It just shows Vance gets too personally involved. He coerced a confession from a scared kid who incidentally did NOT murder his father. Like Gibbs said, Vance swung an ax at a scared kid. This wasn't good interrogation techniques, its just an abuse of authority. I love Vance as a character, but this scene did not help in that opinion
@Thomas.Wiggin3 жыл бұрын
Bet Fornell and Vance would’ve fought if Fornell was in the episode, McGee, DiNozzo, Gibbs, David, Franks or Fornell would’ve been better

It was coerced but it doesn’t change my opinion of Vance. Cmon y’all. Like we haven’t seen Gibbs do anything similar. Isn’t the boy like 18 in the episode?

@DelishaPowell2 жыл бұрын
@@Thomas.Wiggin you realize that at one point DOJ had an entire case against Gibbs that could’ve put him away for life with proof of obstruction of justice and taking shortcuts to convictions, right? That the only reason he got off is because Vance helped green light a mission in Afghanistan (if I’m remembering correct) the truth is people hate Vance because he’s as much as an alpha personality as Gibbs. As an audience, Gibbs is the MC and therefore the protagonist who we are supposed to like no matter what. But Gibbs has done this and worse to suspects. Let’s not forget how he set up Alejandro to kill his own sister. Anyway, point being they all have been wrong before and taken shortcuts to confession
@DelishaPowell2 жыл бұрын
@@Thomas.Wiggin but in terms of having someone else do the interrogation since he knew the victim, I agree he should’ve. Lol but still Gibbs as done some dirty stuff, including allowing his mother in law to get away with literal murder of a man she also blamed for Shannon and Kelly’s death.

One thing I've always wondered is, wouldn't this "confession" be thrown out of court or seen as "confession under duress" or something?
@readsomebooks6664 жыл бұрын
In a second.
@tiagopatricio38052 жыл бұрын
That is why Gibbs doesn't believe the confession
@americanlegaldefense77892 жыл бұрын
Unquestionably. First, Miranda warnings were not provided as required during custodial interrogation. Police are required to inform a suspect prior to custodial interrogation: 1. Of his right to remain silent, 2. Of the fact that anything he says will be used against him in a court of law, and 3. Of his right to consult with his own attorney or an appointed attorney prior to or during questioning. Police must then ask the suspect if he understands his rights, and then must ask if he is willing to talk. However here in hollywood, they've decided to completely skip over all of this and go straight to the interrogation. For this reason the confession would be thrown out. Additionally this confession would be thrown out for coercion. The Fifth Amendment applies to "compelled" statements. The Ninth Circuit and the Supreme Court have articulated several situations which would lead to compelling circumstances. Age must be taken into account. Any confession from this encounter would virtually definitely constitute a coerced encounter, especially taking into consideration the fact that he is a child and was yelled at to answer the questions.

The core is great source of pride for many families, but not for those whose children don't match up to their parent(s). It's a real-life Prejudice unfortunately to look down at the kids who have issues with their military parent(s). That's why I'm glad Gibbs knew this interrogation wasn't going to result in a real confession because Vance was emotionally compromised and was looking to put the blame on Anyone, especially the one that didn't fit what he believed a military man's son was suppose to be. Vance broke the #1 rule of investigating: "Keep your emotions under control." Nick is "sick" but that doesn't make him a murderer.

Vance should have asked these agents to interrogate Nick. Tobias Fornell- FBI Gibbs- Leader DiNozzo- Lieutenant McGee- Second Lieutenant Reasons Fornell- FBI and Identity Theft case. Gibbs- Retired Gunnery Sergeant. DiNozzo- Estranged from his father due to his absences. McGee- Estranged from his father for not spending time with his folks and putting down his son.

Our mind is pretty much amazing. When we see Nick for the first time, we think he’s guilty, cause Vance told us so. Police told him so. Everybody thinks so. We are looking forward to Gibbs and the team breaking Nick and extracting a confession. But then, it’s Gibbs’s guts. And everything turns upside down. This kid is not a killer, he’s a victim. And then we start sympathizing him. We like him now. We pity him now. We wish him a better future now. Fun, hah? People’s mind is truly fascinating.

@@DelishaPowell Honestly forgot this comment even existed lol. I didn't call Vance a monster. If you can find my other response here (also from 3 years ago), I love Vance as a character. I was just stating facts, that in this specific interrogation, Vance let emotions override his common sense and abused his power as the interrogator.
