Sir My father was working in PSU and joined it as Foreman (Supervisor). He became executive at the age of 57 years. However his salary from income was more than 8 lakhs in last 3 years of service. Now he is retired and income including pension is Rs. 6.3 lakh. Since, equivalence for posts is still pending in his PSU , Govt. under section 9 of office memoranda for OBC NCL determination is considering salary as source of income. There are many pending cases in several HCs to clarify confusion created by section 9 for PSUs. Kindly clarify whether I'm eligible for OBC NCL benefit. Thank you.

Dear Vikash, this case of PSU equivalence is still in contention for PSUs which no clear grade demarcations. I would not be the right person to help you in this as there is a lot of ambiguity in this. Please contact a lawyer for the same.

Thank you. If the salary /agriculture income are not included, then why the Tahsildars are asking for the salary certificate while applying for non creamy layer certificate? And that too, they don't ask the salary certificate for consecutive 3 years. Mostly they ask for current month's salary certificate.

In PSU, if your father is managerial cadre then you cannot claim NC-OBC. Salary does not matter in NC-OBC.

Dear Prateek, I will not be a good judge in your case. As your mother was holding a managerial service in PSU you are not eligible for NC-OBC. But since your mother died during service, I think you should be eligible, but I suggest you take a second opinion from the District Magistrate of your region.

PSU has a problem with the ambiguity of grades. There are some PSUs that are now issuing certificates of grade equivalent. Please ask your father to check with his PSU company HR.

If she is a citizen of India only then she can claim a backward class caste certificate. You can use your father's details and apply for it. Salary is anyway not considered in the income, so there should not be any problem.
