangents, I had no problems paying attention.

he was brilliant...I listened to every word the defense spewed and couldn't even relate to anything she was really trying to say.....everything was so inconsequential....never did get to the meat and potatoes..didn't focus much on June 2nd...orher than Oscar Taylor....would love to see this man bring a lawsuit

Overstreet has done a masterful job prosecuting this case. Still can’t believe he got her to admit that it’s her in the van driving around OCI in the time frame her husband was murdered. I also can’t believe he got her to admit to taking off the slide and barrel of the gun that still had the zip tie in it.

@@l.g.4075 Stunning, yes. Perhaps Nancy was so used to spinning fables and having people around her believe them, she didn't take into account that most people would not. I'll bet she's been manipulating and gaslighting close acquaintances for years and never been called on it. I guess that's why Nancy has ZERO close friends. She had her "writers" group who simply seemed to be in awe of Dan's cooking and Nancy kind of went with that. And she had her toxic nieces and cousin, all 3 of whom were just like Nancy in their story-manipulations and word salad.

Highly impressed with the prosecutions job on this trial. Fantastic closing argument. Takes it from the very first step that morning and pretty much takes the jury on a field trip through every step. I got the feeling throughout the closing that I was a fly on Nancy's shoulder as she went through that day. Only trial I've watched that made me feel that way. Excellent job

It drives me nuts every time I hear the recording of the death notification and Nancy jokes that Dan “isn’t having a good week.” She doesn’t realize how very strange she comes off.

Nancy is so good for nothing, she didn't herself put a bucket under the leaky sink. The NEXT DAY the problem becomes Dan's and he puts the bucket under the sink. In the meantime, wet towels are piling up...

Ok defense is getting even more bizarre. The whole "Dan would never be such a cruel selfish old codger as to want to KEEP his filthy extravagant home" is a TOTALLY weird angle. Their mortgage was $1500/month, you can't find a 1-bedroom apartment for that. Where the hell were they going to move where they'd have a cheaper mortgage?

I'm still shocked she has a degree in economics. Her decision making skills regarding finances are laughable. They had a nice house. Instead of prioritizing their mortgage, Nancy buys more life insurance policy's. Then withdrawals from the 401k to catch up on past due mortgages.

Nancy's vision of riverside condo was about 5 times more expensive than the Beaverton home mortgage, too. She would have had to buy it, then there would have been HOA fees, escalating 'til death. A good size condo by the river maybe costs $1M these days? Even now, the HOA fees might be something like $1k per month. That's what they are around here: more than the mortgage. Plus, The Beaverton mortgage may have been paid off in about 10 years...

A great closing by the prosecution. I think he may have watched the brilliant William Brown, who led the prosecution of Chandler Halderson. He’s totally focused, on point, and is giving a clear picture of NB’s actions. I think she’s pretty much sunk.

Amazing prosecutor, she was so arrogant she wouldn't shut up. He drew out her lack of empathy as well as her sarcasm and planning.Dan was a gentleman and he went to work as it may have been the only joy he had at this point.

Hardly looks at his notes. Finally get the answer to this sad story. Yes money always the money. She is such a story teller. The family must be shocked to find out the truth. He is so good at his job. What a rotten stupid thing to do. She thought she was so smart. What a sad thing to do to your life and think you won't be found out. Plotting and planning all that time while you are sharing your life with him. Life in prison. Plenty of time to write now. Can't sell your books in prison.

Nancy Brophy reminds me of my mum 😢 Not that I think even that my (estranged) mum could have killed anyone. Just her demeanor and her pathology… it’s weird. It’s beyond her ability to feel for others… she can only mimic as required…but really she’s completely unaware of her self-centeredness This story is absolutely tragic. I feel so sorry for Dan ironically “her biggest fan” as his son stated. Poor Dan his unluckiest day was the day he met her and found her lively chatting etc charming… and it sparked something in his laidback accepting personality To watch her total lack of self awareness is shocking. How, how you can get to a point to be so numb to think that someone so kind and wonderful… is so dispensable… it’s truly tragic and bizarre. I feel so sorry for his family

They could still have been able to do gunshot residue testing of the frame and empty magazines. If it had been fired even once, cleaned after or not, it would have tested positive. Not sure why they didn't do this?

Thanks a really good point! Was wondering that myself. They could have even swabbed Nancy's hands/clothing for residue but they didn't. Maybe they were trying to be delicate with a spouse who could slip into shock any moment, but still.....

The time stamps on the videos they found were 3 hours ahead so they were initially convinced there was an explanation for her van being in the vids. Also, she’d been back home for hours by then. Gun shot residue washes off very easily…

I think the prosecutor did well pointing out the discrepancies between brophy’s testimony and defense opening statements- I said before at the start of the trial that it felt like a certain author had written them up and just had their defense team read it for her, making no attempt to actually corroborate any of it w their exhibits or testimony. Nancy was clearly running the show and her defense team let her, right into the ground. Whatever the best story is at the time is what’s getting told

Chris Winemiller did the closing bec. she has a softer approach than the bulldog partner. The idea was to have the jury not be barked at as the last thing they hear from the defense before deliberations.

The Prosecution did a great job and I feel the defense tried their best. Nancy's big personality got into her own way. Her chatter is very annoying and she helped the Prosecution. Excellent closing by Overstreet. But the defense was the saddest closing I have ever listened too. Very boring, low energy and had trouble trying 😴 too defend a lost cause. So sad Dan and family suffer the loss and when you are the smartest person in the room and you are so proud of the fact you gotta pay. I definitely think divorce is something you can recover from murder is forever and deserves a lifetime sentence, no parole, no book, no profit from Dan's death.

You can recover from divorce, but Nancy couldn’t. The couple had almost no tangible assets besides the house. If she got 1/2 the proceeds, it would have been about $125k. Her SS would have been tiny, because she didn’t work and make money. She even said Dan’s was much larger. So, there wouldn’t be enough to live on….She’d have had to go and work at Walmart like regular people.

Speaking of the injured Brophy family, Nancy tried to provide testimony to inform the jury how wonderful she thought her mother-in-law was so the jury would believe the family was on her side, but the family all testified for the prosecution and Dan's son has a wrongful death civil suit pending against his former step-mother. Horrific how she took away their son, father, grandfather. Nancy had no parents or children....she not only murdered her husband in cold blood, but she also lost her step-son and step-grandchildren. She didn't paint the toy chest. Dan did. She even lied about that so the jury would think she did something for Dan's grandchild. Evil.

I just listened to the defense closing and was totally underwhelmed. No passion, nothing to really say except to attack the financial gain part and say how much Nancy loved Dan.

That, and making it seem like you cannot arrive at a verdict of 'beyond a reasonable doubt' with only circumstantial evidence. She did it at the beginning and the end of her presentation, saying it multiple times. I suspect it could have been confusing to the jurors and maybe that is exactly what she was hoping to achieve.

Defense is struggling to make Nancy's financial decisions make sense. As if she had it all under control. This is the lady paying 1k in life insurance policy's instead of investing in Dan's 401k. She was betting on his early death to finance her retirement in Costa Rica.

I really liked this Prosecutor. he did a amazing job considering Nancy is the entire nut bag. he stayed firm and was prepared. She reminds me ALOT of Diane Downs, there is just no dealing with her. none. Mr. Overstreet did amazing and she got the just verdict. i also had a steady crush on him until i saw the wedding ring, sooooo dangit doo. lol. i would have chosen violence if i had to question her.

"She knows his routine." Every day, he does X and she does Y, come hell or high water, blah blah blah. Remember the one exchange about how Dan ALWAYS brought her a Starbucks? Once that came out of her mouth, she just went double-down hognuts crazy repeating it over and over. Jurors' eyes were popping, chins were hitting the floor, as everyone's mouth fell open simultaneously. One little stupid and UNNECESSARY Nancy Brophy lie, and she could have said "oops, I was wrong" at any point, but no. She could've easily said, "Oh, wait. Now I think of it, he didn't bring me a Starbucks EVERY SINGLE DAY of our lives together. Thanks for reminding me." Even when the Health Department shut it down after Mt St Helens erupted right into the bean bin, hubby got her Starbucks anyway, AWWWWW? Said it once or twice, it could've been a mistake. Say it over and over regardless of all evidence and logic, that's Nancy Brophy lying.

I think because we're looking at this from a different place (after verdict) we now know how incredulous her taking the stand is. However, I think people are giving the LEO's way to much credit. They were horrible. From start to finish. Did you see Detective P(don't remember how to spell his name) on the stand? He was awful in every way. So many times law enforcement dropped the ball on this. From this horrifically horrible Judge to the crap ass police work it's a miracle that Nancy was found out. I think it was an act of GOD that got Nancy convicted. Lord knows it wasn't good "police" work.

First or second may not matter, since minimum sentence for 2nd is 25 years behind the barbed wire. For Nancy, that’s incarceration for life.

It is because the categories of murder in Oregon are different from what most states use. Premeditation is not what makes a murder first degree in Oregon. They are online and easily looked up.

Arguing against the motion in limine, defense counsel mentions Mrs. Brophy's "unconstitutional rights." Defendant alluded to several of those. Throughout her testimony, she touched upon all sorts of excuses and random events that - to her - supported her rights to do what she did. Her demeanor suggested she believed her rights included all sorts of despicable acts. Anyone confused about the Freudian slip, "unconstitutional rights"? That's my explanation.

I felt their pain;they had to sit and listen to the defense closing for hours . I would have fallen asleep . Definitely grounds for a retrial ineffective counsel. the prosecution said within the first couple minutes ,that the same and model, and caliper gun that Nancy owned killed Dan. That is not correct. It was the same caliber, however there is no way to know the make and model. Not without the actual weapon being recovered and tested for barrel striations. The defense should have objected tp facts not in evidence .

They actually are right on make....they discussed how a glock leaves a specific imprint on the primer when fired and that shape is able to be identified as a glock. I gurss i should say firing pin impression.There were a few that were similar but not exact and that is how they knew it was a glock.

I have to admit that through this entire trial I've been on the fence...and probably leaning over about to fall on NB's side. I relate a lot to her....same age, I wrote a romance book and bought a sword for research, I got deeply involved in my story and characters. I kept a wide open mind. I had great reasonable doubt. But after hearing the pros closing...I'm finally convinced that she had to have done it. I think the motive is weak...but some ppl are just plain crazy. I got to thinking that it's no wonder Ms. Jacobs and she hit it off so well...birds of feather.

One of the most incriminating things is that Nancy leaves the area and goes directly home, IMMEDIATELY after the time of Dan's murder. If her dopey explanation of "driving around writing" had any validity, why wouldn't we see her van, ambling around in the area, for some time AFTER the murder, huh? Why not? How come? Don't ya think he would've stolen the money in Dan's pockets? His wallet? A bunch of alcohol or something? What other reason would there be for a random person to kill him other than robbery? He wasn't robbed and it was a precision, planned killing. The only person with a motive was Nancy and she lied about being there. She bought a ghost gun, real gun and an extra barrel that magically disappeared. You don't need to question every homeless person in the area to see she did it. That's just another red herring that leads nowhere.

I like the prosecution case, generally, but (perhaps alone) think the closing argument was not well organized. I expected he would go straight through all the most important evidence, showing how a reasonable interpretation incriminated her. Instead, he got into the weeds with the psychologists fairly early, which I thought a distraction.
